Feeling aggrieved by the common order<br \/>\n                      dated 11th June 2010 made by the Joint Commissioner of<br \/>\n                      Commercial Taxes (Appeal), Patna in Appeal Nos. 1\/10-<br \/>\n                      11 and 2\/10-11 the petitioner has approached this Court<br \/>\n                      under Article 226 of the Constitution against the demand<br \/>\n                      for payment of Value Added Tax raised for the years<br \/>\n                      2008-09 and 2009-10.\n<\/p>\n<p>                                   Against the order of assessing authority, the<br \/>\n<span class=\"hidden_text\">                         -2-<\/span><\/p>\n<p>          writ petitioner preferred the above referred Appeal Nos.<br \/>\n          1\/10-11 and 2\/10-11 before the Joint Commissioner of<br \/>\n          Commercial Taxes (Appeal). As per the statutory<br \/>\n          requirement the writ petitioner was required to pay 25%<br \/>\n          of the tax demand as condition precedent. The writ<br \/>\n          petitioner failed to pay such amount. Hence, by order<br \/>\n          dated 11th June 2010 both the appeals were dismissed. In<br \/>\n          other words, the appeals were not entertained at the<br \/>\n          threshold without entering into the merits of the appeals.<br \/>\n          Since the dismissal of the appeals the petitioner has paid<br \/>\n          25% of the tax liability in the month of July 2010. The<br \/>\n          statement is not controverted.\n<\/p>\n<p>                      In view of the fact that the petitioner has paid<br \/>\n          25% of its tax liability under the impugned orders of<br \/>\n          assessment the impugned order dated 11th June 2010<br \/>\n          made by the Joint Commissioner of Commercial Taxes<br \/>\n          (Appeal), Patna is set aside. The appeals are restored on<br \/>\n          the files of the Joint Commissioner of Commercial Taxes<br \/>\n          (Appeal), Patna to be heard and decided afresh.\n<\/p>\n<p>                      The writ petition is allowed in the above<br \/>\n          terms.\n<\/p>\n<p>                      The parties will bear their own cost.\n<\/p>\n<p>                              (R.M.
