1.\t\tThe
\npetitioner herein inter alia prayed to quash and set aside the order
\ndated 21.7.2010 passed below Exhibit-31 in Execution Darkhast No. 68
\nof 2008 by Family Court No.2, Ahmedabad, and also prayed for
\nconsequential directions.\n<\/p>\n
2.\t\tLearned
\ncounsel for the petitioner pointed out that in spite of the order of
\nthis Court petitioner is not paid the outstanding amount for 2
\nmonths.\n<\/p>\n
3.\t\tLearned
\nCounsel for the petitioner relied upon judgment of the Delhi High
\nCourt, dated 3rd May 2005, passed in the case of Gaurav
\nSondhi Vs. Diya Sondhi, wherein in Paragraph No.4, it is held as
\nunder:-\n<\/p>\n
“4. The
\nMatrimonial Courts should follow the following procedure while
\ngranting interim maintenance\/maintenance:-\n<\/p>\n
(I)\tWhenever\tmaintenance\/interim
\n   maintenance  maintenance is ordered, the Court will direct that it
\nwill be paid on or before 10th day of every month unless
\nthe Court finds that the nature of the employment of the husband and
\nhis manner of income makes such monthly payments impractical. In such
\na situation appropriate orders may be passed which shall take into
\naccount the circumstances of the husband which warrant departure from
\nthe time bound monthly payment directions contained in this order.\n<\/p>\n
(ii)Whenever the wife
\nhas a bank account and indicates it, such  payment may directly be
\ndeposited in such bank account every month before the 10th
\nday of the month.\n<\/p>\n
(iii)The payment shall
\nbe made to the wife\/child and in case of any difficulty in receiving
\nor tendering the payment, it should be made through counsel. The
\norder of deposit in Court needlessly makes it difficult for the wife
\nto withdraw sums from the registry of the concerned court, apart from
\nadding unnecessarily to the burden of the Court’s registry. If for
\ngood reasons upon finding difficulty in payment to a wife and her
\ncounsel the deposits in Court are made such deposits should be in the
\nname of the wife by a draft\/crossed cheques, which may be retained on
\nthe Court file for retrieval by the wife without the time consuming
\nprocess of deposit in the Court account and subsequent withdrawal by
\nthe recipient;\n<\/p>\n
(iv)In case there is
\nfirst default for payment of maintenance, the Court may condone it.
\nHowever, in case of second default without justification, it will be
\nopen to the Court to impose a penalty up to 25% of the amount of
\nmonthly maintenance awarded;\n<\/p>\n
(v)In case there is
\nthird or fourth default, the penalty may go up to 50% of the monthly
\namount of maintenance upon the Court finding that the default was not
\ncondonable or contumacious in nature.\n<\/p>\n
(vi)The Court must
\nensure that the orders of maintenance are not a mere rhetoric and are
\nmeaningful and effective and give real sustenance and support to the
\ndestitute wife and\/or the child.\n<\/p>\n
(vii)In case interim
\nmaintenance is being paid and adequate litigation expenses have been
\nawarded to the wife, it should be ensured that the written
\nstatement\/reply is filed within a reasonable time.\n<\/p>\n
(viii)However, in
\njudging the nature of default the relative affluence of the husband
\nand the regular nature of his occupation and income will be taken
\ninto account. Obviously husband having irregular employment and\/or
\ndaily wages or those having casual employment would be entitled to
\nhave their defaults viewed more liberally.\n<\/p>\n
4.\t\tIn
\nthe present case the respondent has not paid payment for two months
\nand therefore there are two defaults. In view of the above decision
\nand on the facts of the case the following order is passed:-\n<\/p>\n
“The petitioner
\nshall furnish her Bank Account to respondent immediately and the
\nrespondent shall deposit the arrears amount with further 25% of the
\nmonthly maintenance within a period of 15 days from today.\n<\/p>\n
The respondents shall
\ndirectly deposit the monthly maintenance in the Bank Account
\nof the petitioner before 10th day of every month.”\n<\/p>\n
