SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of this petition under Sec.482 of the Code of Criminal Procedure<br \/>\n\t  the petitioner  &#8211; original accused has prayed for the following<br \/>\n\tmain reliefs in para 7 :-\n<\/p>\n<p>&#8220;(B).\t\tThe<br \/>\nHon&#8217;ble Court be pleased to grant permanent exemption to petitioner<br \/>\n from personal appearance and permit the petitioner<br \/>\n to record her plea and contest her case through counsel,<br \/>\npending before Addl. Sr. Civil Judge and J.M.F.C., Bhavnagar in<br \/>\nCriminal Case No.4651\/2010;\n<\/p>\n<p>(C).\t\t The<br \/>\nHon&#8217;ble Court be pleased to quash the arrest warrant or convert it<br \/>\ninto bailable warrant isused in Criminal Case No.4651\/2010 on<br \/>\n27.6.2011 pending  before Addl. Sr. Civil Judge and J.M.F.C. at<br \/>\nBhavnagar.\n<\/p>\n<p>(D).\t\tPending<br \/>\nadmission hearing and till final disposal of the present petition,<br \/>\nthe Hon&#8217;ble Court be pleased  to stay the operation of arrest warrant<br \/>\nissued in pursuance to order dated 27\/6\/2011 by the trial court in<br \/>\nCriminal Case No.4651\/2010 at Bhavnagar.&#8221;\n<\/p>\n<p>The<br \/>\n\tlearned advocate appearing on behalf of the petitioner  has stated<br \/>\n\tat the bar that he does not press the present petition in terms of<br \/>\n\tpara 7(C) and 7(D). Therefore, present petition is dismissed as not<br \/>\n\tpressed so far as the prayer in terms of para 7(C) and 7(D).\n<\/p>\n<p>So<br \/>\n\tfar as the prayer in terms of para 7(B) is concerned Mr.Manish Shah,<br \/>\n\tlearned advocate appearing on behalf of the petitioner  has stated<br \/>\n\tat the bar that the petitioner  shall remain present before the<br \/>\n\tconcerned Magistrate pursuant to the Non-Bailable Warrant on<br \/>\n\t5\/8\/2011, however, he has requested that suitable directions be<br \/>\n\tissued directing the learned Magistrate to record the plea of the<br \/>\n\tpetitioner  on the very day and liberty be reserved in favour of the<br \/>\n\tpetitioner  to submit appropriate application for permanent<br \/>\n\texemption and the learned Magistrate  may be directed to consider<br \/>\n\tthe same on suitable terms and directions. With above liberty, he<br \/>\n\tdoes not  press the present petition.\n<\/p>\n<p>In<br \/>\n\tview of the above statement made by Mr.Manish Shah, learned advocate<br \/>\n\tappearing on behalf of the petitioner  present petition is dismissed<br \/>\n\tas not pressed even with respect to prayer in terms of para 7(B).<br \/>\n\tLet the petitioner  appear before the concerned Magistrate on<br \/>\n\t5\/8\/2011 pursuant to the Non-Bailable Warrant against her  and the<br \/>\n\tlearned Magistrate is directed to record the plea of the petitioner\n<\/p>\n<p>\t&#8211; accused on the very day and thereafter it will be open for<br \/>\n\tthe petitioner  to submit appropriate application for permanent<br \/>\n\texemption and as and when such application is filed, the same shall<br \/>\n\tbe considered by the learned trial court in accordance with law and<br \/>\n\ton merits and prayer of the petitioner  for permanent exemption can<br \/>\n\tbe considered on  suitable terms and conditions and considering the<br \/>\n\tdecisions of the Hon&#8217;ble Supreme Court  on the issue.\n<\/p>\n<p>With<br \/>\n\tthese present petition is dismissed as not pressed with above<br \/>\n\tliberty.\n<\/p>\n<p>\tDirect<br \/>\nService is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t[M.R.\n<\/p>\n<p>SHAH, J.]<\/p>\n<p>rafik<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Vijiya vs Jitendrabhai on 26 July, 2011 Author: M.R.
