From the grounds of detention, it<br \/>\nappears that two offences being III CR Nos.328 of 2009 and 384 of<br \/>\n2009 have been registered against the detenue.  Both the  offences<br \/>\nhave been registered with Amroli Police Station under the provisions<br \/>\nof Sections 66(1)B, 65EA, 81 and 116(1)B  of the Bombay Prohibition<br \/>\nAct, wherein total quantity of 93 bottles of foreign liquor was found<br \/>\nfrom the possession of the detenue. On the basis of registration of<br \/>\nthese cases, the detaining authority held that the present detenue<br \/>\nwas carrying on activities of selling foreign liquor which is harmful<br \/>\nto the health of the public. It is held by the detaining authority<br \/>\nthat as the detenue is indulged in illegal activities, it is required<br \/>\nto restrain the detenue from carrying out further illegal activities,<br \/>\ni.e. selling of liquor. The detaining authority has placed reliance<br \/>\non the above registered offences and statements of unnamed witnesses.<br \/>\n In the opinion of this Court, the activities of the detenue can, by<br \/>\nno stretch of imagination, be said to be disturbing the  public<br \/>\norder.  It is seen from the grounds of detention that a general<br \/>\nstatement that has been made by the detaining authority that<br \/>\nconsuming liquor is injurious to health.  In fact, a perusal of the<br \/>\norder passed by the detaining authority shows that the grounds which<br \/>\nare mentioned in the order are in reference to the situation of  law<br \/>\nand order  and not  public order .  Therefore, on this ground,<br \/>\nthe subjective satisfaction arrived at by the detaining authority is<br \/>\nvitiated on account of non-application of mind and the impugned<br \/>\norder, therefore, deserves to be quashed and set aside.\n<\/p>\n<p>4.\t\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling foreign liquor which is harmful to the health<br \/>\nof the public. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki<br \/>\nv. Police Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia v. State of Bihar (AIR 1966 SC 740), this Court<br \/>\nheld that the cases wherein the detention order passed on the basis<br \/>\nof the statements of the witnesses falls under the maintenance of<br \/>\n law and order  and not  public order .\n<\/p>\n<p>5.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the  public  order<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to  public order . In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\t\tThe<br \/>\npetition is allowed. The impugned order of detention dated 4.12.2009<br \/>\npassed against the detenu is hereby quashed and set aside. The detenu<br \/>\nis ordered to be set at liberty forthwith, if not required in any<br \/>\nother case. Rule is made absolute accordingly.
