Mr.Nanavati has submitted that why the<br \/>\nperson has committed suicide that words of the suicide note is<br \/>\nrequired to be proved. Even if the allegations made in the FIR are<br \/>\naccepted at its face value for the sake of arguments and without<br \/>\nadmitting the same, then also, no offence under Section 306 of the<br \/>\nIPC is made out against the present applicant. The allegation does<br \/>\nnot fall within the purview of Section 107 of the IPC. He has<br \/>\nsubmitted that looking to the role attributed by the prosecution it<br \/>\ndoes not attract meaning of instigation, provocation and abatement.<br \/>\nHe has submitted that present applicant will be available during<br \/>\ninterrogation and investigation. He has therefore, prayed that<br \/>\npresent applicant may be granted anticipatory bail.\n<\/p>\n<p>3.\tHeard<br \/>\nMr.Chetna Shah, learned APP for the respondent State. Ms.Shah has<br \/>\nvehemently opposed the present application. She has read suicidal<br \/>\nnote and argued that name of the present applicant is shown in<br \/>\nsuicidal note.\n<\/p>\n<p>4.\tMs.Shah<br \/>\nis unable to show this Court that ingredients of Section 107 of the<br \/>\nIPC are prima facie attracted through police papers. Having<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, I am<br \/>\ninclined to grant anticipatory bail to the applicant. This Court has<br \/>\nalso taken into consideration the law laid down by the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of<br \/>\nMaharashtra &amp; Ors.,<\/a> reported in (2011) 1 SCC 694,<br \/>\nwherein the Apex Court reiterated the law<br \/>\nlaid down by the Constitutional Bench in the case of Shri<br \/>\nGurubaksh Singh Sibbia &amp; Ors., reported in (1980) 2 SCC 565.\n<\/p>\n<p>5.\tThe application is<br \/>\nallowed. The applicant is granted anticipatory bail in the event of<br \/>\nhis arrest in connection with CR No. I-336 of 2011 registered<br \/>\nwith  Malaviya Nagar Police Station, Rajkot for the offences as<br \/>\nalleged in FIR on his executing a bond of Rs.10,000\/- [Rupees Ten<br \/>\nthousand only] with one surety of the like amount on the following<br \/>\nconditions that he shall:\n<\/p>\n<p>[a]\tco-operate with the<br \/>\ninvestigation and make himself available for interrogation whenever<br \/>\nand wherever required.\n<\/p>\n<p>[b]\tshall remain present<br \/>\nat the concerned Police Station on 14.11.2011 at 11.00 AM ;\n<\/p>\n<p>[c]\tshall not hamper the<br \/>\ninvestigation in any manner nor shall directly or indirectly make any<br \/>\ninducement, threat or promise to any person acquainted with the facts<br \/>\nof the case so as to dissuade him from disclosing such facts to the<br \/>\nCourt or to any police officer;\n<\/p>\n<p>[d]\tat the time of<br \/>\nexecution of bond, furnish him residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot leave State of<br \/>\nGujarat without the permission of the Court and, if holding a<br \/>\npassport, he shall surrender the same before the Trial Court within a<br \/>\nweek;\n<\/p>\n<p>[f]\tnot obstruct or hamper<br \/>\nthe police investigation and not play mischief with the evidence<br \/>\ncollected or yet to be collected by the police;\n<\/p>\n<p>6.\tIt would be open to the<br \/>\nInvestigating Officer to file an application for remand if he<br \/>\nconsiders it proper and just;
