2\/    18\/04\/2011               Heard learned counsel for the petitioner and<\/p>\n
                     learned counsel for the State.\n<\/p>\n
                               The petitioner is stated to have applied for an<\/p>\n
                     arms licence. It was kept pending awaiting police report.<\/p>\n
                     On passage of sufficient time, the District Magistrate has<\/p>\n
                     rejected it on 23.10.2009 as the police report was not<\/p>\n
                     forthcoming. It appears from the counter affidavit that<\/p>\n
                     subsequently the police report has been made available<\/p>\n
                     on 23.11.2009 though after the rejection.<\/p>\n
                               The Court does not concur with the submission<\/p>\n
                     on behalf of the State that the petitioner may apply afresh<\/p>\n
                     in that light. If the rejection was on the aforesaid ground<\/p>\n
                     only and was attributable to official lapses, the petitioner<\/p>\n
                     cannot be saddled with the burden. Subject to no other<\/p>\n
                     objection in law being there let the licensing authority<\/p>\n
                     now consider his application in light of the received police<\/p>\n
                     report preferably within a maximum period of two months<\/p>\n
                     from the date of receipt\/production of a copy of this
\n                      2<\/span><\/p>\n
     order.\n<\/p>\n
              The writ application stands disposed.\n<\/p>\n<\/p>\n
