SHALIGRAM SINGH\n                                          ...OPPOSITE PARTIES\n                                         -----------\n<\/pre>\n<p>2.   23.11.2010               Heard counsel for the parties.<\/p>\n<p>                              Petitioners are aggrieved by the order dated 25th<\/p>\n<p>                  October, 2008, passed on Cr. Appeal No.95 of 1999, whereby on<\/p>\n<p>                  a consideration of materials on record the substantive sentence<\/p>\n<p>                  imposed on them by learned trial court has been interfered with.<\/p>\n<p>                  The petitioners were directed to be given the benefit under<\/p>\n<p>                  section \u00be of Probation of Offenders Act. This order was passed<\/p>\n<p>                  having      regard to the fact appearing from record indicating<\/p>\n<p>                  therein that both the parties were agnates and had fought over a<\/p>\n<p>                  trivial issue and allegations were not serious.<\/p>\n<p>                              It is admitted at Bar that pursuant to the order, the<\/p>\n<p>                  bond has already been executed period whereof has expired.<\/p>\n<p>                              Section 12 of the Probation of Offenders Act reads<\/p>\n<p>                  as under:\n<\/p>\n<blockquote><p>                                 &#8220;Removal of disqualification attaching to<br \/>\n                              conviction.-Notwithstanding anything contained<br \/>\n                              in any other law, a person found guilty of an<br \/>\n                              offence and dealt with under the provisions of<br \/>\n                              section 3 or section 4           shall not suffer<br \/>\n                              disqualification, if any, attaching to a conviction<br \/>\n                              of an offence under such law:<\/p><\/blockquote>\n<p>                                 Provided that nothing in this section shall<br \/>\n                              apply to a person who, after his release under<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>                section 4, is subsequently sentenced for the<br \/>\n                original offence.&#8221;\n<\/p>\n<p>            In that view of the matter, this Court is not inclined to<\/p>\n<p>     interfere with that part of the appellate court order whereby they<\/p>\n<p>     were given the benefit under section \u00be of the Probation of<\/p>\n<p>     Offenders Act.\n<\/p>\n<p>            The application is accordingly disposed of.<\/p>\n<p>                              ( Kishore K.
