Sinha \n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p> (With Civil Appeal No.1764\/2002)<\/p>\n<p>SANTOSH HEGDE, J.\n<\/p>\n<p>\tThese appeals are preferred against the order of the<br \/>\nDivision Bench of the Rajasthan High Court, Jaipur Bench<br \/>\ndated 10th of August, 2001 whereby the said Bench allowed<br \/>\nthe special appeal filed before it setting aside the judgment of<br \/>\nthe learned Single Judge of the said High Court which had<br \/>\nconfirmed the award made by the Industrial Tribunal, Jaipur.<br \/>\n\tBrief facts necessary for the disposal of these appeals<br \/>\nare as follows;-\n<\/p>\n<p>The respondent herein was appointed as a Conductor on<br \/>\ndaily wages in the appellant-Corporation on 20th of June,<br \/>\n1986.  His services were terminated on 1st of December, 1986<br \/>\non the ground that the same was not required by the appellant-<br \/>\nCorporation.\n<\/p>\n<p>Challenging the said termination, the respondent moved<br \/>\nan application under Section 33(2-A) of the Industrial<br \/>\nDisputes Act, 1947 before the Industrial Tribunal, Jaipur<br \/>\nalleging that his termination was contrary to Section 25F  of<br \/>\nthe Industrial Disputes Act, as he has already completed more<br \/>\nthan 240 days of continuous service in a year in the appellant-<br \/>\nCorporation, therefore, without following the provisions of<br \/>\nSection 25 F of the I.D. Act his services could not have been<br \/>\nterminated. He also alleged in the said application that his<br \/>\ntermination was a colourable exercise of power because<br \/>\nduring his service in the Corporation an inspection was carried<br \/>\nout by the checking staff on 20th of November, 1986 when he<br \/>\nwas on duty in Bus No. 7108. During the course of<br \/>\ninvestigation, a false case of non-issuance of ticket to six<br \/>\npassengers was made against him and since the Management<br \/>\nwas not in a position to prove the said charge it took recourse<br \/>\nto his discharge from service without holding a proper enquiry<br \/>\nwhich amounts to a colourable exercise of power.<br \/>\n\tThe appellant-Corporation opposed the said application<br \/>\nstating that his appointment  was purely temporary on daily<br \/>\nwages basis and since his services were not required, the same<br \/>\nwas terminated which was permissible as per the terms of the<br \/>\nletter of appointment. It is also stated that the respondent had<br \/>\nnot completed 240 days of continuous service in any year in<br \/>\nthe Corporation and therefore there was no need to comply<br \/>\nwith Section 25 F of I.D. Act. However, it was admitted that<br \/>\nwhen the respondent was working as a Conductor and there<br \/>\nwas an inspection on 29.11.1986 wherein it was found that he<br \/>\nhad not issued tickets to six passengers but that was not the<br \/>\nground on which the termination was based.<br \/>\n\tIn view of the allegation of the respondent-workman<br \/>\nthat his termination was for the above said alleged<br \/>\nmisconduct, the appellant-Corporation sought permission from<br \/>\nthe Industrial Tribunal to lead evidence to justify the charge of<br \/>\nmisconduct which permission was granted and parties were<br \/>\npermitted to adduce evidence before the tribunal. Based on the<br \/>\nevidence that came on record the tribunal came to the<br \/>\nconclusion that the Corporation has proved the misconduct as<br \/>\nwell as the unruly behaviour of the Conductor during the<br \/>\ninspection, therefore, it came to the conclusion that even on<br \/>\nthe ground of misconduct termination of the respondent was<br \/>\njustified, hence, rejected the application of the respondent.<br \/>\n\tBeing aggrieved with the said award of dismissal of his<br \/>\ncomplaint, the respondent filed a writ petition before a Single<br \/>\nJudge of the Rajasthan High Court, Jaipur Bench. The learned<br \/>\nSingle Judge who heard the petition came to the conclusion<br \/>\nthat the finding of fact recorded against the petitioner<br \/>\nregarding his misconduct does not suffer from any perversity<br \/>\nso as to give a cause of action for the High Court to interfere<br \/>\nin it, hence, it dismissed the writ petition.<br \/>\nAgainst the said judgment of the learned Single Judge,<br \/>\nthe respondent preferred a special appeal before the Division<br \/>\nBench of the High Court. When the matter came up for<br \/>\nconsideration by the Division Bench, the court on 18.7.2001<br \/>\nmade the following order :\n<\/p>\n<p>&#8220;The learned counsel for the petitioner-\n<\/p>\n<p>appellant  makes a statement that the writ<br \/>\npetitioner is prepared to forego the entire<br \/>\nsalary for the period and he would be<br \/>\nsatisfied, if at least, reinstatement is<br \/>\nordered.