Jain<\/p>\n<p>Respondents : Life Insurance Corporation of India<\/p>\n<p>      This second-appeal came up for hearing on 30.06.2009 in the<br \/>\npresence of appellant, respondents \u23af represented by Ms.Richaa<br \/>\nKapoor, Secretary (P&amp;IR), Shri Vivek Sharma, Assistant Secretary (P&amp;IR)<br \/>\nand Shri Gagan Dua, AAO (RTI) \u23af and the representatives of the<br \/>\nthird-parties, viz. the All India LIC Employees Federation, the All India<br \/>\nScheduled Castes Scheduled Tribes &amp; Buddhists LIC Employees&#8217; Welfare<br \/>\nAssociation and the Northern Zone Insurance Employees&#8217; Association.\n<\/p>\n<p>2.    Appellant&#8217;s RTI-application dated 18.11.2008 comprising the<br \/>\nfollowing queries was filed before the Regional Manager (Marketing) &amp;<br \/>\nCPIO, LIC of India, New Delhi:-\n<\/p>\n<blockquote><p>      &#8220;1.    Please let me know the meetings held between<br \/>\n             Management of LIC in Northern Zonal Office with the<br \/>\n             Unions and the welfare associations with dates and<br \/>\n             Agendas of such meetings during the last 5 years. Also<br \/>\n             provide me the certified copies of all such agendas.\n<\/p><\/blockquote>\n<blockquote><p>       2.    The discussions held item wise in the respective Agendas of<br \/>\n             the respective unions and the welfare associations during<br \/>\n             the last 5 years.\n<\/p><\/blockquote>\n<blockquote><p>       3.    The conclusions arrived at after the aforesaid discussions<br \/>\n             between the Management, Unions and Welfare<br \/>\n             Associations.\n<\/p><\/blockquote>\n<blockquote><p>       4.    The compliance of the decisions taken in the aforesaid<br \/>\n             meetings.&#8221;\n<\/p><\/blockquote>\n<p>3.    CPIO   referred the matter to the Employees&#8217; Unions, who were<br \/>\ntreated as   third-parties in respect of the information sought by the<br \/>\nappellant.   According to the CPIO, the Trade Unions objected to<br \/>\ndisclosure   of the Agendas for those discussions and hence the<br \/>\nAT-31072009-32.doc<br \/>\n<span class=\"hidden_text\">                                                              Page 1 of 3<\/span><br \/>\n information was denied to the appellant. Appellate Authority, through<br \/>\nhis order dated 22.01.2009, largely upheld the CPIO&#8217;s contention.\n<\/p>\n<p>4.    Appellant, through his second-appeal, has questioned the denial<br \/>\nof the information to him by the CPIO.\n<\/p>\n<p>5.     It is fairly obvious that this RTI-petition owes its origin to Trade<br \/>\nUnion rivalry in which the agenda for discussion of one with the public<br \/>\nauthority is sought to be accessed by another. CPIO was asked to file a<br \/>\nformal statement about the public authority&#8217;s position regarding<br \/>\ndisclosing contents of the discussions held with Trade Unions. Such a<br \/>\nstatement has been filed by them on 30.06.2009. The sum-total of<br \/>\ntheir submission is, that while it is true that informal meetings between<br \/>\nthe trade union representatives and the public authority are held off<br \/>\nand on; the minutes of the meetings, however, in most cases, are not<br \/>\nrecorded and, in cases where such minutes are recorded, these are<br \/>\ncirculated only to the Trade Unions to which these relate.\n<\/p>\n<p>6.    Appellant had argued before the Commission that the Trade<br \/>\nUnions represent the workers&#8217; interests and, therefore, the discussions<br \/>\nwhich they hold with the public authority regarding the employees&#8217;<br \/>\nwelfare could not be treated as confidential between those Trade<br \/>\nUnions and the public authority. All workers are entitled to know as to<br \/>\nwhat decisions were made through the intervention of the Trade Unions<br \/>\nto promote their welfare and to redress their grievances. In that light,<br \/>\ndiscussions between Trade Union representatives and the public<br \/>\nauthority could not be an exclusive and secret affair between the two,<br \/>\nto which others could not be made privy.\n<\/p>\n<p>Decision:\n<\/p>\n<p>7.    It is directed that a copy of the CPIO&#8217;s communication to the<br \/>\nCommission dated 30.06.2009 shall be provided to the appellant as the<br \/>\nrespondents&#8217; response to his queries.\n<\/p>\n<p>8.    I see no reason why the Trade Unions&#8217; discussions with the public<br \/>\nauthority could be treated confidential between the Trade Unions and<br \/>\nthe public authority, rivalry between Trade Unions notwithstanding.<br \/>\nInsofar as these discussions are only about employee welfare and<br \/>\ngrievance redressal, it is just and proper that these are allowed to be<br \/>\nheld in the open so that all employees are aware of the conservations<br \/>\nbetween the Trade Unions and the public authority and how far their<br \/>\nwelfare was promoted through these contacts. By its very nature, such<br \/>\nAT-31072009-32.doc<br \/>\n<span class=\"hidden_text\">                                                                Page 2 of 3<\/span><br \/>\n information cannot be characterized as private, secret or confidential.<br \/>\nNo exemption Sections of the RTI Act prohibit such disclosure.\n<\/p>\n<p>9.    It is accordingly directed that all records as held in this matter by<br \/>\nthe public authority, i.e. the Life Insurance Corporation of India shall be<br \/>\ndisclosed to the appellant, through inspection of the records, within<br \/>\nthree weeks of the receipt of this order by the CPIO. A notice may be<br \/>\ngiven by the CPIO to the Appellant indicating the time and date when<br \/>\nhe can inspect the relevant records. He shall be authorized to take<br \/>\ncopies of the inspected records on payment of such fee as may be<br \/>\nadmissible.\n<\/p>\n<p>10.   Appeal disposed of with these directions.\n<\/p>\n<p>11.
