PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\nPATTANAIK, J.\n<\/p>\n<p>     leave granted.\n<\/p>\n<p>     This appeal  by special  leave to\tappeal\tis  directed<br \/>\nagainst the  judgment dated  17.2.1997 of the Allahabad High<br \/>\nCourt dismissing  the writ  petition filed by the appellant.<br \/>\nThe respondent\tlandlord field\t a  petition for eviction to<br \/>\nthe appellant under Section 21(1)(a) of the U.P. Act XIII of<br \/>\n1972 inter  alia on the ground at the bona fide requires the<br \/>\npremises for  carrying on  his own  business and  he has  no<br \/>\nother means  of livelihood.  The tenant\t &#8211;  appellant  filed<br \/>\nobjections before  the prescribed authority stating there in<br \/>\nthat the  application for  eviction has\t been filed on false<br \/>\nand baseless  allegation and in fact the respondent does not<br \/>\nneed the  premises bona\t fide for starting his own business.<br \/>\nThe prescribed\tauthority on  consideration of the materials<br \/>\non record  came to the conclusion that the landlord does not<br \/>\nrequire the  premises for  his own  use bonafide.  The\tsaid<br \/>\nprescribed authority  also came\t to the\t conclusion that the<br \/>\ntenant would  be comparatively\tharrassed  if  an  order  of<br \/>\neviction for  eviction having  been rejected,  the  landlord<br \/>\npreferred an  appeal. The appellate authority re-appreciated<br \/>\nthe entire evidence on record and reversed the conclusion of<br \/>\nthe prescribed\tauthority. The said appellate authority came<br \/>\nto the conclusion that in the facts and circumstances to the<br \/>\ncase of\t the requirement  of the  landlord to  start a cloth<br \/>\nbushiness must\tbe a  bona fide requirement entitling him to<br \/>\nget an\torder of eviction under Section 21(1)(a) of the Act.<br \/>\nThe appellate  authority, therefore,  set aside the order of<br \/>\nthe  prescribed\t authority  and\t directed  eviction  of\t the<br \/>\nappellant. Being  aggrieved by\tthe order  of the  appellate<br \/>\nauthority, the\ttenant carried\tthe matter to the High Court<br \/>\nby filing  a writ  petition. During the pendency of the writ<br \/>\npetition in  the  High\tCourt  the  landlord  died  and\t was<br \/>\nsubstituted by\this legal  heirs namely\t his widow, two sons<br \/>\nand the\t married daughter.  On behalf  of the tenant, it was<br \/>\nurged before  the High\tCourt that the landlord having died,<br \/>\nthe bona fide requirement which was found to have existed by<br \/>\nthe appellate  authority no  more survives,  and  therefore,<br \/>\ntaking into  consideration the\tsubsequent  event  the\tHigh<br \/>\nCourt must  quash  the\torder  of  eviction  passed  by\t the<br \/>\nappellate authority.  On  behalf  of  the  landlord  it\t was<br \/>\ncontended that\tthe order  of the appellate authority in the<br \/>\neviction proceeding,  is a  decree  and\t the  decree  having<br \/>\nbecome final,  In a  proceeding under  Article\t226  of\t the<br \/>\nConstitution, the  High Court  will not\t be entitled to take<br \/>\ninto consideration any subsequent event that had occured and<br \/>\nno that score it would not be appropriate for the High Court<br \/>\nto  interfere  with  the  decree  passed  by  the  appellate<br \/>\nauthority. It  was also\t contended that\t the requirement  in<br \/>\nquestion must  exist on the day the application for eviction<br \/>\nwas filed  and the  same requirement having been found to be<br \/>\nestablished by\tthe competent  forum who  was required to go<br \/>\ninto the  said question,  it is\t no longer  open to the High<br \/>\nCourt to  interfere with the said finding in exercise of its<br \/>\nsupervisory  jurisdiction   under   Article   226   of\t the<br \/>\nConstitution. The  High Court  by the impugned judgment came<br \/>\nthe conclusion that the decree for eviction has become final<br \/>\nand the said finality cannot be disturbed on the application<br \/>\nunder Article 226 of the Constitution by taking into account<br \/>\nthe  facts  that  the  original\t landlord  died\t during\t the<br \/>\npendency of the writ petition.\n<\/p>\n<p>     Mr. Manoj\tSwarup, learned\t counsel appearing  for\t the<br \/>\nappellant in this Court urged that the person for whose bona<br \/>\nfide requirement  the order  of eviction  has been passed by<br \/>\nthe appellate  authority having\t died during the pendency of<br \/>\nthe writ  petition. The\t said bonafide requirement no longer<br \/>\nsubsists and  consequently the\tHigh Court should have taken<br \/>\nthat fact into consideration and should have interfered with<br \/>\nthe order passed by the appellate authority for the eviction<br \/>\nof the\ttenant. The  learned counsel   further urged that no<br \/>\ndoubt the  proceedings under Article 226 of the Constitution<br \/>\nis not\ta continuation of the eviction proceedings under the<br \/>\nAct, but  all the  same the  High Court while exercising its<br \/>\npower of  supervisions under Article 226 of the Constitution<br \/>\nis not\tdenuded of  its power to take into consideration the<br \/>\nsubsequent event  that had happened which is necessary to be<br \/>\ntaken  into   consideration  in\t the  interest\tof  justice.<br \/>\nAccordingly, The  High Court  committed serious error in not<br \/>\ntaking into  account the  facts of the death of the landlord<br \/>\nfor whose  bona fide  requirement the  order of eviction had<br \/>\nbeen passed  by the appellate authority, and therefore, this<br \/>\nCourt should  interfere with  the said\torder  of  the\tHigh<br \/>\nCourt.\tHaving\t given\tand  anxious  consideration  to\t the<br \/>\ncontention raised  by the  learned counsel for the appellant<br \/>\nand under the facts and circumstances of this case we are of<br \/>\nthe considered\topinion that  this case\t does not  warranted<br \/>\ninterference  by   this\t Court\tunder  Article\t136  of\t the<br \/>\nconstitution. Under  the Act  the  order  of  the  appellate<br \/>\nauthority is  final and\t the said  order is  a decree of the<br \/>\ncivil court  and decree\t to a  competent Court having become<br \/>\nfinal cannot  be  interfered  with  by\tthe  High  Court  in<br \/>\nexercise of  its power\tof superintendence under Article 226<br \/>\nand 227\t of the\t Constitution by  taking  into\taccount\t any<br \/>\nsubsequent event  which might have happened. That apart, the<br \/>\nfact that  the landlord\t needed the premises is question for<br \/>\nstarting a  bushiness which  fact  has\tbeen  found  by\t the<br \/>\nappellate authority.  In eye  of law, it must be that on the<br \/>\nday of\tapplication for\t eviction which is the crucial date,<br \/>\nthe tenant  incurred the liability of being evicted from the<br \/>\npremises. Even\tif the\tlandlord died during the pendency of<br \/>\nthe Writ  petition in  the High\t Court the  bona  fide\tneed<br \/>\ncannot be  said to  have lapsed\t as the business in question<br \/>\ncan be\tcarried on  by his  widow or  any elder son. In this<br \/>\nview to\t the matter,  we find  no force in the contention of<br \/>\nMr,  Manoj   Swarup,  learned\tcounsel\t appearing  for\t the<br \/>\nappellant and  we do  not find\tany error  in  the  impugned<br \/>\njudgment  of  the  High\t Court\tunder  Article\t136  of\t the<br \/>\nConstitution.
