     This suo moto transfer petition arose out of the order of<\/p>\n
the Acting Chief Justice of this Court dt.29.1.2009. The facts<\/p>\n
necessary for disposal of this case are briefly as follows.<\/p>\n
     2.    The Presiding Officer of M.A.C.T., Vatakara has<\/p>\n
requested this court to issue necessary orders to re-transfer O.P.<\/p>\n
(M.V) Nos. 1612 and 2854 of 2005 of M.A.C.T., Kozhikode<\/p>\n
to the transferor Tribunal on the ground that the transferor<\/p>\n
Tribunal has jurisdiction to continue the proceedings.<\/p>\n
     3. One of the Honourable Judges of this Court, as per<\/p>\n
order dt.29.11.2008, has directed to call the remarks of the<\/p>\n
Presiding Officer of the transferor Tribunal. In the remarks<\/p>\n
received, the Presiding Officer of the M.A.C.T., Kozhikode<\/p>\n
Tr.P(C) No. 49 of 2009<\/p>\n
                               2<\/span><\/p>\n
has narrated various reasons, including the convenience of the<\/p>\n
parties and the malpractices of agents as well as advocates who<\/p>\n
file claims, for transferring the claim petitions. This Court as<\/p>\n
per order dt.12.1.2009 directed to post the matter before a<\/p>\n
Division Bench dealing with M.A.C.T. matters.<\/p>\n
      4. M.A.C.T., Kozhikode has addressed this Court again,<\/p>\n
stating that O.P.(M.V.) No. 446 of 2007 of that Tribunal is<\/p>\n
having the same nature as of the claims stated above and<\/p>\n
expressed reluctance for transfer, in view of this court taking<\/p>\n
up the matter. This Court considered the matter again and as<\/p>\n
per order dt.19.1.2009 directed to post O.P.(M.V.) 446 of 2007<\/p>\n
also before the judicial side. Thereafter, the Hon’ble the Acting<\/p>\n
Justice directed to post all the three matters before the Division<\/p>\n
Bench dealing with M.A.C.T. matters.\n<\/p>\n
      5. Heard the learned counsel on both sides.<\/p>\n
      6. The above Original Petitions are filed under Section<\/p>\n
166 of the Motor Vehicles Act. Section 166(2) of the Act reads:<\/p>\n
Tr.P(C) No. 49 of 2009<\/p>\n
                               3<\/span><\/p>\n
          “S.166(2):- Every application under sub-section<\/p>\n
    (1) shall be made, at the option of the claimant, either<\/p>\n
    to the Claims Tribunal having jurisdiction over the<\/p>\n
    area in which the accident incurred or to the Claims<\/p>\n
    Tribunal within the local limits of whose jurisdiction<\/p>\n
    the claimants resides or carries on business or within<\/p>\n
    the local limits of whose jurisdiction the defendants<\/p>\n
    resides, and shall be in such form and contain such<\/p>\n
    particulars as may be prescribed:\n<\/p>\n<\/p>\n
          Provided that where no claim for compensation<\/p>\n
    under Section 140 is made in such application, the<\/p>\n
    application shall contain a separate statement to the<\/p>\n
    effect immediately before the signature of the<\/p>\n
    applicant.”\n<\/p>\n<\/p>\n
     7. Rule 375 of the Kerala Motor Vehicle Rules, 1989<\/p>\n
deals with power of Claims Tribunal to transfer application.<\/p>\n
Rule 375 reads:\n<\/p>\n
           “R.375: Power of Claims Tribunal to transfer<\/p>\n
     applications:- A Claims Tribunal shall transfer an<\/p>\n
Tr.P(C) No. 49 of 2009<\/p>\n
                                4<\/span><\/p>\n
     application filed before it to another Tribunal if such<\/p>\n
     application   is   one    which   comes    within   the<\/p>\n
     jurisdiction of the latter.”\n<\/p>\n
\nRule 374 deals with power of the High Court to transfer<\/p>\n
applications. Rule 374 reads:\n<\/p>\n<\/p>\n
     R.374. Power of High Court to transfer<\/p>\n
     applications:- (1) The High Court may transfer an<\/p>\n
     application from the file of one Claims Tribunal<\/p>\n
     before whom the application is pending to that of any<\/p>\n
     other Claims Tribunal, –\n<\/p><\/blockquote>\n
<\/blockquote>\n
                (a) if, the Claims Tribunal        before\n\n          whom      the   application   is   pending   is\n\n<\/pre>\n
          personally interested in the application and<\/p>\n
          reports the matter to the High Court; or<\/p>\n<\/blockquote>\n
                (b) if an application for transfer by any<\/p>\n
          party to the application, the High Court is<\/p>\n
          satisfied that there are sufficient grounds for<\/p>\n
          such transfer.\n<\/p><\/blockquote>\n
Tr.P(C) No. 49 of 2009<\/p>\n
                              5<\/span><\/p>\n
            (2) A Claims Tribunal to whom an application<\/p>\n
     is so transferred under sub-rule (1) may, subject to<\/p>\n
     special directions in the order of transfer, proceed<\/p>\n
     either de novo or from the stage at which it is so<\/p>\n
     transferred.”\n<\/p>\n<\/p>\n
     8. The letter from the M.A.C.T., Vatakara dt.14.11.2008<\/p>\n
shows that O.P.(M.V) Nos.1612 and 2854 of 2005 were<\/p>\n
pending before M.A.C.T., Kozhikode and they were transferred<\/p>\n
by M.A.C.T., Kozhikode to M.A.C.T., Vatakara by invoking the<\/p>\n
provisions of Rule 375 of the Motor Vehicle Rules. As per the<\/p>\n
cause title shown in the O.P., the petitioner in O.P.(M.V.) 2854<\/p>\n
of 2005 is residing at Azhiyur, which is within the jurisdiction<\/p>\n
of the Claims Tribunal, Vatakara and the address of<\/p>\n
respondents 1 and 3 are shown at Kozhikode and address of<\/p>\n
second respondent is shown at Koyilandy.<\/p>\n
     9.    As per the address shown in the cause title of O.P.<\/p>\n
(M.V) 1612 of 2005, the present address of the petitioner is<\/p>\n
Tr.P(C) No. 49 of 2009<\/p>\n

