Government Pleader\n\t\t\t\t\n:ORDER\n<\/pre>\n<p>\tThis writ has been filed to direct the respondents to consider the<br \/>\npetitioner&#8217;s representation dated 10.11.2008 and to pass orders in accordance<br \/>\nwith G.O.Ms.No.34 dated 23.01.2008.\n<\/p>\n<p>\t2. Heard Mr.V.Manoharan, learned counsel for the petitioner and also<br \/>\nMr.R.Janakiramulu, learned Special Government Pleader, who took notice on behalf<br \/>\nof the  respondents.\n<\/p>\n<p>\t3. The grievance of the petitioner as stood exposited from the affidavit<br \/>\naccompanying the writ petition as well as the representation made by the learned<br \/>\ncounsel for the petitioner, is to the effect  that the petitioner is in receipt<br \/>\nof the notice of eviction dated 20.11.2008 and it was actually served to the<br \/>\npetitioner on 22.11.2008, without any show cause notice and adhering to the<br \/>\nProvisions of law, the authorities are trying to take possession of it high<br \/>\nhandedly; it is also the fact that the petitioner is in occupation of the<br \/>\nproperty for over forty years and thereby entitled to get the benefit under the<br \/>\nG.O.Ms.854 Revenue dated 30.12.2006; the petitioner also made earlier<br \/>\nrepresentation for confirmant of patta in response to the publication of the<br \/>\nDistrict Collector, Sivagangai dated 29.10.2008 in the newspaper.  Hence, the<br \/>\nlearned counsel for the petitioner prays for a direction to the Tahsildar to<br \/>\nconsider his representation.\n<\/p>\n<p>\t4. Heard the learned Special Government Pleader.\n<\/p>\n<p>\t5. Hence, in this factual matrix, I would like to observe as under:<br \/>\n\tThe bare perusal of the impugned notice would show that the very notice<br \/>\nitself has been issued only in pursuance of the order dated 01.08.2008 in<br \/>\nW.P.Nos.6234 and 6230 of 2008.  But there is no reference in that notice about<br \/>\nany previous show cause notice having been issued before passing that final<br \/>\norder.\n<\/p>\n<p>\t6. Be that as it may, the learned counsel for the petitioner would submit<br \/>\nthat the petitioner is entitled to get the benefit under G.O.Ms.854 Revenue<br \/>\ndated 30.12.2006 and that there is a representation dated 10.11.2008 is also<br \/>\npending with the second respondent viz., the Tahsildar, Ilayangudi Taluk,<br \/>\nSivagangai District.\n<\/p>\n<p>\t7. Hence, in such a case, I would like to issue the following direction:<br \/>\n\tThe second respondent viz., the Tahsildar, Ilayangudi Taluk, Sivagangai<br \/>\nDistrict shall consider the representation of the petitioner dated 10.11.2008<br \/>\nafter giving due opportunity of being heard to the petitioner immediately and<br \/>\nthe petitioner is also expected to furnish a fresh copy of the representation<br \/>\nenclosing along with the copy of this order to the second respondent and<br \/>\nthereupon the second respondent shall look into the matter and pass orders.\n<\/p>\n<p>\t8. With the above direction, this writ petition is disposed of.
