Nanavaty, learned APP waives service of notice of Rule<br \/>\non behalf of respondent State. With the consent of the parties rule<br \/>\nis fixed forthwith.\n<\/p>\n<p>2.\tThe<br \/>\napplicant has moved this application under section 438 of Cr.P.C. for<br \/>\nseeking anticipatory bail in the event of his likely arrest in<br \/>\nrespect of CR.I.225 of 2009 dated 30.11.2009 registered at<br \/>\nHimmatnagar Town Police Station, Sabarkantha for the offences<br \/>\npunishable under sections 420, 406, 114, 508 of the Indian Penal<br \/>\nCode.\n<\/p>\n<p>3.\tThe<br \/>\naccused moved the application being Criminal Misc. Application<br \/>\nNo.133\/2010 before the concerned Sessions Court, which came to be<br \/>\nrejected on 03.03.2010.\n<\/p>\n<p>4.\tThis<br \/>\nCourt has perused the FIR and role attributed to the present<br \/>\napplicant. Looking to the averments in the complaint and after<br \/>\nhearing learned counsels of the parties this Court is of the<br \/>\nconsidered view that anticipatory bail deserves to be granted to the<br \/>\napplicant for the following reasons :\n<\/p>\n<p>(I)\tLooking<br \/>\nto the entire incident as narrated in the complaint and the attending<br \/>\ncircumstances has persuaded this Court to exercise discretion under<br \/>\nSection 438 of the Code of Criminal Procedure in favour of the<br \/>\npresent applicant. Hence the following order:\n<\/p>\n<p>5.\tThis<br \/>\napplication is therefore deserves to be allowed and is accordingly<br \/>\nallowed on the following conditions as under :\n<\/p>\n<p>\tThat<br \/>\nin the event of arrest of the applicant in connection with<br \/>\nCR.No.I.225 of 2009 registered at Himmatnagar<br \/>\nTown Police Station, Sabarkantha, he shall be released<br \/>\non anticipatory bail in respect of the offences alleged against him<br \/>\nin this application, on his executing a bond of Rs.5,000\/- (Rupees<br \/>\nFive Thousand only) with one surety of the like amount, by the<br \/>\nconcerned Police Officer and on conditions that he shall :\n<\/p>\n<p>(a)\tremain<br \/>\npresent before the Trial Court regularly as and when directed on the<br \/>\ndates fixed;\n<\/p>\n<p>(b)\tappear<br \/>\nbefore the concerned Police Station, on 14.06.2010 between 9.00 a.m.<br \/>\nand 2.00 p.m.<\/p>\n<p>(c)\tmake<br \/>\nhimself available for interrogation by the police officer whenever<br \/>\nand wherever required;\n<\/p>\n<p>(d)\tnot<br \/>\ndirectly or indirectly make any inducement, threat or promise to any<br \/>\nperson acquainted with the fact of the case so as to dissuade him<br \/>\nfrom disclosing such facts to the Court or to any police office;\n<\/p>\n<p>(e)\tnot<br \/>\nto obstruct or hamper the police investigation and not to play<br \/>\nmischief with the evidence collected or yet to be collected by the<br \/>\npolice;\n<\/p>\n<p>(f)\tat<br \/>\nthe time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nhis residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>(g)\tnot<br \/>\nleave Gujarat State without the prior permission of the Court and, if<br \/>\nhaving passport, shall deposit the same before the Trial Court;<br \/>\nwithin a week.\n<\/p>\n<p>6.\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it proper and just, and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>7.\tThis<br \/>\norder will hold good if the applicant is arrested at anytime within<br \/>\n90 days from today. The order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of his arrest.<br \/>\nThereafter, it will be open to the applicant to make a fresh<br \/>\napplication for being enlarged on bail in usual course which when it<br \/>\ncomes before the competent Court, will be disposed of in accordance<br \/>\nwith law, having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time, un-influenced by the fact<br \/>\nthat anticipatory bail was granted.\n<\/p>\n<p>8.\tRule<br \/>\nmade absolute.
