Therefore the employer has filed the above<br \/>\nSpecial Civil Application No.4374 of 2000 challenging the said award<br \/>\nand the workman has filed Special Civil Application No.1292 of 2000<br \/>\nin so far as the compensation is inadequate.\n<\/p>\n<p>2.\tThis<br \/>\nCourt by earlier order dated 3rd May 2000 directed the<br \/>\npetitioner employer to deposit the sum of Rs.40000\/- as a<br \/>\nprecondition of grant of interim relief. Accordingly the<br \/>\npetitioner-employer had deposited the said amount in this Registry,<br \/>\nbut the respondent-workman could not withdraw the said amount as he<br \/>\nwas not able to furnish security.\n<\/p>\n<p>3.\tThe<br \/>\ncase of the respondent-workman is that he was working with the<br \/>\npetitioner-employer as Issue Man in General Stores of the factory.<br \/>\nDuring security check, a drum containing 25 kg. of Potassium Iodate<br \/>\nof the value of approximately Rs.8900\/- was found hidden in a wooden<br \/>\nbox in the cabin of the driver of the vehicle. On inquiry it was<br \/>\nlearnt that the respondent had masterminded the plan for arranging<br \/>\ntaking away the drum outside the factory premises with the help of<br \/>\ncontractor&#8217;s workmen. The respondent workman therefore came to be<br \/>\ndismissed. He therefore raised a dispute which was referred to the<br \/>\nLabour Court wherein the aforesaid award came to be passed.\n<\/p>\n<p>4.\tHeard<br \/>\nthe learned Advocates for the respective parties and perused the<br \/>\nrelevant documents on record. Admittedly no departmental inquiry was<br \/>\nheld against the petitioner. He was dismissed from service because of<br \/>\nloss of confidence. The respondent workman has put in a long service<br \/>\nwith the petitioner employer. Having considered all these factors and<br \/>\nespecially the long services rendered by the respondent I am of the<br \/>\nview that grant of an additional compensation in the sum of<br \/>\nRs.1,10,000\/- would meet the ends of justice. Mr. D.G. Chauhan is not<br \/>\nable controvert this proposition.\n<\/p>\n<p>5.\tIn<br \/>\nthe premises aforesaid, the petitioner-employer is directed to pay a<br \/>\nfurther sum of Rs.1,10,000\/- by way of compensation, in addition to<br \/>\nRs.40000\/- already awarded by the Labour Court. The payment shall be<br \/>\npaid to the respondent-workman within a period of six weeks from<br \/>\ntoday. The judgement and award of the Labour Court is modified<br \/>\naccordingly. Consequently Special Civil Application No.1292 of 2000<br \/>\nis partly allowed  and rule is made absolute accordingly with no<br \/>\norder as to costs. Special Civil Application No.4374 of 2000 is<br \/>\ndismissed and rule is discharged with no order as to costs.\n<\/p>\n<p>6.\tIt<br \/>\nis clarified that the compensation granted to the respondent-workmen<br \/>\nshall by by way of final settlement in respect of all the claims of<br \/>\nthe respondent-workman.
