The learned Judge has<br \/>\nawarded an amount of Rs.1,00,000\/- (Rupees One Lac) as lump sum<br \/>\ncompensation in lieu of reinstatement.\n<\/p>\n<p>2.\t\tLearned<br \/>\nAdvocate for the petitioner states that an amount of Rs.1,00,000\/-<br \/>\n(Rupees One Lac) is already paid to the respondent-workman on<br \/>\n06.07.2011.  The learned Advocate for the respondent-workman<br \/>\nsubmitted that an additional amount of Rs.80,000\/- (Rupees Eighty<br \/>\nThousand Only) towards arrears of back wages is required to be paid.\n<\/p>\n<p>2.1\t\tLearned<br \/>\nAdvocate for the petitioner, on instructions from Shri Bhaveshbhai<br \/>\nPatel, Partner of the petitioner firm, states that according to the<br \/>\npetitioner, if at all any amount is to be paid, it could be anything<br \/>\nbetween Rs.22,000\/- to Rs.25,000\/- and that will meet the ends of<br \/>\njustice.\n<\/p>\n<p>3.\t\tAs<br \/>\nagainst that, learned Advocate for the respondent-workman submitted<br \/>\nthat if at all the respondent-workman has to waive something then<br \/>\nalso, the amount cannot be less than Rs.50,000\/- (Rupees Fifty<br \/>\nThousand Only).\n<\/p>\n<p>4.\t\tTaking<br \/>\ninto consideration the Diary produced by the learned Advocate for the<br \/>\nrespondent-workman for perusal and the documentary evidence made<br \/>\navailable for perusal by the learned Advocate for the petitioner, the<br \/>\nquestion falls within the ambit of &#8216;disputed facts&#8217;.  But, as both<br \/>\nthe parties have left the matter to the Court, the Court is of the<br \/>\nopinion that it will be in fitness of things if the petitioner is<br \/>\nasked to pay an amount of Rs.40,000\/- (Rupees Forty Thousand Only) in<br \/>\nfull and final settlement and the respondent-workman will have no<br \/>\nfurther claim against the petitioner.  This amount of Rs.40,000\/-<br \/>\n(Rupees Forty Thousand Only) will also include cost of Rs.1,000\/-<br \/>\n(Rupees One Thousand Only).\n<\/p>\n<p>\t\tOrder<br \/>\naccordingly.\n<\/p>\n<p>5.\t\tThe<br \/>\npetitions are disposed of with the aforesaid directions.  Notice is<br \/>\ndischarged.
