Justice ANTONY DOMINIC\n\n Dated :05\/09\/2007\n\n O R D E R\n                   ANTONY DOMINIC, J.\n\n            = = = = = = = = = = = = = = = =\n              W.P.(C) No. 26471 OF 2007 B\n            = = = = = = = = = = = = = = = =\n\n           Dated this the 5th September, 2007\n\n                    J U D G M E N T\n<\/pre>\n<p>    The prayer in this writ petition is to quash the<\/p>\n<p>proceedings  initiated against the petitioners pursuant<\/p>\n<p>to Ext. P1 award of the 1st respondent and Ext. P2, the<\/p>\n<p>application filed for execution of the said award.   It<\/p>\n<p>is stated that warrant of arrest has been issued<\/p>\n<p>against the petitioners.  While they have not filed any<\/p>\n<p>appeal against Ext. P1 and have allowed the award to<\/p>\n<p>become final, the contention now raised is that there<\/p>\n<p>are other partners in the firm and that they alone are<\/p>\n<p>liable to satisfy the award amount.     In view of the<\/p>\n<p>terms of the award and the admitted fact that the<\/p>\n<p>petitioners are also partners, the said contention of<\/p>\n<p>the petitioners cannot be accepted.     Therefore, I do<\/p>\n<p>not find any irregularity in the action taken by the 1st<\/p>\n<p>respondent to execute the award.\n<\/p>\n<p>    2. Be that as it may, in my view the petitioners<\/p>\n<p>should be given a chance to avoid arrest and detention.<\/p>\n<p>Accordingly, I direct that the warrant of arrest issued<\/p>\n<p><span class=\"hidden_text\">WPC No. 26471\/07             -2-<\/span><\/p>\n<p>against the petitioner shall not be enforced as against<\/p>\n<p>the petitioners on the petitioners remitting 50% of the<\/p>\n<p>amount due under Ext. P1 within three weeks from today.<\/p>\n<p>The balance amount shall be payable in two equal<\/p>\n<p>monthly instalments thereafter.       The fifty percent,<\/p>\n<p>ordered above, shall be paid by the petitioners on or<\/p>\n<p>before 26-9-2007 and the remaining two instalments<\/p>\n<p>shall be paid on or before 26-10-2007 and 26-11-2007.<\/p>\n<p>    3. If default is committed in paying any one of<\/p>\n<p>the instalments     further action pursuant to the warrant<\/p>\n<p>of arrest can be continued.
