      Appellants are the claimants in O.P.(MV) No.808 of<\/p>\n
2001 on the file of the Motor Accidents Claims Tribunal,<\/p>\n
Manjeri. They are parents, brothers and sisters of deceased<\/p>\n
Mohammed Koya who died in a motor accident. In this<\/p>\n
appeal they challenge the judgment and award of the<\/p>\n
Tribunal dated December 9, 2004 awarding a compensation<\/p>\n
of Rs.1,13,000\/- for the loss caused to them on account of<\/p>\n
death of Mohammed Koya in a motor accident.<\/p>\n
      2. The accident happened on August 9, 1999 at about<\/p>\n
12 O’ clock in the night. Deceased Mohammed Koya was<\/p>\n
driving his car bearing registration No.KL-8\/C-8889 from<\/p>\n
Kodakkad to Kottakkal. When the car reached at<\/p>\n
Pookiparambu, it collided head on with a mini lorry bearing<\/p>\n
registration No.KL-8\/E-1130, driven by the 1st respondent.<\/p>\n
Mohammed Koya sustained serious injuries and he<\/p>\n
succumbed to the injuries sustained on the way to hospital.<\/p>\n

Alleging negligence against the 1st respondent, the<\/p>\n
claimants    filed the O.P. before the Tribunal claiming a<\/p>\n
compensation of Rs.4,50,000\/- for the loss caused to them<\/p>\n
on account of the death of Mohammed Koya in the accident.<\/p>\n
      3. Respondents 1and 2, the driver and owner of the<\/p>\n
offending mini lorry, remained absent before the Tribunal.<\/p>\n
The 3rd respondent, insurer of the offending mini lorry, filed<\/p>\n
a written statement, admitting the policy. Respondents 4<\/p>\n
and 5 are the owner and insurer of the car.<\/p>\n
      4. This O.P. was jointly tried along with other Original<\/p>\n
Petitions filed by the legal heirs of other deceased persons<\/p>\n
in the accident and a common award was passed.<\/p>\n
      5. PW1 was examined and Exts. A1 to A6 were<\/p>\n
marked on the side of the claimants. No evidence was<\/p>\n
adduced by the respondents. The Tribunal, on an<\/p>\n
appreciation of the evidence, found that the accident<\/p>\n
occurred due to the negligence of the 1st respondent and<\/p>\n
awarded a compensation of Rs.1,13,000\/- with interest at<\/p>\n
the rate of 6% per annum from the date of petition till<\/p>\n

realization and cost of Rs.4,000\/-. The claimants have come<\/p>\n
up in appeal, challenging the quantum of compensation<\/p>\n
awarded by the Tribunal.\n<\/p>\n
       6. Heard the learned counsel for the claimants and<\/p>\n
the learned counsel for the Insurance Company.<\/p>\n
       7. The accident is not disputed. The finding of the<\/p>\n
Tribunal that the accident occurred due to the negligence of<\/p>\n
the 1st respondent, driver of the offending mini lorry, is not<\/p>\n
challenged in this appeal.    Therefore, the only question,<\/p>\n
which arises for consideration, is whether the claimants are<\/p>\n
entitled to any enhanced compensation ?<\/p>\n
       8. The Tribunal awarded a total compensation of<\/p>\n
Rs.1,13,000\/-. Break up of the compensation awarded is as<\/p>\n
under:-\n<\/p>\n
       Transport to hospital            :    Rs.     1,000\/-\n       Funeral expenses                 :    Rs.     2,000\/-\n       Loss of estate                   :    Rs.1,10,000\/-\n                                             ------------------\n          Total                         :    Rs.1,13,000\/-\n                                             ========\n\n<\/pre>\n
       9. The learned counsel for the appellants submits that<\/p>\n

no compensation was awarded for the loss of dependency,<\/p>\n
loss of love and affection and for pain and suffering endured<\/p>\n
by the deceased.\n<\/p>\n
      10. The Tribunal took the annual income of the<\/p>\n
deceased as Rs.15,000\/- and after deducting 1\/3rd for his<\/p>\n
personal expenses, balance amount of Rs.10,000\/- was<\/p>\n
taken as his annual contribution to his family, adopted a<\/p>\n
multiplier of 11 and awarded Rs.1,10,000\/- for the loss of<\/p>\n
loss of estate. It was actually compensation awarded for the<\/p>\n
loss of dependency. The deceased was working as a driver<\/p>\n
and earning Rs.3,000\/- per month, according to PW1.<\/p>\n
Taking into consideration the above aspect, we feel that<\/p>\n
monthly income of the claimant can reasonably be fixed at<\/p>\n
Rs.3,000\/-, after deducting 1\/3rd for his personal expenses,<\/p>\n
balance amount of Rs.2,000\/- can be taken as his monthly<\/p>\n
contribution to his family, which comes to Rs.24,000\/- per<\/p>\n
annum. Multiplier of 11 adopted by the Tribunal is not<\/p>\n
seriously challenged. Thus, the claimants are entitled to an<\/p>\n
additional compensation of Rs.2,64,000\/- for loss of<\/p>\n

dependency. Thus on this count the claimants are entitled<\/p>\n
to a compensation of Rs.1,54,000\/-.\n<\/p>\n
      11. No compensation was seen awarded by the<\/p>\n
Tribunal towards loss of love and affection. Taking into<\/p>\n
consideration the age of the deceased and the age of the<\/p>\n
claimants, we feel that a compensation of Rs.50,000\/- would<\/p>\n
be reasonable for the loss of love and affection.<\/p>\n
      12. No compensation was seen awarded for pain and<\/p>\n
suffering   endured    by   the    deceased.   Taking  into<\/p>\n
consideration the nature of the injuries sustained by the<\/p>\n
deceased, we feel that a compensation of Rs.10,000\/- would<\/p>\n
be reasonable on this count.\n<\/p>\n
      13. The Tribunal awarded Rs.1,10,000\/- for loss of<\/p>\n
estate, but it was actually compensation awarded for the<\/p>\n
loss of dependency. Therefore, we feel that separate<\/p>\n
compensation of Rs.10,000\/- would be reasonable for the<\/p>\n
loss of estate. As regards the compensation awarded under<\/p>\n
other heads, we find the same to be reasonable and<\/p>\n
therefore,we are not disturbing the same.<\/p>\n

      14. In the result, the claimants are found entitled to<\/p>\n
additional compensation of Rs.2,24,000\/-.The Tribunal<\/p>\n
awarded interest only @ 6% per annum, which appears to<\/p>\n
be very low. The claimants are entitled to interest @7.5%<\/p>\n
per annum from the date of petition till realization and<\/p>\n
proportionate costs. The 3rd respondent\/Insurance Company<\/p>\n
shall deposit the amount within two months from the date of<\/p>\n
receipt of a copy of this judgment with notice to the<\/p>\n
claimants. The award of the Tribunal is modified to the<\/p>\n
above extent.\n<\/p>\n
      The appeal is disposed of as found above.<\/p>\n
