PUBLIC PROSECUTOR for\nRespondent(s) : 1, \nNone for Respondent(s) :\n2, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tIt<br \/>\nis submitted by Mr.Barot, learned Advocate that complaint is lodged<br \/>\nwith Anand Police Station against present applicants along with other<br \/>\naccused for the offence punishable under section 406, 120 and 114 of<br \/>\nthe Indian Penal Code and subsequently thereafter investigation is<br \/>\nover and charge sheet is filed and Criminal Case No.7942 of 1999 is<br \/>\npending before the learned Chief Judicial Magistrate, Anand.\n<\/p>\n<p>2.\t\tIt<br \/>\nis submitted by Mr.Barot, learned Advocate that present applicants<br \/>\nare bona fide purchaser and they have not played any role in<br \/>\ncommitting crime. As per the complaint, accused nos.2 and 3 were<br \/>\nguarantors of accused no.1 and there was charge of Kalupur Commercial<br \/>\nBank, Anand on the disputed property. It is submitted by Mr.Barot<br \/>\nthat applicants were not aware above this transaction.\n<\/p>\n<p>3.\t\tThe<br \/>\ncriminal case is very old. In view of above, learned Chief Judicial<br \/>\nMagistrate, Anand is hereby directed to decide Criminal Case No.7942<br \/>\nof 1999 as early as possible preferably within a period of 3(three)<br \/>\nmonths from the date of receipt of present order.\n<\/p>\n<p>4.\t\tWith<br \/>\nabove observations, present application is disposed.
