BASANT, J.\n\n               -------------------------------------------------\n\n                        B.A. No. 6472 OF  2007\n\n               -------------------------------------------------\n\n            Dated this the  30th day of October, 2007\n\n\n                                   ORDER\n<\/pre>\n<p>      Application   for   anticipatory   bail.       The   petitioners   are<\/p>\n<p>accused 2 and 3.  Altogether, there are three accused persons.\n<\/p>\n<p>The 1st accused is the sister of the petitioners.   The 1st accused<\/p>\n<p>had got married the de facto complainant in November, 2006.\n<\/p>\n<p>She is employed in U.K.  After marriage, she  took the de facto<\/p>\n<p>complainant   also   to   U.K.       Acrimony   developed   in   marriage.\n<\/p>\n<p>Both   of   them   returned   to   their   native   place   to   attend   the<\/p>\n<p>marriage of the brother of the 1st  accused.     After their return<\/p>\n<p>to   India,   accused   1   to   3   allegedly   made   fraudulent<\/p>\n<p>representations to induce the de facto complainant to part with<\/p>\n<p>his passport.   He was induced  to part with the passport on the<\/p>\n<p>promise that it  can be kept in safe custody and the possibility<\/p>\n<p>of   he   losing   it   can   be   avoided.       But   after   so   getting   the<\/p>\n<p><span class=\"hidden_text\">B.A. No. 6472 OF  2007                -: 2 :-<\/span><\/p>\n<p>passport,   accused   1   to   3   fraudulently   implemented   their   prior<\/p>\n<p>design of the 1st accuse leaving India without giving the passport<\/p>\n<p>to   the   de   facto   complainant.       The     original   of   his   documents<\/p>\n<p>showing   his   educational   qualification   were   also     kept   by   the<\/p>\n<p>accused.       The   1st  accused   has   now   left   for   his   place   of<\/p>\n<p>employment.     Her husband &#8211; the de facto complainant is left in<\/p>\n<p>the lurch in India.   He is unable to go abroad as his passport and<\/p>\n<p>other   documents   are   taken   away   by   the   1st  accused.       He   is<\/p>\n<p>unable to seek employment in India because  his certificates are<\/p>\n<p>also illegally retained by the accused persons.   The complainant<\/p>\n<p>was   thus   in   helpless   circumstances.       The   accused   persons<\/p>\n<p>promised him that all the documents shall be returned to him on<\/p>\n<p>condition   that   he   files   an   application   for   divorce   and   obtain<\/p>\n<p>divorce.       In his anxiety to get his documents returned, he filed<\/p>\n<p>an application  for divorce also.   Divorce has been  ordered.      In<\/p>\n<p>spite of that, his travel documents and certificates are not being<\/p>\n<p>returned.     The   de   facto   complainant   now   realises   that   he   has<\/p>\n<p>been taken for a ride.   In is, in these circumstances, that the de<\/p>\n<p>facto   complainant   filed   a   complaint   before   the   learned<\/p>\n<p>Magistrate   which   was     referred   to   the   police   by   the   learned<\/p>\n<p>Magistrate   under   Sec.156(3)   of   the   Cr.P.C.       The   passport   and<\/p>\n<p>the   travel   documents   have   still   not   been   returned.       This   case<\/p>\n<p><span class=\"hidden_text\">B.A. No. 6472 OF  2007                -: 3 :-<\/span><\/p>\n<p>was adjourned for a number of days giving an opportunity to the<\/p>\n<p>parties   to   settle   their   disputes   and   to   ensure   that   the   travel<\/p>\n<p>documents   are     returned   to   the   de   facto   complainant.       No<\/p>\n<p>arrangement   has  been   made  so  far,  submits  the   learned   Public<\/p>\n<p>Prosecutor.\n<\/p>\n<p>      2.   The learned counsel for the petitioners submits that the<\/p>\n<p>petitioners are absolutely innocent.   At worst, it is only a dispute<\/p>\n<p>between the 1st accused and the de facto complainant.    In these<\/p>\n<p>circumstances,       anticipatory   bail   may   be   granted   to   the<\/p>\n<p>petitioners, it is prayed.\n<\/p>\n<p>      3.    The learned Public Prosecutor opposes the application.\n<\/p>\n<p>The   learned   Public   Prosecutor   submits   that   the   materials<\/p>\n<p>collected so far clearly indicate the complicity of the petitioners.\n<\/p>\n<p>Fraudulent   deception   of   the   de   facto   complainant   is   revealed<\/p>\n<p>from the totality of the materials available in  this case, submits<\/p>\n<p>the learned Public Prosecutor.\n<\/p>\n<p>      4.  I have considered all the relevant inputs.   I find merit in<\/p>\n<p>the   opposition   by   the   learned   Public   Prosecutor.       This,   I   am<\/p>\n<p>satisfied, is not a fit case where the  powers under Sec.438 of the<\/p>\n<p>Cr.P.C.  can or ought to be invoked.     This evidently is a fit case<\/p>\n<p>where   the   petitioners   must   co-operate   with   the   Investigator.\n<\/p>\n<p>They   must   surrender   before   the  Investigating   Officer  or   the<\/p>\n<p><span class=\"hidden_text\">B.A. No. 6472 OF  2007                        -: 4 :-<\/span><\/p>\n<p>learned Magistrate having jurisdiction and then seek regular bail<\/p>\n<p>in the ordinary course.\n<\/p>\n<p>        5.   Needless to say, if, as submitted by the  learned Public<\/p>\n<p>Prosecutor,   a   fraudulent   design   to   defraud   the   de   facto<\/p>\n<p>co<br \/>\n   mplainant by the 1st<br \/>\n                                a<br \/>\n                                ccused is also available, the Investigator<\/p>\n<p>m<br \/>\n   ust take appropriate steps to get the passport of the 1st<br \/>\n                                                                                 a<br \/>\n                                                                                  ccused<\/p>\n<p>impounded   and   to   ensure   that   necessary   steps   are   taken<\/p>\n<p>ex<br \/>\n   peditiously   against   the   1st<br \/>\n                                               a<br \/>\n                                               ccused   also.       The   needful   shall<\/p>\n<p>cer<br \/>\n      tainly   be   done   by   the  Invest<br \/>\n                                                    igating   Officer.\n<\/p>\n<p>                                                                             The   helpless<\/p>\n<p>plight   of   the   de   facto   complainant   does   cause   concern   in   my<\/p>\n<p>mind.\n<\/p>\n<p>        6.     This   application   for   anticipatory   bail   is,   in   these<\/p>\n<p>circumstances,   dismissed.     Communicate   a   copy   of   this   order<\/p>\n<p>immediately to the Investigating Officer.\n<\/p>\n<p>                                                              (R.
