J’UDGMENT<\/p>\n
These two appeals arise out of the common<\/p>\n
judgment and award passed in M.V.c.No.73\/2001-and<\/p>\n
M.V.C.No.69\/2001 disposed of on <\/p>\n
MACT, Madikeri.\n<\/p>\n
2. These two appeals are   <\/p>\n
seeking enhancement of comg\ufb01ensathion  ‘V<\/p>\n
the said common judgment and  in re’s’pe’et of the<\/p>\n
accider1ta\u00a7\u00a3'”s1rstained'”‘by'”them in a road traffic<\/p>\n
accident that  28.11.2000 at about 8.30<\/p>\n
p.m. Vwvhent”the’ ela\ufb01mtantzappellants were on their way to<\/p>\n
  Vil.1age I-‘I’ar1:’–1’C’odu from Somwarpet on their<\/p>\n
  No.KA. 12 \/E– 5098.\n<\/p>\n
‘V 3.   elairnant in M.V.C.No.73\/O1 H.R.Ganesh Was<\/p>\n
‘..f..riding the motereycie and the claimant in<\/p>\n
‘  O1 H.R:Dinesh was proceeding as a pillion<\/p>\n
 When they were driving towards Kibbetta, the<\/p>\n
driver of a Mamthi Van bearing No.KA. 12 \/ M-9636 came<\/p>\n
in a rash and negligent manner and dashed against the<\/p>\n
EL<\/p>\n
\/4<\/p>\n
motorcycle. As a result, they fell down and sustained
\ninjuries. Ganesh was shifted to Government Hospital<\/p>\n
Somwarpet for first aid treatment and then he.-.___was<\/p>\n
shifted to NIMI-IANS Bangalore and Wthen.”j–..:’to<\/p>\n
K.R.H0spita1, Bangalore, wherein he was  <\/p>\n
days. Similarly, Dinesh was alsci’s}1’iftsg1′..to <\/p>\n
Hospital at Somwarpet and thereafter. he too_1:Atre.atrnent’~.<\/p>\n
at a Hospital at Bangalore. shad V<\/p>\n
suffered permanent’  disability t–:’:.Qni’~..paccountll’ of the
\naccidental injuries, they  t1e\u20acili~\u00bbll[respective claim<\/p>\n
petitions seeking c1oinpen’sation”on various heads.\n<\/p>\n
4. After servicef._lof__:”notice by the tribunal, the<\/p>\n
respondents ._appea1l'”edb””.and \ufb01led their statement of<\/p>\n
l V. “‘-obj’ec{tio”ns and contested the matter. in support of their<\/p>\n
  ‘ let in their evidence both oral as<\/p>\n
wel-l.__as__doci::rnentary. On the basis of the material on<\/p>\n
:”r.ecorci.*..- ” the tribunal awarded compensation of<\/p>\n
  as-.1.i;ts’s7,6oo\/– in lVl.V.C.No.69\/01 and Rs.2,85,300\/– in<\/p>\n
  ,..1’vl.V.C.No.73\/01 with interest at 6% p.a. from the date<\/p>\n
of petition till realisation. Not being satisfied with the<\/p>\n
said award the claimants have preferred these appeals.<\/p>\n
\ufb02y,<\/p>\n
5. We have heard the learned counsel forhthe<\/p>\n
appellant and the learned counsel for the  <\/p>\n
insurance company.\n<\/p>\n
6. insofar as M.F.A.No. 7 103   it concerned ;’ ‘i ._<\/p>\n
submission of the learned lco.ui1.sel for._ the  is it<\/p>\n
that considering the   the
\nevidence let in, the id  a meager
\ncompensation.   charges and
\ntransportation.”cliarVge:s:’:as  on the head of pain
\nand   no compensation
\nwas awlardedl  expenses. He further<\/p>\n
submits that._:VtheT’ appellant was earning a sum of<\/p>\n
llV.”‘R.sq.;i~;60ip;I\u00bb;’l-put lthelvsame was not believed by the<\/p>\n
Itri1<1un'a1:\u00b0andfrneager compensation has been awarded<\/p>\n
onthe  loss of future earning capacity.<\/p>\n
  Insofar as IvIF'A.l\\\u00a7"o.7l04\/'O7 is concerned, learned<\/p>\n
 o'oun'sel for the appellant submits that the award made<\/p>\n
i   the head of loss of income during the laid up period,<\/p>\n
attendant charges, transportation charges as well as<\/p>\n
future earning capacity are on the lower side and that<\/p>\n

