Mr.Pon Senthil Kumaran\n \t\t\t\tfor R.1 to R.6\n\t\t\t       Mr.S.Jawahar for R.8\n\n:JUDGMENT\n<\/pre>\n<p>\tThis appeal is focussed as against the Judgment and Decree dated<br \/>\n15.02.2000 passed in M.C.O.P.No.355 of 1996 by the learned Motor Accidents<br \/>\nClaims Tribunal cum Sub Judge, Srivilliputtur.\n<\/p>\n<p>\t2. The challenge in this Civil Miscellaneous Appeal is relating to the<br \/>\nquantum of compensation awarded by the Tribunal, vide judgment dated 15.02.2000,<br \/>\nto a tune of Rs.3,04,200\/- (Rupees Three Lakhs Four Thousand and Two Hundred<br \/>\nonly) on the following sub-heads:\n<\/p>\n<p>\t(i)For Loss of Income\t\t&#8211; Rs.2,59,200.00\n<\/p>\n<p>\t(ii)For Loss of Consortium\t&#8211; Rs.  10,000.00\n<\/p>\n<p>\t(iii)For Loss of Love<br \/>\n\t\t\tand Affection\t&#8211; Rs.  25,000.00\n<\/p>\n<p>\t(iv) For Loss of Love and<br \/>\n  \taffection to P.7 and R.2\t&#8211; Rs.   5,000.00\n<\/p>\n<p>\t(v) For Funeral Expenses\t&#8211; Rs.   5,000.00\n<\/p>\n<p>\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>\t\t\t\tTotal \t&#8211; Rs.3,04,200.00\n<\/p>\n<p>\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>\t3. Heard both sides.\n<\/p>\n<p>\t4. The learned Counsel for the appellant would contend that multiplier 18<br \/>\nchosen for assessing the compensation relating to the death of an individual<br \/>\naged 35 years is on the higher side.  Accordingly, he prays for reducing the<br \/>\naward.\n<\/p>\n<p>\t5. The point for determination is to whether the Tribunal has arrived at a<br \/>\njust compensation?\n<\/p>\n<p>The Point:\n<\/p>\n<p>\t6. The learned Counsel for the appellant placing reliance on the grounds<br \/>\nof appeal would submit that relating to the death of a person aged 35 years, the<br \/>\nmultiplier cannot be 18 by any standard.\n<\/p>\n<p>\t7. The learned Counsel for the claimants would contend that the wife and<br \/>\nthe five children along with the parents of the deceased are the claimants and<br \/>\nthe matter may be viewed leniently.\n<\/p>\n<p>\t8. Taking a cue from the Second Schedule to the Motor Vehicles Act, if the<br \/>\nmatter is analysed, the multiplier 17 is contemplated for the age group between<br \/>\n30 and 35 years.  Here, the multiplier 18 is applied.  I am fully aware of the<br \/>\nfact that the Second Schedule to the Act, need not be followed in all cases.<br \/>\nBut, here taking into consideration the fact that the deceased at the age of 35<br \/>\nyears died leaving behind his wife and the five minor children, the multiplier<br \/>\n17 would be absolute necessary for  the calculation of just compensation which<br \/>\nwould be a real soccur to the dependants.\n<\/p>\n<p>\t9. I am of the considered opinion that instead of multiplier 18, the<br \/>\nmultiplier 17 could be chosen and accordingly, the compensation under the head<br \/>\n&#8216;loss of income&#8217; would be Rs.2,44,800\/- (Rs.1,200\/- X 12 X 17 = Rs.2,44,800\/-)<br \/>\n[Rupees Two Lakhs Forty Four Thousand and Eight Hundred only].  The compensation<br \/>\nawarded under the other heads need not be interfered with.  Accordingly, the<br \/>\nfollowing formula emerges:\n<\/p>\n<p>\t(i)For Loss of Income\t\t&#8211; Rs.2,44,800.00\n<\/p>\n<p>\t(ii)For Loss of Consortium\t&#8211; Rs.  10,000.00\n<\/p>\n<p>\t(iii)For Loss of Love<br \/>\n\t\t\tand Affection\t&#8211; Rs.  25,000.00\n<\/p>\n<p>\t(iv) For Loss of Love and<br \/>\n  \taffection to P.7 and R.2\t&#8211; Rs.   5,000.00\n<\/p>\n<p>\t(v) For Funeral Expenses\t&#8211; Rs.   5,000.00\n<\/p>\n<p>\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>\t\t\t\tTotal \t&#8211; Rs.2,89,800.00\n<\/p>\n<p>\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>\t10. In the result, this Civil Miscellaneous Appeal is dismissed, reducing<br \/>\nthe award of the Tribunal from Rs.3,04,800\/- to Rs.2,89,800\/- (Rupees Two Lakhs<br \/>\nEighty Nine Thousand and Eight Hunred only).  The interest awarded at the rate<br \/>\nof 12% is reduced to 9% taking into consideration the prevailing rate of<br \/>\ninterest.
