Gandhi, learned advocate for the GIDC, would contend that, so<br \/>\nfar as Plot Nos. 6101\/1, 6101\/2, and 6101\/A are concerned, the GIDC<br \/>\nhas clear title over the land in view of the licence agreement<br \/>\nentered into between the GIDC and the Company.\n<\/p>\n<p>\tShri<br \/>\nHiren Modi, the learned advocate for the Official Liquidator would<br \/>\ncontend that, by order dated 9.8.2002 passed by the learned Company<br \/>\nJudge, provisional liquidator was appointed and the company was<br \/>\nordered to be wound up on 25.10.2004 and, thereafter, in view of the<br \/>\nsubsequent orders passed and pursuant to the advertisement published<br \/>\nin the newspapers to sell the subject property in question, the sale<br \/>\nis to be undertaken by this Court.\n<\/p>\n<p>\tThe<br \/>\nissue about the claim of the GIDC needs to be addressed first before<br \/>\nproceeding ahead with the auction as ordered.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>B.T. Rao, learned advocate for offerer-Venus Infrastructure seeks<br \/>\npermission to withdraw the EMD in view of the time taken during the<br \/>\nproceedings. Permission as prayed for  is granted. It would be open<br \/>\nto Venus Infrastructure  to withdraw the amount of EMD, which may be<br \/>\nreturned by the Official Liquidator within two weeks of request in<br \/>\nwriting.\n<\/p>\n<p>\tIt<br \/>\nis made clear that, so far as other offerers are concerned, if they<br \/>\ndesire to continue with the procedure of auction to be held after<br \/>\nSummer Vacation, they may continue with the EMD or in the alternative<br \/>\nthey may also withdraw the EMD.\n<\/p>\n<p>\tS.O.\n<\/p>\n<p>To 22.6.2011.\n<\/p>\n<p>(ANANT<br \/>\nS.