shown at Kozhikode and the address of the first respondent is<\/p>\n
shown at Kannur, that of second respondent is Idukki and that<\/p>\n
of the   third respondent is Nilambur and the accident       has<\/p>\n
occurred at Nilambur. The permanent address of the petitioner<\/p>\n
is shown at Kallachi, which is within the jurisdiction of the<\/p>\n
Claims Tribunal, Vatakara. As per Section 166 of the amended<\/p>\n
Motor Vehicles Act, the party can file the petition before the<\/p>\n
M.A.C.T. within whose jurisdiction any of the parties are<\/p>\n
residing and the accident has occurred. So, as per the address of<\/p>\n
the parties shown in the petition, the M.A.C.T., Vatakara is also<\/p>\n
having jurisdiction to deal with the petitions.<\/p>\n
      10. In the remarks submitted by the Presiding Officer of<\/p>\n
the M.A.C.T., Kozhikode, she has narrated the various reasons,<\/p>\n
including convenience of the parties and malpractice of agents<\/p>\n
etc. for transferring the above claim petitions to M.A.C.T.,<\/p>\n
Vatakara.\n<\/p>\n
Tr.P(C) No. 49 of 2009<\/p>\n
                              7<\/span><\/p>\n
     11. On perusing the records, it is seen that O.P.(M.V)<\/p>\n
2854 of 2005 might have been filed either before M.A.C.T.,<\/p>\n
Vatakara or before M.A.C.T., Kozhikode as the petitioner<\/p>\n
resides   within the jurisdiction of the former Tribunal and<\/p>\n
respondents 1 and 3 reside within the jurisdiction of the latter<\/p>\n
Tribunal. The claimant in O.P.(M.V.) 1612 of 2005 has his<\/p>\n
present address at Kozhikode and permanent address at<\/p>\n
Kallachi, which is within the jurisdiction of M.A.C.T.,<\/p>\n
Vatakara. The respondents are hailing from Kannur, Idukki<\/p>\n
and Nilambur.     Since the Presiding Officer of M.A.C.T.<\/p>\n
Kozhikode has already transferred the cases to M.A.C.T.,<\/p>\n
Vatakara and she has shown sufficient reasons for the transfer,<\/p>\n
we are of the view that in the interests of justice that order need<\/p>\n
not be interfered with.\n<\/p>\n
     12.    Therefore, M.A.C.T., Vatakara is directed to re-<\/p>\n
number O.P.(M.V.) Nos. 1612 and 2854 of 2005 on the file of<\/p>\n
the M.A.C.T., Kozhikode and proceed with the applications in<\/p>\n
Tr.P(C) No. 49 of 2009<\/p>\n

accordance with law. As regards O.P.(M.V.) 446 of 2007 on<\/p>\n
the file of the M.A.C.T., Kozhikode is concerned, there is no<\/p>\n
written request from the claimant to transfer the case to<\/p>\n
M.A.C.T. Vatakara and therefore that request of the M.A.C.T.,<\/p>\n
Kozhikode to transfer that petition to M.A.C.T., Vatakara<\/p>\n
cannot be allowed. If any of the parties to O.P.(M.V.) 446 of<\/p>\n
2007 file an application before this Court, as per Rule 374 of<\/p>\n
the Kerala Motor vehicles Rules, that application can        be<\/p>\n
considered by this Court. In order to avoid future controversies<\/p>\n
in the matter of invoking the power of transfer under Rule 375,<\/p>\n
the following direction is issued.\n<\/p>\n
      13.   In the matter of transfer of Claim Petitions, Rule<\/p>\n
375 could be invoked by the Tribunal, provided that Tribunal<\/p>\n
lacks jurisdiction.    If the two Tribunals have     concurrent<\/p>\n
jurisdiction, then, the power under Rule 375 cannot be invoked.<\/p>\n
But the party can seek remedies by invoking Rule 374 from the<\/p>\n
High Court.\n<\/p>\n

     14. The above Transfer Petition is disposed of as above.<\/p>\n
