DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/04\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Learned<br \/>\n\tcounsel appearing for the Applicant submits that the Applicant is in<br \/>\n\tjail since last 15 months and considering the nature of offence and<br \/>\n\tpunishment prescribed for the alleged offence and the case is<br \/>\n\ttriable by the Magistrate, by imposing suitable conditions, the<br \/>\n\tApplicant be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP for the Respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and taking into consideration<br \/>\n\tthe facts of the case, nature of allegations, role attributed to the<br \/>\n\tApplicant accused and punishment prescribed for the alleged offence<br \/>\n\tcoupled with the fact that the charge sheet is filed and the<br \/>\n\tinvestigation is over and also other attending circumstances,<br \/>\n\twithout discussing the evidence in detail, at this stage, I am<br \/>\n\tinclined to enlarge the Applicant on bail in connection with II-CR<br \/>\n\tNo.3067 of 2009 registered with D.C.B. Crime, Ahmedabad Police<br \/>\n\tStation for the offences punishable under Section 25(1)(A) (B) of<br \/>\n\tthe Arms Act, on furnishing bond of Rs.10,000\/- (Rupees Ten thousand<br \/>\n\tonly) with one surety of the like amount to the satisfaction of the<br \/>\n\tlower Court on conditions that the Applicant shall:\n<\/p>\n<p>(a)\tnot<br \/>\n\ttake undue advantage of liberty or abuse liberty,<\/p>\n<p>(b)\tnot<br \/>\n\tact in a manner injurious to the interest of the prosecution,<\/p>\n<p>(c)\tmaintain<br \/>\n\tlaw and order,<\/p>\n<p>(d)\tmark<br \/>\n\tpresence before the concerned Police Station on every 1st<br \/>\n\tand 15th day of English Calendar month between 11:00 am<br \/>\n\tand 2 pm.<\/p>\n<p>(e)\tnot<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned,<\/p>\n<p>(f)\tnot<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned,<\/p>\n<p>(g)\tnot<br \/>\n\tenter the City and District limit of Ahmedabad for a period of six<br \/>\n\tmonths except for marking presence before the concerned police<br \/>\n\tstation and \/ or attending the trial,<\/p>\n<p>(h)\tfurnish<br \/>\n\tthe address of residence at the time of execution of the bond and<br \/>\n\tshall not change the residence without prior permission of this<br \/>\n\tCourt,<\/p>\n<p>(i)\tsurrender<br \/>\n\tpassport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
