NO. 869 OF 2005\n                        ---------------------------------\n            DATED THIS THE 2ND DAY OF SEPTEMBER, 2010\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p>Barkath Ali, J.\n<\/p>\n<\/p>\n<p>        The appellant is the 3rd respondent, Insurance Company<\/p>\n<p>   in OP(MV) No. 271\/2002 on the file of Motor Accidents Claims<\/p>\n<p>   Tribunal, Tirur. The first respondent in this appeal who is the<\/p>\n<p>   claimant in OP is the mother of deceased Kaisumon who<\/p>\n<p>   died in a motor accident that occurred on 3rd April, 2002 at<\/p>\n<p>   about 1.15 p.m. near Kumaranellur Vetinary hospital<\/p>\n<p>   Junction. The accident happened while the deceased and his<\/p>\n<p>   friend one Abid were walking along the side of the road, they<\/p>\n<p>   were knocked down by the bus bearing registration No. KLL-<\/p>\n<p>   10K\/8479. They sustained serious injuries and succumbed<\/p>\n<p>   to the injuries sustained while undergoing treatment at the<\/p>\n<p>   hospital. Alleging negligence against the driver of the bus,<\/p>\n<p>   the first respondent, the claimants filed O.P u\/S. 166 of the<\/p>\n<p>   Motor Vehicles Act claiming a compensation of Rs. 6 lakhs.<\/p>\n<p>M.A.C.A. NO. 869 OF 2005<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>2.    Respondents 1 and 2 in the O.P who are the driver and<\/p>\n<p>owner of the offending bus remained absent before the<\/p>\n<p>Tribunal. The 3rd respondent, the Insurer of the offending<\/p>\n<p>bus filed a written statement admitting the policy of the<\/p>\n<p>offending bus.\n<\/p>\n<p>3.    This O.P was jointly tried along with O.P No. 270\/2002<\/p>\n<p>filed by the legal heirs of the deceased Abid and a common<\/p>\n<p>award was passed.\n<\/p>\n<p>4.    PW1 was examined and Exts.A1 to A9 were marked on<\/p>\n<p>the side of claimants.     No evidence was adduced by the<\/p>\n<p>contesting 3rd respondent, the appellant herein.      On an<\/p>\n<p>appreciation of evidence, the Tribunal found that the<\/p>\n<p>accident occurred due to the negligence of the first<\/p>\n<p>respondent in O.P, the driver of the offending bus and<\/p>\n<p>awarded a compensation of Rs. 3,69,500\/- with interest at<\/p>\n<p>the rate of 6% per annum from the date of petition till<\/p>\n<p>realization and a cost of Rs. 1500\/-. The Insurance Company<\/p>\n<p>has now come up in appeal challenging the quantum of<\/p>\n<p>M.A.C.A. NO. 869 OF 2005<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>compensation awarded by the Tribunal.<\/p>\n<p>5.   Heard the counsel for the appellant\/Insurance Company<\/p>\n<p>and that of the claimants.\n<\/p>\n<p>6.   The accident is not disputed. The only question which<\/p>\n<p>arises for consideration is whether the compensation<\/p>\n<p>awarded by the Tribunal is excessive ?<\/p>\n<p>7.   The Tribunal awarded a total compensation of Rs.<\/p>\n<p>3,69,500\/-. The break up of the compensation awarded is as<\/p>\n<p>under:\n<\/p>\n<blockquote><p>     For loss of dependency       :Rs. 3,60,000<br \/>\n     For pain and suffering,      :Rs.     9,500<br \/>\n     loss of estate, for loss of<br \/>\n     love and affection, funeral<br \/>\n     expenses etc..                    &#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p><\/blockquote>\n<blockquote><p>                           Total  :Rs. 3,69,500<br \/>\n                                       =======<\/p>\n<\/blockquote>\n<blockquote><p>8.   The Tribunal took the monthly income of the deceased<\/p>\n<p>as Rs. 3,000\/-.      After deducting 1\/3 for his personal<\/p>\n<p>expenses, took Rs. 2000\/- per month as his monthly<\/p>\n<p>contribution to his family and adopted a multiplier of 15 and<\/p>\n<p>awarded a compensation of Rs. 3,60,000\/- for loss of<\/p>\n<p>M.A.C.A. NO. 869 OF 2005<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>dependency.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>9.   The counsel for the appellant, Insurance Company<\/p>\n<p>argued that as there was no evidence to prove the income of<\/p>\n<p>the deceased, the Tribunal is not justified in taking his<\/p>\n<p>monthly income as Rs. 3000\/-. The counsel for the appellant<\/p>\n<p>further argued that as the deceased was a bachelor, the<\/p>\n<p>Tribunal should have adopted one half of his income for his<\/p>\n<p>personal expenses and adopted a lesser multiplier in this<\/p>\n<p>case.   We find no merit in the above contention of the<\/p>\n<p>appellant. According to the claimants, the deceased was a<\/p>\n<p>tailor earning to Rs. 4,000\/- per month.      Further even a<\/p>\n<p>coolie would fetch a minimum income of Rs. 100\/- per month<\/p>\n<p>in those days. Therefore, the Tribunal is perfectly justified in<\/p>\n<p>taking the monthly income of the deceased as Rs. 3,000\/-.<\/p>\n<p>There is no evidence to show that the claimant has any<\/p>\n<p>other children. Under these circumstances we feel that the<\/p>\n<p>compensation awarded by the Tribunal is just and<\/p>\n<p>M.A.C.A. NO. 869 OF 2005<br \/>\n<span class=\"hidden_text\">                               5<\/span><\/p>\n<p>reasonable and not excessive.\n<\/p>\n<p>10. In the light of our above findings, the appeal is devoid<\/p>\n<p>of any merit and is liable to be dismissed.<\/p>\n<p>    In the result, the appeal is dismissed.
