Advocate\n\nHon'ble Shashi Kant Gupta,J.\n<\/pre>\n<p>Heard learned counsel for the applicant , learned<br \/>\nA.G.A for the State and perused the record.\n<\/p>\n<p>The applicant has applied for bail in Case Crime No.<br \/>\n35 of 2008, under sections 302,376,511 I.P.C. and<br \/>\nSections 3(2)((V) of SC\/ST Act P.S. Ashothar,<br \/>\nDistrict Fatehpur.\n<\/p>\n<p>It is a triple murder case.\n<\/p>\n<p>It is submitted by the learned counsel for the applicant<br \/>\nthat the applicant is innocent and has been falsely<br \/>\nimplicated in the case. It is further submitted that the<br \/>\npost mortem reports of the deceased persons do not<br \/>\nsupport the prosecution story. It is further submitted<br \/>\nthat , according to the F.I.R. the deceased Jhallu<br \/>\nShukla was assaulted by the deceased Smt. Asha by<br \/>\nHansiya( a sharpe edged weapon) but the said<br \/>\ndeceased Jhallu Shukla did not receive any injury of<br \/>\nHansiya and in fact, fire arm injury was found on the<br \/>\n person of the deceased Jhallu Shukla which falsifies<br \/>\nthe prosecution story .\n<\/p>\n<p>It is further submitted that it is unbelievable that the<br \/>\napplicant , who is alleged to have reached the spot to<br \/>\nprotect and save his brother , would cause any fire<br \/>\narm injury to his brother . In support of his<br \/>\ncontention, learned counsel for the applicant referred<br \/>\nto the site plan to falsify the story of the prosecution.\n<\/p>\n<p>Learned counsel for the applicant also referred to the<br \/>\nstatement of Dinesh alias Pappu ( P.W. 2) to show<br \/>\nthat he was not an eye witness of the scene and in<br \/>\nsupport of his contention also referred to the<br \/>\nPanchayatnama wherein the Sari and other clothes<br \/>\nwere found intact on the person of the deceased Smt.<br \/>\nAsha, as such the story of rape , as alleged by the<br \/>\nwitness Dinesh alias Pappu, can not be relied upon. It<br \/>\nis further submitted that in the site plan the applicant<br \/>\nhas not been shown on the spot and pointed out other<br \/>\ndiscrepancies.\n<\/p>\n<p>It is further submitted that the informant is not eye<br \/>\nwitness of the incident and , in fact, no body had seen<br \/>\nthe alleged incident and F.I.R. was lodged on<br \/>\n hearsay .\n<\/p>\n<p>Per contra, learned A.G.A. opposed the bail<br \/>\napplication and submitted that in the present case a<br \/>\nheinous crime has been committed by the applicant<br \/>\nwherein three persons have been killed and the<br \/>\napplicant is the sole accused named in the F.I.R and<br \/>\nspecific role of shooting has been assigned to him.\n<\/p>\n<p>It is further submitted by learned A.G.A. that the post<br \/>\nmortem reports of all the deceased persons fully<br \/>\ncorroborate the prosecution story. In support of his<br \/>\ncontention, the learned A. G.A. referred to the injury<br \/>\nreport dated 29.2.08 of Ravi Shanker Shukla alias<br \/>\nJhallu which clearly shows that he was brought to the<br \/>\nhospital at Fatehpur by Laxmi Shanker Shukla and<br \/>\nnot by the applicant.\n<\/p>\n<p>It is further submitted by learned A.G.A. that<br \/>\naccording to the injury report dated 29.2.2008, the<br \/>\ninjury no. 1 was caused by the fire arm and injury no.<br \/>\n2 was caused by Hansiya from its blunt side.\n<\/p>\n<p>He further referred to the post mortem report of the<br \/>\ndeceased Ravi Shankar Shukla alias Jhallu and argued<br \/>\n that indiscriminate firing was made upon the deceased<br \/>\nSrimati and her daughter Smt. Asha and during the<br \/>\ncourse of firing, Ravi Shankar Shukla alias Jhallu<br \/>\nShukla also sustained fire arm injuries and succumbed<br \/>\nto injuries. It is further submitted that the nature of the<br \/>\nfire arm injuries caused to Srimati and his daughter<br \/>\nSmt. Asha as well as to the deceased Ravi Shankar<br \/>\nShukla alias Jhallu clearly shows that the fires were<br \/>\nshot from the same weapon . In support of his<br \/>\nallegation, he also referred to the statement of Dinesh<br \/>\nalias Pappu recorded under section 161 Cr.P.C.<br \/>\nwherein he has clearly stated that the applicant made<br \/>\nindiscriminate firing, killing Srimati and her daughter<br \/>\nSmt. Asha and also shot fire at his brother Jhallu<br \/>\nShukla who sustained serious injuries and ultimately<br \/>\nsuccumbed to his injuries.\n<\/p>\n<p>It is further submitted by learned A.G.A. that Dinesh<br \/>\nalias Pappu, who happens to be the son of the<br \/>\ndeceased Srimati, is an eye witness of the scene .<br \/>\nLearned A.G.A. also referred to the statements<br \/>\nrecorded under section 161 Cr.P.C. of the witnesses<br \/>\nBhola Pasi, Virendra Shukla and Dharmendra, who<br \/>\nhave supported the prosecution story . It is further<br \/>\n submitted that the evidentiary value of the statements<br \/>\nof the eye witness Dinesh alias Pappu and other<br \/>\nwitnesses recorded before the court below will be<br \/>\nconsidered by the trial court and its evidentiary value<br \/>\ncan not be appreciated by this court .\n<\/p>\n<p>Lastly, it was submitted by the learned A.G.A. that<br \/>\nany minor discrepancy in the site plan prepared by the<br \/>\ninvestigating officer will not give any benefit to the<br \/>\naccused applicant. He further submitted that the trial<br \/>\nis at an advanced stage. Therefore, it would not be<br \/>\nappropriate for this court to consider the bail<br \/>\napplication of the applicant.\n<\/p>\n<p>It is settled law that in granting or non granting of bail<br \/>\nin non bailable offences, the primary consideration is<br \/>\nthe nature and gravity of the offence. In the present<br \/>\ncase, the applicant is accused of committing triple<br \/>\nmurder. The alleged crime was committed in broad<br \/>\nday light. The court must hear the loud cry for justice<br \/>\nby the society in the heinous crime.\n<\/p>\n<p>In view of the facts and circumstances of the case,<br \/>\nand having regard to the nature and gravity of the<br \/>\noffence, no case for bail is made out. The prayer for<br \/>\n bail is declined and the bail application is rejected.\n<\/p>\n<p>However, the learned lower court is directed to<br \/>\nexpedite the trial and conclude the same expeditiously<br \/>\n, preferably within a period of three months from the<br \/>\ndate of production of a certified copy of this order,<br \/>\nkeeping in view the provisions of Section 309 Cr.P.C.\n<\/p>\n<p>Order Date: 5.1.2010<\/p>\n<p>MLK\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Rajeev Yadav @ Banti vs State Of U.P. on 5 January, 2010 Court No. &#8211; 51 Reserved Case :- CRIMINAL MISC.
