1\t\tHeard
\nlearned Advocate Mr. Kishor M. Paul, appearing on behalf of  the
\napplicants  and learned Advocate Mr. P.S. Gogia, appearing on behalf
\nof the Opponent.  In main matters, being Special Civil Application
\nNo. 7593 of 2008 with  Special Civil Application No. 11156 of 2008
\nwith Special Civil Application No. 11157 of 2008, this Court has
\npassed a Common Order dated 11th of May, 2009, which is
\nquoted as under :\n<\/p>\n
Heard
\n\tMr. Gogia learned advocate for the petitioner and Mr. Paul learned
\n\tadvocate for the respondent.\n<\/p>\n
Considering
\n\tthe observations made and recorded in the impugned and considering
\n\tthe submissions made by both the sides, the petition requires
\n\tconsideration.\n<\/p>\n
Hence,
\n\tRule. Mr. Paul learned advocate waives service of notice of
\n\tRule on behalf of the respondent. By way of interim relief it is
\n\tdirected that the operation of the impugned award shall remain
\n\tstayed on condition that the petitioner shall comply with the
\n\trequirements under Section 17-B of the Industrial Disputes Act,
\n\t1947.\n<\/p>\n
It
\n\tdeserves to be mentioned that the petitioner had offered Rs.
\n\t40,000\/- to each of the workmen as lumpsum amount for final
\n\tsettlement.\n<\/p>\n
2\t\tThe
\nLabour Court, Rajkot, has granted reinstatement  in favour of  the
\nworkmen with 25%  back wages   in each award, which is challenged  in
\nthe writ petitions.  This Court had passed a common order on 11th
\nof May, 2009 in all the three  Special Civil Applications  where
\nreinstatement oder  has been stayed   on condition that   the
\npetitioner  shall comply with the  requirement  under Section 17-B of
\nthe I.D. Act, 1947.  Learned Advocate Mr. Paul  submitted that
\nunemployment affidavit has been filed  by each  respondent workman
\nbefore this court in all the three petitions  that  the workmen are
\nunemployed and are  not gainfully employed  and, therefore,  the
\nworkmen are entitled to  get last drawn wages  from the date of
\nAward,  but that amount is not paid by petitioner establishment.
\nTherefore, the present applications are filed with a prayer to grant
\nlast drawn  wage in favour of the workmen for compliance of condition
\nincorporated by this Court in Order dated 11th of May,
\n2009.  On behalf of the Opponent  i.e. original petitioner   learned
\nAdvocate Mr. Gogia  submitted that  the main matters may be proceeded
\nfirst  and  petitioner is prepared to comply  with the provisions of
\nSection 17-B   of the I.D. Act, 1947.\n<\/p>\n
3\t\tIt
\nis very difficult to   decide   all the three petitions because
\nnumber of old matters are in queue. Therefore,   this Court can fix
\nthese three matters  for final hearing  in the month of April, 2010.
\nThere is no counter affidavit filed  by the  petitioner  against the
\naffidavit of the workmen  which is filed under Section 17-B of the
\nI.D. Act, 1947.\n<\/p>\n
4\t\tTherefore,
\nin view of this, the  mandatory provision must have to be  complied
\nwith by the petitioner  by paying last drawn wages to the  opponents
\n  workmen  from the date of Award   i.e. 31.12.2007.\n<\/p>\n
5\t\tLearned
\nAdvocate Mr. Paul  for the applicants submitted that  two
\napplications  are filed by workmen, but one workman has not filed
\napplication,  is also entitled to get the last drawn wages from the
\nopponent   petitioner. Therefore, requested to this Court to pass
\ncommon order which includes the workman who has not filed  the Civil
\nApplication.\n<\/p>\n
6\t\tTherefore,
\nin view of the above,  it is directed  the opponent   petitioner
\nM\/s Orbit Bearings India Limited,   to pay last drawn  wages to each
\nrespondent workman, namely,    (i) Smt. Maltiben Jayantilal  Uteriya;\n<\/p>\n
 (ii) Smt. Shilaben Natvarlal Makwana and, (iii)  Smt. Shardaben
\nPunjabhai Ghedia, w.e.f.  31st of December,  2007 till
\n31st of March, 2010 within a period of  one month from the
\ndate of receiving a copy of the present order. Thereafter  it is
\nfurther directed to the opponent   petitioner  to pay regularly
\nthe last drawn wages  to all the three concerned workmen, as referred
\nto above.\n<\/p>\n
7\t\tUpon
\nthe request made by learned Advocate  Mr. Gogia, all the three
\nSpecial Civil Application Nos.  7593 of 2008, 11156 of 2008 and 11157
\nof 2008, are fixed for  final hearing  on 23rd of April,
\n2010.  Registry is directed to  notify the aforesaid matters  for
\nfinal hearing  on Admission Board.\n<\/p>\n
8\t\t<\/span><\/p>\n
In view of the aforesaid observations and directions passed by this
\nCourt, Civil Application No.  13336 of 2009 and  13338 of 2009   are
\naccordingly disposed of.\n<\/p>\n
9\t\tIt
\nis made clear  that for the same relief,  if the workmen   have filed
\nRecovery Applications before the Labour Court, Rajkot,  claiming
\nthe last drawn wages  from the date of award, then,  those Recovery
\nApplications are required to be  disposed of by the Labour  Court,
\nRajkot,  because of the order passed by this Court  in the present
\ntwo Civil Applications   in favour of three workmen.   However, it is
\nalso open for the opponent   petitioner to reinstate the  opponents
\n  workmen, but before that,   the opponent   petitioner must
\nhave to comply with the order passed by this Court today.\n<\/p>\n
