On 19.11.1988, during the course of<br \/>\nemployment, deceased Manubhai met with an accident and sustained<br \/>\nsevere bodily injuries and ultimately succumbed to it.\n<\/p>\n<p>2.1.\t\tThe<br \/>\nlegal heirs of the deceased, the appellants herein, filed an<br \/>\napplication  before the learned Civil Judge (SD) and Ex-officio<br \/>\nCommissioner for Workmen&#8217;s Compensation, Panchmahals at Godhra for<br \/>\nrecovery of compensation to the tune of Rs.54,896\/- under the<br \/>\nWorkmen&#8217;s Compensation Act.\n<\/p>\n<p>2.2.\t\tThe<br \/>\nlearned trial Judge, after hearing the parties and after considering<br \/>\nthe evidence on record partly allowed the application. However, no<br \/>\npenalty was imposed by the trial Court. Hence,  this appeal.\n<\/p>\n<p>3.0.\t\tThe<br \/>\nmain contention raised in this appeal is that while passing the<br \/>\nimpugned award, the trial Court ought to have imposed penalty in view<br \/>\nof the fact that the accident was within the knowledge of the<br \/>\nemployer. Having perused the evidence on record, it appears that no<br \/>\nevidence was produced on record to the effect that they are entitled<br \/>\nto get penalty on the total amount of compensation. However, it is a<br \/>\nmatter of discretion whether to grant the penalty or not. Hence, no<br \/>\ncase is made out to interfere with the impugned order.
