(Oral)\n<\/pre>\n<p>             Sonu alias Shinder Pal has filed this petition for anticipatory<\/p>\n<p>bail in case FIR No. 13 dated 26.2.2009 under section 395 IPC, Police<\/p>\n<p>Station Behram, S.B.S. Nagar (Nawanshahar).\n<\/p>\n<p>             I have heard learned counsel for the parties and perused the<\/p>\n<p>case file.\n<\/p>\n<p>             According to the prosecution version, 5\/6 young persons<\/p>\n<p>including the petitioner tres-passed into house of complainant Narinder<\/p>\n<p>Kaur at about 1.00 AM on night intervening 25\/26-2-2009, armed with<\/p>\n<p>sword, dattar and iron rods and started throwing articles out of Almirah, like<\/p>\n<p>searching something. One of them attacked the complainant with his sword<\/p>\n<p>but the complainant ducked and saved herself.         Her cry attracted other<\/p>\n<p>family members. They also cried. The aforesaid culprits thereupon ran<br \/>\n<span class=\"hidden_text\"> Criminal Misc. No. M-23153 of 2009                             -2-<\/span><\/p>\n<p>away. Complainant and her family members followed the culprits. There<\/p>\n<p>was a Qualis vehicle parked outside.        One of the assailants fell down<\/p>\n<p>whereas the other escaped in the vehicle.    The boy who had fallen down<\/p>\n<p>disclosed his name as Manoj Kumar alias Mani and also disclosed the<\/p>\n<p>names of his companions as Kamaljit alias Soma, Sonu i.e. petitioner and<\/p>\n<p>one Parveen Kumar and did not disclose the names of the remaining two<\/p>\n<p>persons. However, Manoj Kumar also gave slip and escaped on account of<\/p>\n<p>darkness.   One mobile telephone, one camera and some cash amount were<\/p>\n<p>found missing.\n<\/p>\n<p>            Learned counsel for the petitioner contended that, in fact,<\/p>\n<p>petitioner&#8217;s co-accused Parveen Kumar had married with the daughter of the<\/p>\n<p>complainant against the wishes of the complainant and they were called to<\/p>\n<p>the house of the complainant for settling the matter but instead of doing so,<\/p>\n<p>the complainant&#8217;s daughter was kept there and this false FIR was registered.<\/p>\n<p>It is contended that Parveen Kumar filed habeas corpus petition in this<\/p>\n<p>Court in which complainant&#8217;s daughter appeared and stated that she wanted<\/p>\n<p>to live with her husband Parveen Kumar.\n<\/p>\n<p>            On the other hand, learned State counsel contended that mobile<\/p>\n<p>telephone which had been taken away by the culprits has since been<\/p>\n<p>recovered from petitioner&#8217;s co-accused Kamaljit Singh alias Sonu.       It is<\/p>\n<p>also contended that a serious attack was made on the complainant but she<\/p>\n<p>saved herself by ducking.       It is also contended that proceedings for<\/p>\n<p>declaring petitioner as proclaimed offender have already been initiated.<\/p>\n<p>The petitioner has been evading arrest for six months.<\/p>\n<p>            Keeping in view the serious allegations that the petitioner along<\/p>\n<p>with his co-accused entered into house of the complainant at odd hour of<br \/>\n<span class=\"hidden_text\"> Criminal Misc. No. M-23153 of 2009                            -3-<\/span><\/p>\n<p>the night and took away mobile phone, camera and cash amount, the<\/p>\n<p>petitioner, in my considered view, does not deserve the concession of<\/p>\n<p>anticipatory bail. The instant petition is accordingly dismissed but without<\/p>\n<p>meaning to express any opinion on merits.<\/p>\n<pre>\n\n\n                                                     ( L.N.
