\n    The petitioner, an    employee of a co-operative<\/p>\n
society,  challenges  Ext.P6. At  the   outset, it   is<\/p>\n
clarified that this judgment is being issued on the<\/p>\n
main issue that Ext.P6 is a non-speaking order, leaving<\/p>\n
open all other issues.\n<\/p>\n<\/p>\n
2.  The petitioner’s employer, a co-operative society,<\/p>\n
resolved and requested for exemption from possessing a<\/p>\n
qualification,  for  the   purpose  of  promoting   the<\/p>\n
petitioner in its service. The Registrar forwarded that<\/p>\n
request to the Government. The Government sent impugned<\/p>\n
Ext.P6 to the Registrar stating that it has been<\/p>\n
decided that exemption need not be granted. It is<\/p>\n
single line order, a cryptic one, stating no reason for<\/p>\n
that decision.\n<\/p>\n

3.   The     request   was  for   exercising  a  power of<\/p>\n
exemption. To grant or not, is within the power of the<\/p>\n
authority empowered to grant in terms of law. But, it<\/p>\n
is of the core principles of administrative law, that a<\/p>\n
decision has to contain its reasons. This           is on<\/p>\n
account of different reasons. One is that, if the<\/p>\n
aggrieved      person  carries   the  matter to  a  higher<\/p>\n
authority, or requests for judicial review of that<\/p>\n
decision, fundamentally, reasons and lawful procedures<\/p>\n
are   those      which will sustain   the  decision making<\/p>\n
process and ultimately the decision. These principles<\/p>\n
of    administrative     law,    which  have   grown  with<\/p>\n
civilisation, have now found expression in Sections 3<\/p>\n
and 4(1)(d) of the Right to Information Act, 2005,<\/p>\n
hereinafter referred to as “RTI Act”. Section 3 of the<\/p>\n
RTI Act provides that all citizens shall have the right<\/p>\n
to information subject to the provisions of that Act.<\/p>\n
Section 4(1)(d) of the RTI Act provides that every<\/p>\n
public      authority  shall   provide   reasons  for  its<\/p>\n
administrative or quasi judicial decisions to affected<\/p>\n

persons. Indisputably, the Government and the Registrar<\/p>\n
of Co-operative Societies are public authorities as<\/p>\n
defined in Section 2(h) of the RTI Act. It goes without<\/p>\n
saying that the impugned Ext.P6 order is one which<\/p>\n
affects the writ petitioner’s claim for promotion to<\/p>\n
higher post, to which his employer society has agreed.<\/p>\n
Therefore, the petitioner has the statutory right in<\/p>\n
terms of Section 4(1)(d) of the RTI Act to be provided<\/p>\n
with the reasons for the administrative decision of the<\/p>\n
Government that has led to the issuance of Ext.P6<\/p>\n
order. Bereft of that, Ext.P6 is issued in infraction<\/p>\n
of that provision of the RTI Act. This, in turn,<\/p>\n
results     in    Ext.P6 being   an arbitrary exercise of<\/p>\n
authority, in so far as the petitioner is concerned,<\/p>\n
since it results in negation of the Rule of Law and<\/p>\n
thereby,      infraction  of   the  fundamental right  to<\/p>\n
equality before law and equal protection of the laws,<\/p>\n
guaranteed by Article 14 of the Constitution of India.<\/p>\n

4.   Time has come when the prestigious and salutary<\/p>\n
principles of administrative law have found expression<\/p>\n
in provisions like the one noticed in this judgment,<\/p>\n
from the RTI Act. They are laws to be always remembered<\/p>\n
and     obeyed      by  the   administrative, or   other,<\/p>\n
authorities, who are public authorities.<\/p>\n
        For the aforesaid reasons, this writ petition is<\/p>\n
allowed, quashing Ext.P6 without expressing anything on<\/p>\n
merits. The Government shall take up the matter and<\/p>\n
reconsider the issue and pass fresh orders, after<\/p>\n
affording       the   petitioner   and  his  employer an<\/p>\n
opportunity of hearing, in accordance with law, within<\/p>\n
a period of three months from the date of receipt of a<\/p>\n
copy of this judgment.\n<\/p>\n<\/p>\n
