Tarif Faridbhai Shaikh<br \/>\n\tfor releasing him on regular bail in connection with DCB Crime<br \/>\n\tPolice Station, Ahmedabad I-C.R.No.6\/2003 (POTA Case No.6\/2003),<br \/>\n\twherein the present appellant was arrested on 18.04.2003 and sent to<br \/>\n\tjudicial custody on 30.04.2003.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel appearing for the respective parties and perused the<br \/>\n\trecords.\n<\/p>\n<p>It<br \/>\n\thas been mainly argued by the learned counsel for the appellant,<br \/>\n\tMr.K.G. Shaikh that the present appellant is totally innocent and<br \/>\n\thas been falsely involved in the crime in question. It is also<br \/>\n\targued that though specific direction has been given by the Hon&#8217;ble<br \/>\n\tApex Court as well as this Court, the trial has not been completed<br \/>\n\tby the Court below within stipulated period and yet the trial will<br \/>\n\ttake its own course. It is also argued that the witnesses examined<br \/>\n\tby the prosecution have not supported the say of the prosecution and<br \/>\n\tno incrementing evidence has come on record against the present<br \/>\n\tappellant. It is, therefore, requested that the appellant may be<br \/>\n\treleased on bail.\n<\/p>\n<p>Learned<br \/>\n\tSpecial P.P., Mr.Panchal has drawn our attention that here in this<br \/>\n\tcase, the prosecution has already examined about 168 witnesses and<br \/>\n\tnow approximately 25-30 witnesses are to be examined and the Court<br \/>\n\tis also taking care to deal with the matter as early as possible,<br \/>\n\tfor which, the concerned Judge is visiting and conducting the trial<br \/>\n\tin the Central Jail itself and, hence, the trial will be completed<br \/>\n\tas early as possible. Mr.Panchal has also drawn our attention<br \/>\n\ttowards applications filed by the present appellant before the trial<br \/>\n\tcourt namely Criminal Misc. Application No.47\/2004 and Criminal<br \/>\n\tMisc. Application No.1354\/2007. It is also argued by Mr.Panchal that<br \/>\n\tit is a serious offence and the role of the present appellant has<br \/>\n\tbeen fully established to connect him with the crime in question. It<br \/>\n\tis, therefore, submitted that looking to the seriousness of the<br \/>\n\toffence, the bail is required to be rejected.\n<\/p>\n<p>We<br \/>\n\thave taken into consideration the oral as well as documentary<br \/>\n\tevidence shown to us by the learned counsel appearing for the<br \/>\n\trespective parties along with the reasoned judgment delivered by the<br \/>\n\tCourt below in Criminal Misc. Application No.1845\/2008, which shows<br \/>\n\tthat here in this case, the prosecution has already examined more<br \/>\n\tthan 168 witnesses and as stated by Learned<br \/>\n\tSpl. P.P., Mr.Panchal, now only 25-30 witnesses are to be examined<br \/>\n\tand they are Police Officers. We have also gone through the evidence<br \/>\n\ton record and found that there is prima-facie case to connect the<br \/>\n\taccused with the crime in question. Record also shows that the<br \/>\n\tLearned<br \/>\n\tSpecial Court is dealing with the matter on a day-to-day basis by<br \/>\n\tallotting three days in a week, for that, the Judge is regularly<br \/>\n\tgoing into Central Jail from 11:00 a.m. to 5:00 p.m., wherein Court<br \/>\n\thas been created there itself. It is required to be noted that most<br \/>\n\tof the witnesses are the Police Officers and they are easily<br \/>\n\tavailable and, therefore, the trial will be completed in near<br \/>\n\tfuture. It is required to be noted that other co-accused have also<br \/>\n\tfiled various application before this Court, which we have finally<br \/>\n\tdisposed of. We have also gone through the impugned judgment<br \/>\n\tdelivered by the Court below, wherein the trial Court has dealt with<br \/>\n\tin detail the role played by the appellant especially in paragraph<br \/>\n\tno.6 and, therefore, we are not repeating the same.\n<\/p>\n<p>In<br \/>\n\tview of the seriousness of the offence and this being successive<br \/>\n\tbail application and in view of the fact that the trial is going on<br \/>\n\ton a day-to-day basis, this Criminal Appeal for bail is required to<br \/>\n\tbe rejected and is rejected accordingly.
