Acharya for the respondents.\n<\/p>\n<p>2.\tThis<br \/>\nFirst Appeal is preferred by the appellant -Insurance Company against<br \/>\nthe judgment and award passed by the Motor Accident Claims Tribunal<br \/>\n(Auxi.), Fast Track Court No. 5, Palanpur, on 20.7.2007 in MAC<br \/>\nPetition No. 231\/1993.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Vibhuti Nanavati learned advocate appearing for the appellant ?<br \/>\nInsurance Company  has contended that the judgment and award passed<br \/>\nby the  Tribunal is contrary to law, facts and weight of evidence on<br \/>\nrecord.  It is also contended by Mr. Nanavati that Tribunal has not<br \/>\nproperly interpreted the contents of panchnama of scene of offence<br \/>\nEx. 27 and the accident marks in the panchnama found at 6 \u00bd<br \/>\nfeet off the road, meaning thereby, the collision  between the<br \/>\nvehicles took place in the middle of the road, yet, the Tribunal has<br \/>\nnot considered the said issue. It is  proved and established by the<br \/>\nInsurance Company before the Tribunal that scooterist was totally<br \/>\nnegligent and was driving his scooter in a rash and negligent manner,<br \/>\nand therefore, he was fully liable for the said accident. It is also<br \/>\ncontended by Mr. Nanavati that the Tribunal has not considered the<br \/>\nincome of the deceased in a proper way and manner. The deceased was<br \/>\nworking as a  managerial capacity for the sole business of<br \/>\nagricultural, cattle and dairy products. It is also argued by Mr.<br \/>\nNanavati that in light of the latest decision of the Hon&#8217;ble Apex<br \/>\nCourt, the Tribunal has not considered the rate of interest properly.<br \/>\nHe has also contended that the Tribunal ought to have awarded rate of<br \/>\ninterest as 7.5% instead of 9.00%  because the rate of interest would<br \/>\ndepend upon the facts and circumstances of each case and the award of<br \/>\ninterest would normally depend upon the bank rate prevailing at the<br \/>\nrelevant time. Mr. Nanavati has submitted that the respondents are<br \/>\nnot entitled to get any compensatory amount from the Insurance<br \/>\nCompany.\n<\/p>\n<p>4.\tWe<br \/>\nhave gone through the contentions raised by Mr.Vibhuti Nanavati<br \/>\nlearned advocate appearing for the appellant and Mr. Hitesh N Acharya<br \/>\nlearned advocate appearing for the ori. Claimants ?  respondents. It<br \/>\nis true that original claimants have also preferred an appeal for<br \/>\nenhancement of quantum of compensation awarded to them, whereas, the<br \/>\npresent appeal is filed by the Insurance Company. We have perused the<br \/>\ndocumentary as well as oral evidence adduced by both the sides before<br \/>\nthe Tribunal. We have not found any error committed by the Tribunal<br \/>\nwhile passing the award. It appears that the income of the deceased<br \/>\nis properly considered. It also appears that the amount which is<br \/>\nawarded to the present respondents ?  original claimants is just,<br \/>\nproper, legal and reasonable. We have considered the submissions made<br \/>\nby Mr. Vibhuti Nanavati learned advocate appearing for the appellant<br \/>\n?  Insurance Company. Mr. Nanavati has submitted that the rate of<br \/>\ninterest may be reduced as the rate of interest awarded by the<br \/>\nTribunal is on higher side. In the case of <a href=\"\/doc\/1803341\/\">Dharampal &amp; Ors vs.<br \/>\nU.P. State Road Transport Corporation,<\/a> reported in 2008(7)<br \/>\nSCALE 360, wherein, the Hon&#8217;ble Apex Court  has observed that<br \/>\n?Srate of interest would depend upon the facts and circumstances of<br \/>\neach case and the award of interest would normally depend upon the<br \/>\nbank rate prevailing at the relevant time.??  In light of the above<br \/>\ndecision of Hon&#8217;ble Apex Court, we are of the opinion that the rate<br \/>\nof interest which is awarded as 9.00% by the Tribunal, is required to<br \/>\nbe reduced to the extent of 7.5% considering the current bank rate<br \/>\nand rest of the award is required to be  confirmed.\n<\/p>\n<p>5.\tIn<br \/>\nthe result, this Appeal is partly allowed. The rate of interest 9.00%<br \/>\nawarded by the Tribunal in the impugned judgment and award dated<br \/>\n20.7.2007 in MAC Petition No. 231\/1993, is hereby reduced to the<br \/>\nextent of 7.5%.
