         Petitioners are accused 1 and 2 in<\/p>\n
S.T.2077\/1996 on the file of Judicial First<\/p>\n
Class Magistrate-III, Thrissur. They were<\/p>\n
convicted     and           sentenced                 to     simple<\/p>\n
imprisonment for three months and fine of<\/p>\n
Rs.25,000\/-       and           in          default          simple<\/p>\n
imprisonment for six months each                           for the<\/p>\n
offence under Section 55(a) of Abkari Act.<\/p>\n
Third accused was acquitted                          finding that<\/p>\n
prosecution did not establish                        that   he was<\/p>\n
owner   of       the           vehicle.                 Petitioners<\/p>\n
challenged   the         conviction                and     sentence<\/p>\n
before  Sessions            court,            Thrissur           in<\/p>\n
Crl.A.422\/2001. Learned Additional Sessions<\/p>\n
Judge  on     re-appreciation                       of    evidence<\/p>\n
CRRP 2979\/03              2<\/span><\/p>\n
confirmed     the  conviction  and   sentence  and<\/p>\n
dismissed the appeal. It is challenged in the<\/p>\n
revision.\n<\/p>\n
           2.   Learned  counsel appearing for the<\/p>\n
petitioner     and learned Public Prosecutor were<\/p>\n
heard.\n<\/p>\n
           3. Argument of the    learned   counsel<\/p>\n
is that there is no independent evidence to<\/p>\n
prove     that     petitioners  were  transporting<\/p>\n
contraband liquor and relying on the evidence<\/p>\n
of Pws.1 to 3 alone, courts below should not<\/p>\n
have     convicted  them.   It  was  argued   that<\/p>\n
petitioner     is     the   driver    and   second<\/p>\n
petitioner is the cleaner of the lorry and<\/p>\n
contraband article was seized from the built in<\/p>\n
tank      concealed  in the vehicle    and in the<\/p>\n
absence of       evidence to prove    that it was<\/p>\n
concealed      with   the  knowledge      of   the<\/p>\n
petitioners, petitioners should not have been<\/p>\n

convicted.    Finally,   learned  counsel   argued<\/p>\n
that     as   the  incident   occurred  in   1996,<\/p>\n
substantive sentence may be avoided.<\/p>\n
           4. Learned  Public Prosecutor   pointed<\/p>\n
out     that   Ext.P3  certificate   of   chemical<\/p>\n
analysis      establish   that contraband article<\/p>\n
contained     94.64% by volume of Ethyl Alcohol<\/p>\n
and there is no reason to interfere      with the<\/p>\n
conviction or the sentence.\n<\/p>\n
           5. Prosecution   case   is    that   on<\/p>\n
17\/9\/1996 at about 11.15 p.m lorry KL-7\/L-3427<\/p>\n
was    found   parked  on  the  side  of  National<\/p>\n
Highway in front of       Indian Coffee House at<\/p>\n
Mannuthy. First petitioner was the driver and<\/p>\n
second      petitioner,   the   cleaner.   Getting<\/p>\n
suspicious     Pws.1 to 3 Excise Officials checked<\/p>\n
the vehicle and it was found     that vehicle was<\/p>\n
not having any valid license or permit. When<\/p>\n
lorry was examined, it was found that in two<\/p>\n

tanks      2000  liters   of  spirit   was   being<\/p>\n
transported.    The  spirit  in  the  vehicle  was<\/p>\n
seized     and Ext.P1  mahazar  was  prepared  and<\/p>\n
three representative samples were also taken.<\/p>\n
Petitioners     were    arrested.   Samples   were<\/p>\n
produced      in court and     sent for chemical<\/p>\n
analysis and obtained Ext.P3        report. Under<\/p>\n
Ext.P2 occurrence report case was registered.<\/p>\n
On   the    final  report  being   filed,  learned<\/p>\n
Magistrate     took  cognizance  of  the   offence<\/p>\n
under Section 55(a) of Abkari Act. Petitioners<\/p>\n
and     third    accused   pleaded   not   guilty.<\/p>\n
Prosecution examined four witnesses and marked<\/p>\n
three exhibits.     Petitioners   did not   adduce<\/p>\n
any evidence.     They did not explain possession<\/p>\n
of   the    spirit  found  in  the  vehicle, when<\/p>\n
questioned     under  Section   313  of  Code   of<\/p>\n
Criminal Procedure. Learned Magistrate accepted<\/p>\n
the evidence of Pws.1 and 4 and found that<\/p>\n

petitioners     were  possessing  2000  liters  of<\/p>\n
spirit      in violation of the provisions of the<\/p>\n
Abkari Act and     Rules and therefore,  convicted<\/p>\n
them      for the offence under Section 55(a) of<\/p>\n
Abkari Act. Learned Sessions Judge appreciated<\/p>\n
the evidence    and confirmed the  findings.<\/p>\n
           6. Learned   counsel   argued that when<\/p>\n
Pws.3 and 4 independent witnesses to Ext.P1<\/p>\n
mahazar     turned  hostile  to  the  prosecution,<\/p>\n
evidence of Pws.1 and 2 should not have been<\/p>\n
accepted. I have gone through the evidence of<\/p>\n
Pws.1 and 2 and Ext.P1 mahazar. No material<\/p>\n
contradictions      were pointed out. Fact that<\/p>\n
independent witness to the scene mahazar turned<\/p>\n
hostile to the prosecution, does not mean that<\/p>\n
evidence     of  an  Excise  Officials  is  to be<\/p>\n
disbelieved. There is no        rule or law that<\/p>\n
evidence of an Excise Official or a police<\/p>\n
officer is either to be disbelieved or to be<\/p>\n

viewed with suspicion. Evidence     of Pws.1 and 2<\/p>\n
is   fully       corroborated by  Ext.P1  mahazar.<\/p>\n
Courts      below     on  proper  appreciation  of<\/p>\n
evidence      accepted the evidence of Pws.1 and 2<\/p>\n
and found that       petitioners being, the driver<\/p>\n
and   cleaner    of  the  lorry  KL-7\/L-3427, were<\/p>\n
transporting     2000 liters of spirit when it was<\/p>\n
detected at about 11.15 p.m on 17\/9\/1996.<\/p>\n
           7. Ext.P3 report establishes that it is<\/p>\n
spirit. In such circumstances,       conviction of<\/p>\n
the petitioner for the offence under Section 55<\/p>\n
(a) of Abkari Act is perfectly legal.<\/p>\n
           8. Then   the  only  question  is  with<\/p>\n
regard to the sentence. Considering the huge<\/p>\n
quantity of spirit being transported, I find no<\/p>\n
reason to interfere with the        sentence also.<\/p>\n
Even     though   sentence  as  on   the  date  of<\/p>\n
commission of the offence is punishable with<\/p>\n
imprisonment for a term which may extend        to<\/p>\n
CRRP 2979\/03              7<\/span><\/p>\n
two   years,    learned  Magistrate  sentenced  the<\/p>\n
petitioners     only  to  simple  imprisonment  for<\/p>\n
three     months.  Fine   of  Rs.25,000\/-  is   the<\/p>\n
minimum fine      provided  under the Abkari Act.<\/p>\n
In such circumstances, there is no       reason to<\/p>\n
interfere with the conviction or the sentence.<\/p>\n
           Revision is dismissed. Petitioners  are<\/p>\n
directed to appear before the Judicial First<\/p>\n
Class     Magistrate-III,  Thrissur  on  12\/8\/2010.<\/p>\n
Judicial First Class Magistrate is directed to<\/p>\n
execute the sentence.\n<\/p>\n<\/p>\n
