\tThe
\npresent application has been filed by the applicant for grant of
\nregular bail under sec. 439 of the Code of Criminal Procedure.\n<\/p>\n
2.\tThe
\napplicant-accused is charged with having committed offences under
\nsections 406, 419, 420, 465, 467, 468, 470, 120B and 114 of IPC for
\nwhich FIR, being C.R. No. I-56\/2010, has been registered with Kalupur
\nPolice Station.\n<\/p>\n
3.\tLearned
\nSr. Counsel Mr. Lakhani submitted that an FIR came to be registered
\non 3.5.2010 with regard to the alleged transactions in Siddhi
\nCo-operative Bank and as it is stated in the FIR, irregularities are
\nalleged to have been made. Learned Sr. Counsel Mr. Lakhani further
\nsubmitted that the complainant who is a PSI as well as an account
\nholder with the bank received some letters on the basis of which he
\nlodged the complaint. He submitted that the petitioner is a co-opted
\ndirector of the bank and he has not forged any signature nor he has
\nplayed any role except that he has introduced some of the account
\nholders which are said to have been fictitious accounts. However,
\nlearned counsel Mr. Lakhani submitted that as the investigation is
\nover and the charge sheet is filed, the present application may be
\nallowed as the offence is triable by the court of Magistrate and it
\nmay take some time. He further submitted that there is no loss to the
\nbank and he has not received any benefit.\n<\/p>\n
4.\tLearned
\nAPP Mr. Kartik Pandya submitted that there are about 88 such
\nfictitious bank accounts opened where the petitioner has introduced
\nthe account holders suggesting prima facie case and his involvement.\n<\/p>\n
5.\tLearned
\nadvocate Mr. Dagli for the complainant submitted that he has signed
\nfor introducing the persons whose bank accounts are found to be
\nfictitious suggesting his involvement.  He submitted that  the
\ncomplainant has received some letters  and therefore it may not
\nentail any liability.\n<\/p>\n
6.\tIn view
\nof rival submissions it is required to be considered whether the
\npresent application can be entertained or not.\n<\/p>\n
7.\tIt is
\nwell-accepted that the court is not required to appreciate and
\nscrutinize the evidence in detail at this stage. However, for
\nconsidering the prima facie case for the purpose of bail, aspects
\nlike the nature of offence, the role attributed and the manner in
\nwhich it is alleged to have been committed, etc. are relevant.
\nFurther, as pointed out the fictitious bank accounts are opened,
\nwhere the applicant has signed for introducing the account holders
\nsuggesting some prima facie involvement.  At the same time, the fact
\nremains that the investigation is over, the charge sheet has been
\nfiled and he has not forged any document, nor any benefit has been
\ngained.  Therefore, considering the nature of offences which are
\ntriable by the Court of Magistrate and also the fact that the
\ninvestigation is over and the case is based on documentary evidence,
\nthe present application deserves to be allowed.\n<\/p>\n
8.\tThe
\napplication is accordingly allowed.  The applicant is ordered to be
\nreleased on bail in connection with C.R. No. I-56\/2010,
\nregistered with Kalupur Police Station on his executing
\na personal bond of Rs. 10,000\/- (Rupees Ten Thousand only) with one
\nsolvent surety for the like amount to the satisfaction of the lower
\ncourt and subject to the further conditions that he shall :\n<\/p>\n
(a)\tnot
\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n
(b)\tnot to
\ntry to tamper or pressurize the prosecution witnesses or complainant
\nin any manner;\n<\/p>\n
(c )\tnot
\nact in any manner injurious to the interests of the prosecution.\n<\/p>\n
(d)\tmaintain
\nlaw and order and should co-operate with the investigating officers;\n<\/p>\n
(e)\tmark
\nhis presence before the concerned Police Station on the 5th
\nof every calendar month between 11.00 am to 2.00 pm till the trial
\ncommences.\n<\/p>\n
(f)\tfurnish
\nthe address of his residence to the investigating officer and also to
\nthe court at the time of execution of the bond and shall not change
\nhis residence without prior permission of the court.\n<\/p>\n
(g)\tsurrender
\nhis passport, if any, to the lower court, within a week.\n<\/p>\n
9.\tIf
\nbreach of any of the above conditions is committed, the concerned
\nSessions Judge will be free to issue warrant or take appropriate
\naction in the matter.\n<\/p>\n
10.\tBail
\nbefore the lower court having jurisdiction to try the case. It would
\nbe open to the trial court concerned to give time to furnishthe
\nsolvency certificate, if prayed for.\n<\/p>\n
\tRule is
\nmade absolute.  D.S. permitted.\n<\/p>\n
