An application for necessary permission was made on<br \/>\n\t19.11.2009 and after verification of the land in question by the<br \/>\n\tofficer, the said permission was duly granted by the respondent No.3<br \/>\n\ton 19.11.2009. The permission was granted by the respondent No.2 for<br \/>\n\t1000 Metric Tons and validity period was given from 19.11.2009 to<br \/>\n\t25.11.2009. Subsequently work was not over and therefore, second<br \/>\n\tpermission was obtained by respondent No.2 for about 2000 Metric<br \/>\n\tTons for the period from 26.11.2009 to 15.12.2009 vide order dated<br \/>\n\t26.11.2009. On the very same day, the officers of the respondent No.<br \/>\n\t2 seized Four Trucks of the petitioner on the ground that the same<br \/>\n\tis utilized in transportation without any valid pass or permit.<br \/>\n\tImmediately on 11.12.2009, the petitioner visited the office of the<br \/>\n\trespondent No.3 for releasing the said trucks  because all the<br \/>\n\ttrucks were belonging to the different owners and petitioner had<br \/>\n\ttaken the same on rental basis, but no reply has been given by the<br \/>\n\trespondent. Thereafter, after 16 days, a show cause notice has been<br \/>\n\tissued by the respondent No.2 on 11.12.2009 showing to recover an<br \/>\n\tamount of Rs. 20,43,240\/- from the petitioner. Pursuant to the same<br \/>\n\ton 16.12.2009 necessary reply was filed by the petitioner but no<br \/>\n\tdecision was taken for releasing the truck in favour of the<br \/>\n\tpetitioner on furnishing Bond. The owner of the trucks also filed<br \/>\n\tnecessary applications for release of their truck upon  production<br \/>\n\tof personal\/security bond. The respondent No. 3 is not deciding the<br \/>\n\tapplications of the truck owner. Hence, this petition.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocates for the respective parties.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the petitioner submitted that though the second<br \/>\n\tpermission was obtained, four trucks of the petitioners were<br \/>\n\tdetained stating that the four trucks of the petitioners were<br \/>\n\tillegally transporting the clay without any pass or permits, but the<br \/>\n\tfacts remain that the petitioner had already taken permission from<br \/>\n\t26.11.2009 to 15.12.2009 from the respondent.  However, without<br \/>\n\tconsidering this fact, the respondent No. 2 refused to release the<br \/>\n\tvehicles of the petitioner. He further submitted that there is no<br \/>\n\tevidence to prove the guilt of the petitioner and therefore, the<br \/>\n\tentire proceedings  initiated against the petitioner are vitiated<br \/>\n\tfor non-compliance of principles of natural justice.\n<\/p>\n<p>Learned<br \/>\n\tAssistant Government Pleader defended the action of the respondents<br \/>\n\tand submitted that the petition may be dismissed.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocates for the respective parties.\n<\/p>\n<p>As<br \/>\n\ta result of hearing and on perusal of the record it is found that<br \/>\n\tthe permission was granted by the respondent No. 2 for 1000 Metric<br \/>\n\tTons and the validity period was from 19.11.2009 to 25.11.2009 by<br \/>\n\tputting condition to pay Rs. 5\/- per tone royalty amount. By<br \/>\n\tcomplying with the same Rs. 5000\/- was already paid by the<br \/>\n\tpetitioner. Subsequently as the work was not over, the second<br \/>\n\tpermission was obtained by the petitioner and the same was granted<br \/>\n\tby respondent No.2 for about 2000 Metric Tons for the period from<br \/>\n\t26.11.2009 to 15.12.2009 vide order dated 26.11.2009. It is also<br \/>\n\tfound that on 26.11.2009 the officers of the respondent No. 2 seized<br \/>\n\tfour trucks of the petitioner on the ground that the same is<br \/>\n\tutilized in transportation without any valid pass or permits.<br \/>\n\tHowever, the fact remains that on that very day the permission was<br \/>\n\ttaken. Even though the petitioner has pointed out the same, the<br \/>\n\trespondent authority has proceeded further and seized the vehicles.<br \/>\n\tThereafter, the show cause notice was issued. In any case there was<br \/>\n\trequisite permission and on that ground the vehicles could not have<br \/>\n\tbeen detained and the detention is without any authority of law.<br \/>\n\tFurther the vehicles are of different owners. Even the owners have<br \/>\n\tfiled undertaking to furnish security\/bond release of the vehicle.\n<\/p>\n<p>Learned<br \/>\n\tAssistant Government Pleader is not in a position to show that on<br \/>\n\tthe day in question there was no permission. In fact the permission<br \/>\n\twas taken on the very same day. Therefore, the impugned action is<br \/>\n\tillegal and arbitrary.\n<\/p>\n<p>In<br \/>\n\tthe premises aforesaid, the respondent No. 2 shall hand over four<br \/>\n\ttrucks bearing Nos. GJ-18-AT-8201, GJ-18-AT-9074, GJ-18-X-9625 and<br \/>\n\tGJ-18-AT-9407 to the petitioner within 24 hours from the date of<br \/>\n\treceipt of the writ of this order. Petition is allowed to the<br \/>\n\taforesaid extent. Direct service is permitted.\n<\/p>\n<p>With<br \/>\n\tthe above observation, petition stands disposed of.