no compensation has been awarded towards
\nnourishment and diet charges and that the award made
\nunder pain and suffering, loss of amenities is aiso on<\/p>\n
the lower side which calis for interference <\/p>\n
appeals.\n<\/p>\n
8. Per contra, learned coun_sel.__for .”the”‘iii.’nsurance_V <\/p>\n
company, supporting the judgment <\/p>\n
that in the instant case; -considering’ the  of ” it<\/p>\n
injuries and the evidence on-record, thetribunal has<\/p>\n
awarded a just and proper’ which does<\/p>\n
not call for inte1″fe.rence._in–these appeals. Having heard<\/p>\n
the counsel on  the only point that arises for<\/p>\n
 our45consi_deration__i_sas to whether the appellants are<\/p>\n
V”. en’tit1ed_ to ‘addi_tional Compensation.<\/p>\n
    as the appellant I-I.R.Ganesh in<\/p>\n
CfJ’viFA..,No.7i03\/O7 is concerned, from the material on<\/p>\n
d  record, it is evident that he sustained grade I open<\/p>\n
 fracture of shaft of left femur, fracture of mandible,<\/p>\n
coxnminuted fracture of right clavicle, deep lacerated<\/p>\n
wound over anterior abdominal wall with peritoneum<\/p>\n
\ufb01r\u00bb<\/p>\n
-3-<\/span><\/p>\n
exposed, pneumothorax on left side, concussive head<\/p>\n
injury with mild diffuse cerebral edema and _.deep<\/p>\n
lacerated wound on the face and dorsum of right<\/p>\n
Three doctors were examined to prove that  <\/p>\n
treatment and they have stated’ that p_t’her;e <\/p>\n
disability to the whole body.  the_-v_,A.sametV <\/p>\n
consideration and taking  the   it the
\nappellant was engagedwiifi  ._ and lvooking after
\ncoffee plantation, a sum   has to be<\/p>\n
assessed as”  2:  the appellant.\n<\/p>\n
Accordingly;   ciihsabvivlity and by applying
\nappropriate  and considering the fact<\/p>\n
that the appeI_la_nt..’was  years at the time of accident,<\/p>\n
 of..ppRs.\u00e9V4,'(\u00a7()VO\/~ which is rounded off to<\/p>\n
  as compensation on the head of<\/p>\n
loss-.__of earning capacity. Similarly, on the head<\/p>\n
“of attendant and transportation charges a further sum<\/p>\n
 ,.’t’of’Rs:”10,000\/~ is awarded. As far as pain and suffering<\/p>\n
it  -isconcerned, considering the nature of injury sustained<\/p>\n
by the appellant an additional sum of Rs.25,000\/~ is<\/p>\n
awarded. On the head of loss of amenities, a further<\/p>\n

sum of Rs.10,000\/– is awarded and considering the fact<\/p>\n
that he had undergone surgery and there wp’p””Were<\/p>\n
implants, a sum of Rs.l0,000\/– is awarded<\/p>\n
medical expenses and thereby  <\/p>\n
enhanced compensation of  <\/p>\n
carry interest at the rate o’f,_(_3%  froIn””the:’_dat%e.’.of <\/p>\n
claim petition till realisationf”7lflieu avvxarduilrnade on the
\nother heads are left of the said
\nenhanced corngiensationlda   Vp’Rs”.5O,OOO\/- with<\/p>\n
proportionate  _ \u20acs_ha1l.f \u00a7blelV:’deposited in any<\/p>\n
nationialised.:lianl{\u00a7vf’or:l’a1fl’linitialperiod of five years and
\nthe appellant– \u00bb\u00bbi:e~ntitled to draw periodical<\/p>\n
interest onluthe said deposit. The balance compensation<\/p>\n
 if   released tothe appellant.\n<\/p>\n
to, the appellant in M.F.A.No.7104\/O7 is<\/p>\n
cori.cerned,l’.ii’rom the material on record it is evident that<\/p>\n
 V”‘heiphad..-sustained fracture of right squamous temporal<\/p>\n
” . ‘ ‘xyall-,*’ sphenoid sinus–post traumatic collections, left<\/p>\n
 ~\u00bbv-parietal\/parietowfrontal chronic subdural haematorna,<\/p>\n
right parietal cortical focal calcifications–gran1.rle<\/p>\n
umayous and concussive head injury with fracture of<\/p>\n
\ufb01n.\n<\/p>\n
-10-<\/span><\/p>\n
right squamous temporal bone following which he has
\nsevere sensory neural hearing loss in the right ear and<\/p>\n
and it has come in the evidence that there was  of<\/p>\n
hearing. Considering his quali\ufb01cation as <\/p>\n
Engineering and that he was working   9 <\/p>\n
and also doing contract work, <\/p>\n
income to be at Rs.5,ooo\/–._ and\ufb02the  ‘for if.<\/p>\n
permanent disability at    the
\nappropriate multiplier._..’:of_’  Rs.23,400\/–<\/p>\n
rounded off to Rs.25,:GG9h\/:3 is the head of<\/p>\n
loss  addition, a sum of
\nRs.6,000\/l-\u00ab is  loss of income during<\/p>\n
the pgperiodh’ treativnent and an additional sum of<\/p>\n
 is awarded towards attendant charges and<\/p>\n
 tgharges. A further sum of Rs.25,000\/~ is<\/p>\n
awarded the head pain and suffering and an<\/p>\n
 sum of Rs.30,000\/~ is awarded towards loss<\/p>\n
uglll-ot’–\u00bb.arn.enities and a sum of Rs.l0,000\/- is awarded<\/p>\n
 ….tswards nourishment and diet charges. Considering<\/p>\n
V the fact that the appellant had undergone surgery and<\/p>\n
there were implants and for removal of implants, future<\/p>\n
\ufb01e\u00bb<\/p>\n

medical expenses is required. On re–appreciation of
\nevidence on record we feel that towards medieal
\nexpenses a further sum of Rs.25,000\/-
\n  awarded thereby making\ufb01tidae total   <\/p>\n

11. It is”‘rnadve (:1_ea.1f  in both the cases, with regard<\/p>\n
_ to  medic-a:1Vv_expenses there would be no interest<\/p>\n

12. For the aforesaid reasons, the appeals are allowed <\/p>\n