\n<\/p>\n<p>We direct the counsel for the<br \/>\nrespondent  No. 2 to ascertain  from<br \/>\nhis department, whether the petitioner-\n<\/p>\n<p>appellant can be taken now as a fresh<br \/>\nemployee&#8221;.\n<\/p>\n<p>\tThe matter again came up for further orders on<br \/>\n10.8.2001 when the Division Bench passed the following<br \/>\norder which is now impugned in this appeal:<br \/>\n&#8220;The learned counsel for the appellant<br \/>\nnow states that he is willing to forego  the<br \/>\nsalary from 1986 till the date of his<br \/>\nreinstatement, with continuity  of service<br \/>\nand other attendant benefits attached to<br \/>\nthe said post. Since, the appellant has<br \/>\nnow opted for the above benefit, we<br \/>\naccept his prayer and direct the<br \/>\nrespondent No. 2 accordingly.  The<br \/>\nrespondent No. 2 is directed to reinstate<br \/>\nthe appellant in service in the above<br \/>\nterms within four weeks from today&#8221;.\n<\/p>\n<p>A perusal of these two orders of the Appellate Bench of<br \/>\nthe High Court shows that it did not apply its mind to the facts<br \/>\nand law involved in the case but proceeded to consider the<br \/>\noffer made by the appellant in his prayer, i.e., in the event of<br \/>\nhis  being re-instated in service he would forego the entire<br \/>\nback wages. The order of 10th of August, 2002 shows that the<br \/>\nappellant-Corporation had not agreed to such a proposal made<br \/>\nby the respondent and the said order which is now impugned<br \/>\nin this appeal was made without the consent of the appellant.\n<\/p>\n<p>We notice from the finding of the Industrial Tribunal<br \/>\nthat the respondent-workman had indulged in misconduct<br \/>\nwhich has not only led to monetary loss to the Corporation but<br \/>\nthe Corporation has also lost confidence in the said workman.<br \/>\nTherefore,  to continue such an employee in the employment<br \/>\nof the Corporation by virtue of a judicial order, in our opinion,<br \/>\nis an act of misplaced sympathy which can find no foundation<br \/>\nin law or in equity. The finding  that  the workman has<br \/>\ncommitted the misconduct in question of not issuing tickets to<br \/>\npassengers is a finding of fact arrived at by the Tribunal after<br \/>\ntaking into consideration the evidence recorded therein. This<br \/>\nfinding was affirmed by the learned Single Judge and the High<br \/>\nCourt has not set aside the finding. Therefore, the question of<br \/>\nmoulding the relief on the facts of this case did not arise at all.<br \/>\nThe offer of the respondent to forego the back wages in lieu of<br \/>\nhis being re-instated is not an offer to be taken into<br \/>\nconsideration by the court unless and until the finding of the<br \/>\ntribunal on misconduct was set aside and having perused the<br \/>\nrecords including the order of the tribunal, we are satisfied that<br \/>\nthis is not one of those cases in which there was room for<br \/>\nsetting aside such a finding.\n<\/p>\n<p>Assuming for argument sake that the High Court by the<br \/>\nimpugned order proceeded on the basis that though the<br \/>\nmisconduct is proved the punishment was disproportionate<br \/>\nand it is on that basis that the impugned order is made, even<br \/>\nthen we are unable to agree with the order of the Appellate<br \/>\nBench of the High Court because it is not the normal<br \/>\njurisdiction of the superior courts to interfere with the<br \/>\nquantum of sentence unless the said sentence is wholly<br \/>\ndisproportionate to the misconduct proved. No such finding<br \/>\nhas been recorded by the Appellate Bench in the impugned<br \/>\norder.  Since the misconduct proved is one of dishonesty, the<br \/>\nquantum  of loss is immaterial, it is the loss of confidence that<br \/>\nmatters. In such a situation  if the Tribunal chooses to uphold<br \/>\nthe  order of dismissal  and refuse  to interfere  with such<br \/>\ntermination  and the learned single Judge of the High Court<br \/>\nagreed  with the said order of the Tribunal, then Appellate<br \/>\nBench  ought not to have interfered with the quantum  of<br \/>\nsentence.  Having  perused the facts of the case we are in<br \/>\nagreement  with the finding  of the Tribunal as well as  learned<br \/>\nsingle Judge, hence,  we are of the considered opinion that the<br \/>\nAppellate Bench fell in error  in interfering  with the orders of<br \/>\nthe courts below merely on the basis of offer made by the<br \/>\nappellant before it.\n<\/p>\n<p>For the reasons stated above, these appeals succeed.
