The notice, therefore,<br \/>\n\tcame to be issued by learned advocate on behalf<br \/>\n\tof the petitioner on 26.07.2011 to which in a mechanical way the<br \/>\n\tSection Officer of the Revenue Department has reacted and sent a<br \/>\n\treply that the notice and proceedings are sent to Collector for<br \/>\n\tdoing needful.\n<\/p>\n<p>\tThis, in my view, is<br \/>\n\tnot the approach commensurate with the duty cast upon the State when<br \/>\n\tthe concerned District Collector has unequivocally opined in his<br \/>\n\tcommunication dated 23.10.2008 and when the notice was sent by<br \/>\n\tlearned advocate addressed to the Secretary of the Revenue<br \/>\n\tDepartment, then naturally Collector is not the authority to decide<br \/>\n\tor sent any reply to the petitioner and in my view, therefore, the<br \/>\n\tappropriate authority i.e. State who should have replied to the<br \/>\n\tcommunication in form of notice sent by learned advocate for the<br \/>\n\tpetitioner.\n<\/p>\n<p>\tThe<br \/>\n\tnotice, therefore,<br \/>\n\tis required to be issued for final disposal, returnable on<br \/>\n\t14.10.2011.  It is<br \/>\n\texpected of the State to file reply, if any, clarifying as to on<br \/>\n\twhat ground the communication of the Collector dated 23.10.2008 is<br \/>\n\tnot acted upon.
