1.\t\tHeard learned
\nAdvocates for the petitioners. The petitioners seek quashing of the
\ncomplaint at  Annexure-A , bearing I-C.R.
\nNo.512\/06, filed by respondent No.2 before Varachha Police Station,
\nSurat, for the offences punishable under Sections 406, 420, 465, 467,
\n468, 471, 34, 506(2), 387 read with Sections 120-B and 114 of the
\nIndian Penal Code. The complainant has alleged that the petitioners
\nhave systematically conspired to defeat the rights of the
\ncomplainant. Different documents were entered into between the
\nparties, however, to dupe the complainant, by the petitioners herein.
\nIt is alleged that for the aforesaid purpose, the petitioners have
\ncreated false documents. It is also the allegation of the complainant
\nthat in the above manner, the petitioners are trying to forcibly
\nenter into the mill \/ factory premises.\n<\/p>\n
2.\t\tThe learned Counsel
\nfor the petitioners, at the very outset, submitted that insofar as
\nthe offences punishable under Sections 406, 420, 387, 506(2), read
\nwith Sections 120-B and 114 of the Indian Penal Code are concerned,
\nhe DOES NOT PRESS
\nthis petition.\n<\/p>\n
3.\t\tHe, however,
\nsubmitted that there are no allegations in the complaint of the
\ncommission of offences punishable under Sections 465, 467, 468 and
\n471, read with Section 34 of the Indian Penal Code.\n<\/p>\n
4.\t\tTo this limited
\nextent, I have examined the documents on record.\n<\/p>\n
5.\t\tAs already noted,
\nthe complaint mainly alleges that the accused, present petitioners,
\nhad after entering into certain agreements and documents with the
\ncomplainant, in order to dupe the complainant, tried to re-possess
\nthe factory and that from the beginning their intention was to cheat
\nthe complainant.  Whatever the validity of these allegations, there
\nis no allegation with respect to fabrication of documents.\n<\/p>\n
6.\t\tSection 465 of the
\nIndian Penal Code pertains to  punishment for forgery . Other
\nsections under consideration, such as 467, 468 and 471 provides for
\nthe punishment for forgery for the purpose of cheating, in aggravated
\nform.\n<\/p>\n
7.\t\tThe term ‘forgery’
\nhas been defined in Section 463 of the Indian Penal Code, in the
\nfollowing manner:\n<\/p>\n
 463. Forgery.-\n<\/p>\n
[Whoever makes any false documents or false electronic record or part
\nof a document or electronic record, with intent to cause damage or
\ninjury], to the public or to any person, or to support any claim or
\ntitle, or to contract, or with intent to commit fraud or that fraud
\nmay be committed, commits forgery.\n<\/p>\n
8.\t\tThe term ‘making
\nfalse document’ is defined in Section 464 of the Indian Penal Code
\nand provides that a person is stated to create a false document,
\nunder certain circumstances.  The relevant portion of Section 464 is,
\nas follows:\n<\/p>\n
 464. Making a
\nfalse document.- [A person is said to make a false document
\nor false electronic record-\n<\/p>\n
First- who
\ndishonestly or fraudulently-\n<\/p>\n
(a)  makes, signs, seals
\nor executes a document or part of a document;\n<\/p>\n
(b)   makes or transmits
\nany electronic record or part of any electronic record;\n<\/p>\n
(c)\t affixes any
\n[electronic signature] on any electronic record;\n<\/p>\n
(d) makes any mark
\ndenoting the execution of a document or the authenticity of the
\n[electronic signature],<\/p>\n
with the intention of
\ncausing it to be believed that such document or part of document,
\nelectronic record or [electronic signature] was made, signed, sealed,
\nexecuted, transmitted or affixed by or by the authority of a person
\nby whom or by whose authority he knows that it was not made, signed,
\nsealed, executed or affixed, or<\/p>\n
Secondly- Who,
\nwithout lawful authority, dishonestly or fraudulently, by
\ncancellation or otherwise, alters a document or an electronic record
\nin any material part thereof, after it has been made, executed or
\naffixed with [electronic signature]either by himself or by any other
\nperson, whether such person be living or dead the time of such
\nalteration; or<\/p>\n
Thirdly- Who
\ndishonestly or fraudulently causes any person to sign, seal, execute
\nor later a document or an electronic record or to affix his
\n[electronic signature] on any electronic record knowing that such
\nperson by reason of unsoundness of mind or intoxication cannot, or
\nthat by reason of deception practiced upon him, he does not know the
\ncontents of the document or electronic record or the nature of the
\nalteration.] <\/p>\n
9.\t\tFrom the above, it
\nappears that none of the ingredients of Section 463, 464 of the
\nIndian Penal Code are found in the impugned complaint.  All that is
\nstated in the complainant is that the accused, to defeat the rights
\nof the complainant and to misappropriate his properties, had taken
\nhelp of forged documents. Except, this bare statement, in one line,
\nin the entire complaint there are no averments regarding the manner
\nin which such documents were forged.  To my mind, such bald statement
\nof one line, cannot give rise to a criminal prosecution, for such
\nserious offences.\n<\/p>\n
10.\t\tIn the result, as
\nthe complaint stands, as noted earlier, none of the ingredients of
\nSections 465, 467, 468 and 471, read with Section 34 of the Indian
\nPenal Code, are disclosed and the same are ordered to be DELETED
\nfrom the COMPLAINT. For the REMAINING
\nSections, the investigation may CONTINUE.\n<\/p>\n
11.\t\tThis
\npetition is disposed of, in the above terms.\n<\/p>\n
