Heard learned counsel for the petitioner and<\/p>\n<p>                     the Union of India.\n<\/p>\n<p>                              2. At the relevant time petitioner served as<\/p>\n<p>                     Motor Vehicle Inspector in the bifurcated State of<\/p>\n<p>                     Bihar. He has filed this writ petition questioning the<\/p>\n<p>                     order of the State Advisory Committee bearing Memo<\/p>\n<p>                     No. 700 dated 18.12.2006, Annexure-1, whereunder in<\/p>\n<p>                     compliance of the order of the High Court dated<\/p>\n<p>                     11.9.2006 passed in the earlier writ petition filed by<\/p>\n<p>                     the writ petitioner bearing C.W.J.C.No. 14544 of 2004<\/p>\n<p>                     cadre of the petitioner has been finally allocated in the<\/p>\n<p>                     bifurcated State of Bihar ignoring his option for<\/p>\n<p>                     allocating Jharkhand as the cadre for the reason that<\/p>\n<p>                     his home district is in the State of Jharkhand. In this<\/p>\n<p>                     connection learned counsel for the petitioner has<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>referred to Paragraph 7.6 of the minutes of the State<\/p>\n<p>Advisory Committee dated 31.10.2001, Annexure-2,<\/p>\n<p>whereunder it was resolved to consider the case of all<\/p>\n<p>the reserved category except S.T. for allocation of cadre<\/p>\n<p>together. Reference in this connection has also been<\/p>\n<p>made to Paragraph 7 (g) (i) of the earlier counter<\/p>\n<p>affidavit filed by the Deputy Secretary of the State<\/p>\n<p>Advisory Committee, Bihar, Patna in the earlier writ<\/p>\n<p>petition filed by       the   petitioner which is   quoted<\/p>\n<p>hereinbelow for ready reference:-\n<\/p>\n<p>         &#8220;(i). The quota of personnel that remains<\/p>\n<p>available for each state if first filled up by those having<\/p>\n<p>home district in that state and who have also exercised<\/p>\n<p>option for that state.&#8221;\n<\/p>\n<p>         3. It is submitted on behalf of the petitioner<\/p>\n<p>that had the State Advisory Committee considered the<\/p>\n<p>case of the petitioner strictly in terms of the minutes<\/p>\n<p>paragraph 7.6 and the contents of Paragraph 7(g) (i) of<\/p>\n<p>the counter affidavit petitioner ought not to have been<\/p>\n<p>retained in the State of Bihar but allocated to<\/p>\n<p>Jharkhand State. It is also submitted that while<\/p>\n<p>allocating the cadre of others named in the petition the<\/p>\n<p>instructions contained in paragraph 7.6 and the<\/p>\n<p>contents of paragraph 7(g)(i) of the counter affidavit<\/p>\n<p>was relied upon but the case of the petitioner for<\/p>\n<p>reasons best known to the State Advisory Committee<\/p>\n<p>was not considered in the light of the minutes and the<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>         contents of the counter affidavit.\n<\/p>\n<p>                  4. During the pendency of this writ petition<\/p>\n<p>         the State Advisory Committee has become defunct. In<\/p>\n<p>         the circumstances, no useful purpose will be served by<\/p>\n<p>         quashing the order of the State Advisory Committee,<\/p>\n<p>         which   is   subject       to    the   final    approval   by    the<\/p>\n<p>         Government of India. It is submitted on behalf of the<\/p>\n<p>         petitioner that till date no order has been passed by the<\/p>\n<p>         competent authority of the Government of India finally<\/p>\n<p>         allocating the petitioner bifurcated State of Bihar as his<\/p>\n<p>         cadre. In such view of the matter, I grant liberty to the<\/p>\n<p>         petitioner to challenge the order bearing Memo No. 700<\/p>\n<p>         dated   18.12.2006          (Annexure-1)        passed     by    the<\/p>\n<p>         Chairman of the State Advisory Committee before the<\/p>\n<p>         competent    authority          of   the    Union   of   India   i.e.<\/p>\n<p>         Department of Personnel,                   Public Grievances and<\/p>\n<p>         Pensions, Respondent No. 1 herein. The challenge<\/p>\n<p>         made by the petitioner to the aforesaid order dated<\/p>\n<p>         18.12.2006, Annexure-1 be considered as expeditiously<\/p>\n<p>         as possible by the competent authority of the Union of<\/p>\n<p>         India, in any case within a period of three months from<\/p>\n<p>         the date of receipt of the challenge.\n<\/p>\n<p>                  5.
