  3 are the c n of the deceased Sri. C.<\/p>\n
J ayachandra and they have filed a claim petition before
\nthe Tribunal under section 166 of M.V.Act. claiming
\ncompensation against the respondents, on account of the<\/p>\n
death of the deceased in the road traffic accident,<\/p>\n
contending that, on 22.11.2003 at about;’i’;–5.Q.’__lpl,Vin,,~.<\/p>\n
when deceased was standing on the left_sid.,e”:’0f  -\u00ab ., <\/p>\n
infront of his Scooter opposite Gurilf\u00e9ij Bai’..o’n l’Se_rvicel<\/p>\n

lorry bearing No. KA.O5.61 -r.l,1:_&m.’,1_\u00bbe  highlfspeed in
\na rash and negligentrnannep’an’d’g’vvd:as.hed against the<\/p>\n
deceased’;  to’: which “he l feilwdown, sustained injuries
\nand   the  thenfurther case of the claimants<\/p>\n
that, deceased  54 years, hale and healthy,<\/p>\n
 wo:fl{ing__g:as__ Intefior…..Decorator and getting the income of<\/p>\n
 _than:v’\u00ab.t?1.5,000\/- per month and looking after the<\/p>\n
welfare Voigthellfamily and due to his untimely death<\/p>\n
clairnantgs V have suffered \ufb01nancially as they have lost<\/p>\n
A “:l,”theli’r~\u00ab_.only source of living. The said claim petition had<\/p>\n
 come up for considg\u00e9tion before the Tribunal. The<\/p>\n
\ufb02<\/p>\n
\/<\/p>\n
Tribunal, in turn, after appreciating the oral and
\ndocumentary evidence and other material available on
\nfile, has allowed the claim petition in part and awarded<\/p>\n
the compensation of ?13,40,000\/- under differentlieads<\/p>\n
with interest at 6% pa, from the date of<\/p>\n
payment. Being aggrieved by the said ‘\u00bb <\/p>\n
award, the Insurer has \ufb01led <\/p>\n
contending that, the inconi_e\u00ab–..of the. deceased; ‘a.sse.sse%d <\/p>\n
by the Tribunal at ?’1__5,000\/gt:ll’:-;.\u00a7er.._\u00bbn1onthl_  higher<\/p>\n
side and it needs to -the quantum of<\/p>\n
Compenslationf,  Tribunal under all the

Z We have heard the learned counsel appearing<\/p>\n
 . for\u00bb-the Insurer and learned counsel for the clairnantsw<\/p>\n
  -~{3ross Objectors at c derable length of time.<\/p>\n

5. After careful perusal of the original records
\navailable on \ufb01le, including the impugned judgment and
\naward passed by the Tribunal, it emerges that, the<\/p>\n
occurrence of the accident and the death \u00abaf”\u00bbrthe<\/p>\n
deceased in the said accident are not in dis’pu.te,’__i’it:__is.,<\/p>\n
also not in dispute that, the deceased a._bout–. <\/p>\n
54 years working as Interior Deczoratoif fiand .’eraI*nin’g__ an d’<\/p>\n
he has filed his Income Tax returns for th.e”‘a_ss_ess::\u00a7nent_V”;<\/p>\n
year 2002-2003 for ?1,11,40a:\/”==,::pax;d for  year 2003-<\/p>\n
2004 for ?2,15,810\u00bb\/;;\ufb017’I’11eL “which comes to<\/p>\n
?3.27,V2’1’8’\/’-2:15′ “”oi'”‘:these two comes to
\n?1,63,t\u00a7’0\u00a32i\/_– ‘which, the income tax of<\/p>\n
?14,Q82\/-d'”‘isV_’d.educ’ted*”nVas submitted by the learned<\/p>\n
 for  parties after making necessary<\/p>\n
 calculatioiis permissible under the Income Tax Act,<\/p>\n
the.__net.~  comes to ?l,49,S27\/– . Out of Which, if<\/p>\n
 i3Fdz  deducted towards personal expenses of the<\/p>\n
ihdeceased, the net income comes to ?99,685\/–. The<\/p>\n
  …_appropriate muitiplier licable to the present case is ’11’<\/p>\n
___’__l_____N_,___,,..\u00bb<\/p>\n
since the deceased was aged about 54 years. Therefore, we
\nre–detern’1ine the compensation towards loss of dependency
\nat ?10,96,535\/– and accordingly, it is awarded.<\/p>\n
6. Having regard to the facts and circumstances<\/p>\n
of the Case, We award a sum of ?10,000\/- <\/p>\n
of consortium, a sum of \u00a7’10,000\/–  <\/p>\n
estate, a sum of ?15,000\/–  loss”  <\/p>\n
affection and a sum ?1iO,Q0O’\/=3_”transpertatibn\u00b0’:<\/p>\n
funeral expenses.\n<\/p>\n
