A notification under s.4(1) of the Land Acquisition\tAct,<br \/>\n1894,  (for  short, &#8216;the Act&#8217;) was published  in  the  State<br \/>\ngazette on September 6, 1974 acquiring 22 acres 63  decimals<br \/>\nof  the land situated in Village Rasoolpur of Devdas  Distt.<br \/>\nof  M.P.  for  industrial  purpose.   The  Land\t Acquisition<br \/>\nOfficer\t in his award dated June 1975 determined the  market<br \/>\nvalue at Rs. 1,500\/per acre and given the compensation\twith<br \/>\nstatutory  benefits.  On reference, the Civil Court  by\t its<br \/>\naward  and  decree  dated  October  22,\t 1980  enhanced\t the<br \/>\ncompensation to Rs.4,900\/- per acre which worked out to\t Rs.<br \/>\n1,08,000\/- in all.  At this stage it is relevant to  mention<br \/>\nthat  the respondent herself purchased the  entire  acquired<br \/>\nland  under  registered sale deed dated September  4,  1974,<br \/>\njust  two  days\t earlier  to  the  date\t of  publication  of<br \/>\npreliminary  notification for a total sum of  Rs.1,08,000\/-.<br \/>\nThe  respondent not being satisfied, carried the  matter  in<br \/>\nappeal\tto the High Court under s.54 of the Act.   The\tHigh<br \/>\nCourt, by its impugned judgment in Transfer Appeal No.323\/82<br \/>\ndated  November\t 1, 1983, enhanced the compensation  to\t Rs.<br \/>\n10,000\/per  acre.  In other words, the High Court awarded  a<br \/>\ntotal compensation of Rs.2,27,000\/- with statutory  benefits<br \/>\nthereon.   Feeling aggrieved against  enhanced\tcompensation<br \/>\nawarded by the High Court, this appeal by special leave\t has<br \/>\nbeen filed.\n<\/p>\n<p>2. The High Court in our considered view, committed palpable<br \/>\nand  manifest error of law in ignoring the sale deed of\t the<br \/>\nrespondent  herself dated September 4, 1974 wherein she\t had<br \/>\npaid total consideration of a sum of Rs. 1,08,000\/- for\t the<br \/>\nacquired  land.\t It is contended by learned  senior  counsel<br \/>\nfor  the respondent that this is an industrial area and\t the<br \/>\nvery  purpose for which acquisition is sought to be made  is<br \/>\nfor  industrial purpose.  The respondent  herself  purchased<br \/>\nthe  property  for industrial purpose.\tThe High  Court\t had<br \/>\nrightly\t  taken\t  into\tconsideration\tthose\t-facts\t and<br \/>\ncircumstances  and  enhanced the compensation.\tWe  find  no<br \/>\nforce  in  the contention- When the respondent\therself\t had<br \/>\npurchased  the property for the purpose of  establishing  an<br \/>\nindustry  and got the sale deed registered on  September  4,<br \/>\n1974, it would furnish ipso facto the sole basis for  deter-<br \/>\nmination  of  market value of the self same land.   For\t the<br \/>\nproperty  purchased  by\t paying a consideration\t of  of\t Rs.<br \/>\n1,08,000\/-, no reasonable and prudent buyer, within two days<br \/>\nthereafter,  would  purchase  the land by paying  a  sum  of<br \/>\nRs.2,27,000\/- as determined by the High Court.\tIt is  quite<br \/>\nunreasonable  and credulous to believe that a prudent  buyer<br \/>\nin normal market conditions would agree to pay Rs.1,19,000\/-<br \/>\nmore  within  two  days for the self same  land.   The\tHigh<br \/>\nCourt,\t  therefore,   totally\t ignored   these    relevant<br \/>\nconsiderations while enhancing the compensation without\t ap-<br \/>\nPlication of mind on the basis of sale transactions of small<br \/>\nbits of other lands.  <a href=\"\/doc\/838779\/\">In V. Salgoacar &amp; Pvt.  Ltd. v.  Union<br \/>\nof India (C.A. No.3800\/89)<\/a> dated January 11, 1995 on similar<br \/>\nfacts,\tthis  Court affirmed the judgment of High  Court  of<br \/>\nBombay\treversing  the\taward of  the  reference  court\t and<br \/>\nawarded\t at the rate purchased by the claimants\t itself\t The<br \/>\njudgment  and  decree of the High Court is,  therefore,\t set<br \/>\naside<br \/>\n<span class=\"hidden_text\">539<\/span><br \/>\nand  that  of  the  Dist.   Judge  is  affirmed.  appeal  is<br \/>\naccordingly allowed with costs.\n<\/p>\n<p>3.
