Kuriakose, J<\/p>\n<p>      Under challenge in this Writ Petition filed<\/p>\n<p>under Article 226 of the Constitution of India by<\/p>\n<p>the landlord is Ext.P5 order of the Accommodation<\/p>\n<p>Controller permitting the tenant to carry out the<\/p>\n<p>various   items    of   maintenance      and    repairs<\/p>\n<p>described in the A.C. Petition filed by him. Various<\/p>\n<p>grounds are raised in this Writ Petition challenging<\/p>\n<p>Ext.P5.\n<\/p>\n<p>     2. We have heard submissions of Sri.Philip T.<\/p>\n<p>Varghese, the learned counsel for the petitioner<\/p>\n<p>and those of Sri.S.P.Chaly, the learned counsel for<\/p>\n<p><span class=\"hidden_text\">W. P. (Civil) No.30424 of 2010    -2-<\/span><\/p>\n<p>     the respondents\/tenants. Even though Sri.Philip T.<\/p>\n<p>     Varghese addressed strenuously on the basis of<\/p>\n<p>     the various grounds in the Writ Petition, what<\/p>\n<p>     appealed to us most was his argument that the<\/p>\n<p>     Accommodation           Controller under Ext.P5  has<\/p>\n<p>     virtually permitted the tenant to expend unlimited<\/p>\n<p>     amounts and to claim adjustment of such amounts<\/p>\n<p>     against future rent. If Ext.P5 is allowed to stand,<\/p>\n<p>     the respondent will expend several lakhs of rupees<\/p>\n<p>     with the result that the petitioner\/landlord will not<\/p>\n<p>     be able to recover any amount from the<\/p>\n<p>     respondent towards rent. Sri.Philip submitted that<\/p>\n<p>     the building abuts K. K. Road and is in the heart of<\/p>\n<p>     Mundakayam town. If the building is let out today,<\/p>\n<p>     it will fetch at least Rs.6,000\/- per mensem.<\/p>\n<p>             3. Sri.Chaly submitted that as per the<\/p>\n<p><span class=\"hidden_text\">W. P. (Civil) No.30424 of 2010   -3-<\/span><\/p>\n<p>     estimate prepared by the respondents, the total<\/p>\n<p>     cost in carrying out the repairs will be around<\/p>\n<p>     Rs.75,000\/-. He submitted that there is no<\/p>\n<p>     infirmity about Ext.P5 as the landlord had not<\/p>\n<p>     carried out the repairs despite a demand in that<\/p>\n<p>     regard by the tenant.\n<\/p>\n<p>                   4. When we invited Sri.Chaly&#8217;s attention<\/p>\n<p>     to the injustice in the tenant being permitted to<\/p>\n<p>     expend a huge sum of Rs.75,000\/- and permitted<\/p>\n<p>     further to adjust the entire amount towards the<\/p>\n<p>     rent payable for the building Sri.Chaly submitted<\/p>\n<p>     that the tenant is prepared to spend the entire<\/p>\n<p>     amount himself and that no adjustment will be<\/p>\n<p>     claimed by the tenant of the said amount towards<\/p>\n<p>     rent.      We    record   the  above  submission    of<\/p>\n<p>     Sri.S.P.Chaly.\n<\/p>\n<p><span class=\"hidden_text\">W. P. (Civil) No.30424 of 2010   -4-<\/span><\/p>\n<p>             5. We have very anxiously considered the<\/p>\n<p>     rival submissions addressed at the Bar. We find<\/p>\n<p>     much force in the submission of Sri.Philip that the<\/p>\n<p>     rent of Rs.400\/- per mensem presently being paid<\/p>\n<p>     by the respondent is very low, when compared to<\/p>\n<p>     the rent prevailing in the locality. We are of the<\/p>\n<p>     view that in the totality of the circumstances<\/p>\n<p>     attending on this case, it is not just to permit the<\/p>\n<p>     respondent to expend the requisite amount of<\/p>\n<p>     Rs.75,000\/- and then adjust the same against the<\/p>\n<p>     rent payable to the landlord. We feel that this is a<\/p>\n<p>     fit case where the tenant can be permitted to<\/p>\n<p>     expend the entire amount by himself and carry<\/p>\n<p>     out the repairs without any entitlement for<\/p>\n<p>     adjustment of the amounts towards future rent. In<\/p>\n<p>     this context, we are relying on the submission<\/p>\n<p><span class=\"hidden_text\">W. P. (Civil) No.30424 of 2010   -5-<\/span><\/p>\n<p>     made by Sri.Chaly already recorded by us in<\/p>\n<p>     paragraph 4 above. We also feel that the rent also<\/p>\n<p>     can be re-fixed prospectively with effect from 1st<\/p>\n<p>     November, 2010 at the rate of Rs.1,500\/- per<\/p>\n<p>     mensem. It is open to either party to move the<\/p>\n<p>     Rent Control Court by appropriate petition under<\/p>\n<p>     Section 5 for fixation of fair rent. Till such time as<\/p>\n<p>     fair rent is fixed, the respondent shall pay rent at<\/p>\n<p>     Rs.1,500\/- per mensem. The result of the above<\/p>\n<p>     discussion, therefore, is as follows:-<\/p>\n<p>             6. Ext.P5 is modified and the respondent is<\/p>\n<p>     permitted to carry out the various items of repairs<\/p>\n<p>     and maintenance mentioned in Ext.P1 petition at<\/p>\n<p>     his own cost. The amounts expended are not<\/p>\n<p>     liable to be adjusted towards the rent due for the<\/p>\n<p>     building. At the same time, we make it clear that<\/p>\n<p><span class=\"hidden_text\">W. P. (Civil) No.30424 of 2010   -6-<\/span><\/p>\n<p>     the respondents will not be entitled to make<\/p>\n<p>     structural alterations to the building. The works to<\/p>\n<p>     be done by the respondents should be confined to<\/p>\n<p>     what are sought for in Ext.P1. The rent payable by<\/p>\n<p>     the respondents is re-fixed at Rs.1,500\/- per<\/p>\n<p>     mensem with effect from 1st November, 2010.<\/p>\n<p>                                     PIUS C.
