    Revision  petitioner  is  the  accused  and<\/p>\n
first    respondent    the    complainant    in<\/p>\n
C.C.1283\/2004 on the file of Judicial First<\/p>\n
Class   Magistrate,   Mavelikara.      Revision<\/p>\n
petitioner was convicted and sentenced for the<\/p>\n
offence  under   section   138  of   Negotiable<\/p>\n
Instruments   Act.        Revision   petitioner<\/p>\n
challenged  the  conviction  before  Additional<\/p>\n
Sessions Court, Mavelikara in Crl.A.44\/2007.<\/p>\n
Learned   Additional    Sessions    Judge    on<\/p>\n
reappreciation  of   evidence   confirmed   the<\/p>\n
conviction and modified the sentence to simple<\/p>\n
imprisonment   for    three   months    and   a<\/p>\n
compensation of Rs.50,000\/-.  Revision is filed<\/p>\n
challenging the conviction and sentence.<\/p>\n
    2.  Learned counsel appearing for revision<\/p>\n
CRRP 234\/2009               2<\/span><\/p>\n
petitioner was heard.\n<\/p>\n
     3.    Learned counsel  submitted that in view of<\/p>\n
the evidence on record and the concurrent findings<\/p>\n
of fact, revision petitioner is not challenging the<\/p>\n
conviction but the sentence may be modified and he<\/p>\n
is   ready    to  pay  the   amount  covered  by   the<\/p>\n
dishonoured cheque to first respondent and time may<\/p>\n
be granted for payment.\n<\/p>\n
     4.      On going through the judgments of the<\/p>\n
courts below, I find no reason to interfere with<\/p>\n
the conviction.\n<\/p>\n
     5.    Evidence establish that revision petitioner<\/p>\n
borrowed Rs.2,00,000\/- from first respondent and<\/p>\n
towards its repayment issued Ext.P1 cheque which<\/p>\n
was dishonoured for want of sufficient funds, when<\/p>\n
presented for encashment.      It is also established<\/p>\n
that    first   respondent   had  complied  with   all<\/p>\n
statutory formalities provided under section 138<\/p>\n
and 142 of Negotiable Instruments Act.        In such<\/p>\n
circumstance, conviction of the revision petitioner<\/p>\n
CRRP 234\/2009               3<\/span><\/p>\n
for the offence under section 138 of Negotiable<\/p>\n
Instruments Act is perfectly legal.<\/p>\n
     6.      Then   the  question  is  regarding   the<\/p>\n
sentence.     So long as the sentence is not altered<\/p>\n
or varied against the interest of first respondent,<\/p>\n
it is not necessary to issue notice to first<\/p>\n
respondent.      As   per  the  sentence  modified by<\/p>\n
Additional Sessions Judge, first respondent is to<\/p>\n
get a compensation of Rs.50,000\/- only.         Ext.P1<\/p>\n
cheque     is  for  Rs.2,00,000\/-.    Considering  the<\/p>\n
entire     facts  and   circumstances  of  the   case,<\/p>\n
interest of justice will be met if the sentence is<\/p>\n
modified to imprisonment till rising of court and a<\/p>\n
fine of Rs.2,00,000\/- the amount covered by the<\/p>\n
dishonoured cheque.\n<\/p>\n
     Revision is allowed.    Conviction is confirmed.<\/p>\n
Sentence     is  modified.    Revision  petitioner  is<\/p>\n
sentenced to imprisonment till rising of court     and<\/p>\n
in default simple imprisonment for two months.      On<\/p>\n
realisation of fine, it is to be paid to first<\/p>\n
CRRP 234\/2009             4<\/span><\/p>\n
respondent as compensation under section 357(1)(b)<\/p>\n
of       Code  of  Criminal  Procedure.    Revision<\/p>\n
petitioner is granted to six months time to pay the<\/p>\n
amount. He     is permitted to pay the compensation<\/p>\n
directly     to first  respondent and  produce   the<\/p>\n
receipt and satisfy the Magistrate that fine, which<\/p>\n
is to be paid on realisation as compensation      to<\/p>\n
first respondent was paid. Revision petitioner   is<\/p>\n
directed to appear before the Judicial First Class<\/p>\n
Magistrate, Mavelikkara on 3.7.2009.<\/p>\n
