PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 04\/08\/2011\n \n\nORAL\nORDER<\/pre>\n<p>\tBy<br \/>\n\tway of present application, filed under Section 439 of the Code of<br \/>\n\tCriminal Procedure, 1973, the applicant has prayed to release him on<br \/>\n\tregular bail in connection with CR No.I-0068 of 2009 registered with<br \/>\n\tModasa Town Police Station.\n<\/p>\n<p>Heard<br \/>\n\tMr.Ashish M. Dagli, learned counsel for the applicant and Mr.H.L.<br \/>\n\tJani, learned Additional Public Prosecutor appearing<br \/>\n\tfor the respondent-State.\n<\/p>\n<p>It<br \/>\n\tis contended by Mr.Dagli that the co-accused has already been<br \/>\n\treleased on bail by this Court and looking to the similar role<br \/>\n\tplayed by the present applicant, the applicant may be released on<br \/>\n\tbail. He has also contended that it is true that the applicant is<br \/>\n\toutsider, but that cannot be the ground to refuse the bail. He has<br \/>\n\tfurther contended that the applicant is ready to abide by any<br \/>\n\tstringent condition imposed by this Court.<br \/>\n\tHe has also contended that the applicant is earning member of his<br \/>\n\tfamily. Mr.Dagli has also contended that originally the applicant<br \/>\n\twas convicted for three years and thereafter, the learned JMFC,<br \/>\n\tModasa, for the reason best known to him, forwarded the case of the<br \/>\n\tapplicant to the learned Additional Chief Judicial Magistrate under<br \/>\n\tSection 325 of the Code of Criminal Procedure, 1973 and the learned<br \/>\n\tAdditional Chief Judicial Magistrate has convicted the applicant for<br \/>\n\tfive years. It is also contended by Mr.Dagli that the applicant is<br \/>\n\tin jail since last about two years. He, therefore, contended that<br \/>\n\tlooking to the overall aspect of the matter, the applicant may be<br \/>\n\treleased on bail.\n<\/p>\n<p>As<br \/>\n\tagainst this, Mr.Jani, learned Additional Public Prosecutor has<br \/>\n\tvehemently opposed the present application and contended that<br \/>\n\tapplicant is involved in a serious case. He has contended that the<br \/>\n\tapplicant is a practicing advocate. The applicant has by fraud<br \/>\n\tstolen as many as 13 vehicles and by forging the documents with the<br \/>\n\thelp of other accused persons, got transferred the said vehicles<br \/>\n\teither in his name or in the name of his relatives. He has also<br \/>\n\tcontended that the cost of the stolen vehicles comes to around<br \/>\n\tRs.1,27,00,000\/-. Mr.Jani has also contended that this is a case of<br \/>\n\tforgery and criminal conspiracy. He has also contended that there<br \/>\n\tare chances that applicant may jump the bail and he will not be<br \/>\n\tavailable during the trial. He has also contended that the role of<br \/>\n\tthe co-accused, who is released on bail by this Court, and present<br \/>\n\tapplicant is not similar. Therefore, parity ground<br \/>\n\tcannot be considered to release the applicant on bail. Mr.Jani has<br \/>\n\talso contended that this is a successive bail application. He,<br \/>\n\ttherefore, contended that looking to the role played by the<br \/>\n\tapplicant and looking to the seriousness of the case, present<br \/>\n\tapplicant is required to be rejected.\n<\/p>\n<p>Heard learned<br \/>\n\tcounsel for the respective parties and also perused the papers<br \/>\n\tproduced before me. It appears from the papers that the role of the<br \/>\n\tpresent applicant and the co-accused, who has been released on bail<br \/>\n\tby this Court, is not similar. The applicant has committed serious<br \/>\n\toffence of theft. The applicant is involved in theft of 13 vehicles<br \/>\n\tand by forging the documents and by changing the engine number and<br \/>\n\tchasis number, transferred the vehicle in his name or in the name of<br \/>\n\this relatives. The amount involved in the case is about<br \/>\n\tRs.1,27,00,000\/-. The applicant is in the noble profession of<br \/>\n\tadvocacy and is misusing his profession. Looking to the gravity of<br \/>\n\toffence and role of the applicant, I am of the opinion that learned<br \/>\n\tJudge has not committed any error in rejecting the bail application<br \/>\n\tof the applicant. I have not found any substance in the present<br \/>\n\tapplication. The application deserves to be dismissed and is hereby<br \/>\n\tdismissed. Rule is discharged.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
