Advocate\n\nHon'ble Ravindra Singh,J.\n<\/pre>\n<p>Heard\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0applicants\u00a0and\u00a0learned\u00a0A.G.A.<br \/>\nThis\u00a0application\u00a0has\u00a0been\u00a0filed\u00a0with\u00a0a\u00a0prayer\u00a0to\u00a0quash\u00a0the\u00a0order\u00a0<br \/>\ndated\u00a09.11.2009\u00a0passed\u00a0by\u00a0C.J.M.\u00a0Orai\u00a0in\u00a0complaint\u00a0case\u00a0No.\u00a0<br \/>\n2682\u00a0of\u00a02009\u00a0by\u00a0which\u00a0the\u00a0learned\u00a0Magistrate\u00a0has\u00a0taken\u00a0the\u00a0<br \/>\ncognizance\u00a0and\u00a0summoned\u00a0the\u00a0applicants\u00a0to\u00a0face\u00a0the\u00a0trial\u00a0for\u00a0<br \/>\nthe\u00a0offence\u00a0punishable\u00a0under\u00a0sections\u00a0427,\u00a0506,\u00a0279,\u00a0337\u00a0IPC\u00a0<br \/>\nand\u00a0section\u00a03(1)(X)\u00a0SC\/ST\u00a0(P.A.)\u00a0Act.\u00a0\n<\/p>\n<p>From\u00a0the\u00a0perusal\u00a0of\u00a0the\u00a0impugned\u00a0order\u00a0it\u00a0appears\u00a0that\u00a0learned\u00a0<br \/>\nMagistrate \u00a0 has \u00a0 taken \u00a0 the \u00a0 cognizance \u00a0 and \u00a0 summoned \u00a0 the\u00a0<br \/>\napplicant \u00a0 after \u00a0 considering \u00a0 the \u00a0 complaint \u00a0 and \u00a0 statements\u00a0<br \/>\nrecorded\u00a0under\u00a0sections\u00a0200\u00a0and\u00a0202\u00a0Cr.P.C.\u00a0which\u00a0discloses\u00a0<br \/>\nthe \u00a0 offence \u00a0 against \u00a0 the \u00a0 applicants. \u00a0 There \u00a0 is \u00a0 no \u00a0 illegality \u00a0 or\u00a0<br \/>\nirregularities\u00a0in\u00a0 the\u00a0impugned\u00a0order,\u00a0therefore,\u00a0the\u00a0 prayer\u00a0for\u00a0<br \/>\nquashing\u00a0the\u00a0impugned\u00a0order\u00a0is\u00a0refused.\u00a0\n<\/p>\n<p>However,\u00a0considering\u00a0the\u00a0facts\u00a0and\u00a0circumstances\u00a0of\u00a0the\u00a0case,\u00a0<br \/>\nit\u00a0is\u00a0directed\u00a0that\u00a0applicants\u00a0move\u00a0application\u00a0for\u00a0appearance\/\u00a0<br \/>\nsurrender\u00a0before\u00a0the\u00a0court\u00a0concerned\u00a0within\u00a030\u00a0days\u00a0from\u00a0today\u00a0<br \/>\non \u00a0 which \u00a0 the \u00a0 court \u00a0 concerned \u00a0 shall \u00a0 fix \u00a0 the \u00a0 date \u00a0 of\u00a0<br \/>\nsurrender\/appearance,\u00a0 in \u00a0 the \u00a0 meantime \u00a0 the \u00a0 court \u00a0 concerned\u00a0<br \/>\nshall\u00a0seek\u00a0the\u00a0instructions\u00a0from\u00a0the\u00a0prosecution\u00a0side.\u00a0In\u00a0case\u00a0<br \/>\nthe\u00a0applicant\u00a0moves\u00a0the\u00a0application\u00a0for\u00a0bail\u00a0on\u00a0the\u00a0day\u00a0of\u00a0the\u00a0<br \/>\nappearance\u00a0or\u00a0 surrender,\u00a0the\u00a0same\u00a0shall\u00a0be\u00a0considered\u00a0and\u00a0<br \/>\ndisposed\u00a0of\u00a0on\u00a0the\u00a0same\u00a0day\u00a0by\u00a0the\u00a0courts\u00a0below.<br \/>\nWith\u00a0this\u00a0direction,\u00a0this\u00a0application\u00a0is\u00a0finally\u00a0disposed\u00a0of.<br \/>\nOrder Date :- 27.1.2010<br \/>\nRPD\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Atrup And Others vs State Of U.P.
