Selection Grade--I (HSG~I) by order dated is\/4\/1996 \n\npay was fixed in the scale of Rs.2000 ~ 3200 by  *\n\n\u00a39\/4\/1996 as per FR22-I (a)_(:)r.,,_w.e.\u00a3;\"'\"2sj3'\/'1993_.,_V\n\nSubsequently, the Director of Accou-nts::\"(\u00a7?.ostal)0 'cl:arifie:d--..yi\ufb011.i_:\n\nthe year 1999, that fixation ofpayyyof \nFR.22wI (a)(1') was not correct    was\nreduced Wei. 1\/ 9\/ 200 I   'made for recovery\nat Rs.38,134\/W in.' monthly]_inst'aiinj.e'nt...'  1,000\/W per\nmonth. The  not to\nrecover the  vyasttrejected.  ~ i:.V’pI’Oi’I1OJ[iOI1 became a transfer w.e.f. 1\/1\/1996. Hence. the<\/p>\n

 considered as a promotion on 16.4.1996 ceased to be a<\/p>\n
A fprotrnotion on account of the retrospective operation of 5*”! Pay<\/p>\n
.9  Cornrnission Scales ofPay. Necessarily, therefore. the benefit<\/p>\n

The Promotion of petitioner to HSGJ became non
\nexistent with retrospective effect and it_follows that the benefit

onwards? the  entitled to the pay scale of<\/p>\n
Rs.6500–\ufb010.Q"– li05Ci0an:'d fixation of saiary was rightly<\/p>\n
set right by the n\u00a7pa1~mient. Since the respondent was in no<\/p>\n
  for the same, the amount of Rs.38,13\u00e9L\/-<\/p>\n
I to.-:'the respondent for the period from March<\/p>\n
199t}.__to  2001 is not recoverable and if any amount<\/p>\n
hasbeen._.i'ecoVered, the respondent is entitled to refund of<\/p>\n
