              The petitioners in these Writ Petitions are candidates included in<\/p>\n
the rank list published by the Kerala Public Service Commission for appointment<\/p>\n
to the post of High School Assistant (English) in Ernakulam District.          Their<\/p>\n
grievance is that the vacancies available were not reported and that even in<\/p>\n
respect of the reported vacancies, advices were not issued by the Kerala Public<\/p>\n
Service Commission.\n<\/p>\n<\/p>\n
      2.      It is submitted by the counsel appearing for the petitioners, the<\/p>\n
Government Pleader as well as the standing counsel for the Public Service<\/p>\n
Commission that the Writ Petitions can be disposed of in the light of the facts<\/p>\n
disclosed in the statement dated 26.8.2008, filed by the Deputy Director of<\/p>\n
Education, Ernakulam.\n<\/p>\n<\/p>\n
      3.      In the statement, in paragraphs 4 to 6, it is stated as follows:-<\/p>\n
                            “4.     It is submitted that the finalization<\/p>\n
                     of staff fixation for the year 2008-09 is not over.<\/p>\n
                     But at present the total staff strength of H.S.A.<\/p>\n<\/blockquote>\n

\n                                         2<\/span><\/p>\n
                   (English) in Ernakulam Revenue District is 82.<\/p>\n
                   The latest position of different categories are<\/p>\n
                   given as follows:<\/p>\n

It is submitted that out of the 12\n\n<\/pre>\n
                   vacancies available 4 vacancies were reported<\/p>\n
                   to the PSC for making by transfer appointment.<\/p>\n
                   The vacancies were reported as early as on<\/p>\n
                   13.11.2006. Against the 4 vacancies reported<\/p>\n
                   for by transfer appointment the P.S.C. has<\/p>\n
                   advised three candidates who have been<\/p>\n
                   included in the list for appointment under direct<\/p>\n
                   recruitment quota saying that there is no live<\/p>\n
                   rank list for the appointment to the post of<\/p>\n
                   H.S.A. (English) under by transfer category.<\/p>\n

\n                                        3<\/span><\/p>\n
                   The advice was made on 22.1.2008 since the<\/p>\n
                   reporting   of    vacancy    for   by    transfer<\/p>\n
                   appointment.       It  is submitted    that  this<\/p>\n
                   respondent has not issued any appointment<\/p>\n
                   order appointing the candidates advised by the<\/p>\n
                   PSC on 22.1.2008. It is also submitted that<\/p>\n
                   two vacancies which was initially reported to<\/p>\n
                   the District Collector for appointing physically<\/p>\n
                   handicapped candidates under compassionate<\/p>\n
                   employment scheme was reported to the PSC<\/p>\n
                   in the absence of list available with the District<\/p>\n
                   Collector.   Apart from that 6 vacancies of<\/p>\n
                   H.S.A.(English) in Ernakulam Revenue District<\/p>\n
                   have been reported to the PSC for direct<\/p>\n
                   recruitment on 2 different occasion on 6.6.2008<\/p>\n
                   and 11.7.2008.\n<\/p>\n<\/p>\n
                          6.     It is submitted that there are no<\/p>\n
                   qualified hands in the category of P.D.\n<\/p>\n
                   Teachers who are eligible for promotion apart<\/p>\n
                   from that there are no applicants for IDT. It is<\/p>\n
                   submitted that as per Ext.R3(c) order in the<\/p>\n
                   absence of eligible candidate under the<\/p>\n
                   category of PD promotion and Inter District<\/p>\n
                   Transfer, the vacancies set apart from them<\/p>\n
                   has    also  to   eligible candidate   for  post<\/p>\n
                   conversion also. Therefore in the absence of<\/p>\n
                   qualified hands in those categories the vacancy<\/p>\n
                   set apart for them were reported to the PSC.<\/p>\n
                   Therefore this department has no objection in<\/p>\n

\n                                        4<\/span><\/p>\n
                    advising   the   candidates    against    the   6<\/p>\n
                    vacancies reported for direct recruitment. If the<\/p>\n
                    advise is received from the PSC, orders<\/p>\n
                    appointing the candidates will be issued. It is<\/p>\n
                    submitted that this department is not having<\/p>\n
                    objection in adjusting the 3 candidates already<\/p>\n
                    advised by the Public Service Commission on<\/p>\n
                    22.1.2008 against the 6 vacancies reported to<\/p>\n
                    the P.S.C. under direct recruitment quota if this<\/p>\n
                    Honourable Court direct to do so.”\n<\/p>\n<\/p>\n
       4.     The learned counsel for the petitioners submitted that further<\/p>\n
vacancies would arise on the finalisation of the staff fixation for the year 2008-<\/p>\n
2009 and that those vacancies are also liable to be reported before the expiry of<\/p>\n
the rank list on 16.10.2008. This submission is not objected to by the learned<\/p>\n
Government Pleader. He only points out that vacancies are only to be reported<\/p>\n
in accordance with the norms.\n<\/p>\n<\/p>\n
       5.     The learned standing counsel appearing for the Kerala Public<\/p>\n
Service Commission submitted that           the Gazette notification was dated<\/p>\n
26.4.2005 and out of the seven applications received in the by transfer category,<\/p>\n
only one application was admitted.      It is also stated that the four vacancies<\/p>\n
earmarked for by transfer category were filled from the rank list for direct<\/p>\n
recruitment, but advices were cancelled in compliance with the interim order<\/p>\n
dated 6.6.2008 passed      by this Court in W.P.(C) No.4975 of 2008.          It is<\/p>\n

submitted by all the counsel that in the absence of qualified hands for<\/p>\n
appointment in the by transfer category, three vacancies can be filled up by<\/p>\n
advising candidates for appointment from the direct recruitment quota.<\/p>\n
        6.    In the light of the submissions made by the learned counsel for the<\/p>\n
petitioners, learned standing counsel for Kerala Public Service Commission and<\/p>\n
the learned Government Pleader, these Writ Petitions are disposed of with the<\/p>\n
following directions:-\n<\/p>\n<\/p>\n
        (i)   The Kerala Public Service Commission shall issue advice to six<\/p>\n
candidates in direct recruitment quota        for appointment to the post of High<\/p>\n
School Assistant (English) in Ernakulam District as expeditiously as possible.<\/p>\n
        (ii)  The Deputy Director of Education, Ernakulam, shall report all the<\/p>\n
available vacancies of High School Assistant (English) set apart for direct<\/p>\n
recruitment, after finalisation of the staff fixation order for 2008-2009, to the<\/p>\n
Public Service Commission as expeditiously as possible and at any rate, on or<\/p>\n
before 16.10.2008.\n<\/p>\n<\/p>\n
        (iii) It is also agreed that if any such vacancy is reported after<\/p>\n
finalisation of the staff fixation order for 2008-2009, such vacancies also can be<\/p>\n
filled up from the rank list dated 17.10.2005.<\/p>\n

      (iv)   All the exercises referred to above shall be done as expeditiously<\/p>\n
