PATTANAIK (J)\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This special  leave petition  arises from\tthe judgment<br \/>\nand order  of the High Court of Rajasthan, Jaipur Bench made<br \/>\non February  29, 1996  in C.A.\tNo . 864\/94. Admittedly, the<br \/>\npetitioner is  lessee  winnover\t in  respect  of  the  miner<br \/>\nmineral viz. Sand Stone at Banthali, District Tonk. Since he<br \/>\nhad not\t submitted  proper  returns  as\t per  the  Rajasthan<br \/>\nMineral Concession  Rules, 1986 (for short, the &#8216;Rules), the<br \/>\nAssessing Authority made best judgment assessment under Rule<br \/>\n38(3) of  the Rules.  When it was challenged, the High Court<br \/>\nupheld the  same. It  has been found that the assessment and<br \/>\ndetermination of  the royalty due from an asessee during the<br \/>\nassessment made\t by the Assessing Authority after the return<br \/>\nin respect  of that  year was  filed by\t the  petitioner  as<br \/>\nrequired under\tterms  and  conditions\tof  the\t lease.\t The<br \/>\npetitioner was asked to produce the evidence; on his failure<br \/>\nto do  so, a  random check  was conducted  by the  Assessing<br \/>\nAuthority on  December 24, 1985 and it was found that one of<br \/>\nthe trucks  going to  Kota contained approximately 12 metric<br \/>\ntonnes of  minerals. On the basis of the said weighment\t and<br \/>\nin the absence of any slips of the actual weighment  carried<br \/>\nin the\tvehicle,  the  Assessing  Authority  came  to\t the<br \/>\nconclusion and made the assessment in terms of the  circular<br \/>\nissued by the Government on October 17,1987.\n<\/p>\n<p>     Sri Mahabir  Singh, learned  counsel appearing  for the<br \/>\npetitioner, contended  that the\t circular cannot run counter<br \/>\nto Rules.  In the  Rules, assessment  has to  be made as per<br \/>\nRule  38  readwith  Rule  18(1)(b)  and\t   Schedule  I.\t The<br \/>\nassessment of  more than  100% cannot  be  assessed  by\t the<br \/>\nauthority. We find no force in the contention.\n<\/p>\n<p>     It is  true that  the Schedule regulates the payment at<br \/>\nthe rates  of the  royalty required to be paid. The circular<br \/>\nindicates  only\t  uniform  policy   in\tthe   best  judsment<br \/>\nassessment. It\tis provided in clause 2(a) that the minerals<br \/>\nfrom the  mines carried\t for local  use and the roads or the<br \/>\nsignificant ways are not bitumens, the minimum weight should<br \/>\nbe assessed at 150% of similar vehicles carrying the maximum<br \/>\nsafe weight.  Normally, the  assessing\tofficials  can\tmake<br \/>\nassessment on the base of the circular for more weight under<br \/>\nthe power  vested in them. As it would indicate, it does not<br \/>\nprescribe rate of payment of the royalty, but prescribes the<br \/>\nmode of\t assessment of\tthe total  quantum of  the  minerals<br \/>\ncarried by  the licensee under the Rules; but they failed to<br \/>\nproduce slips  of the actual weighment from the mouth of the<br \/>\nmines. On  his failure\tto do  so, an  opportunity has\tbeen<br \/>\ngiven; the  weighment check was made at random. On the basis<br \/>\nthereof, he  assessed 150% as indicated in the circular. The<br \/>\nmethod can  be adopted\tonly when  the\tperson\thas  avoided<br \/>\npayment of  the royalty\t and avoidance\tof correct  and true<br \/>\nweighment of  the minerals  winover and\t carried away by the<br \/>\nlicensee. Under\t these circumstances,  we do  not think that<br \/>\nthe circular runs counter to the statutory rules. It is true<br \/>\nthat the  penalty by  way of punishment has been provided in<br \/>\nthe Rules  for contravention.  The assessment  is  different<br \/>\nfrom  the  prosecution\tfor  contravention.  In\t making\t the<br \/>\nassessment, in\tparticular when\t best judgment assessment is<br \/>\nsought to  be made,  uniform instructions have been given in<br \/>\nthe above  Circular by\tthe  Government\t to  make  the\tbest<br \/>\njudgment assessment  so that thare may not be any difference<br \/>\nin the\tprocedure  to  be  adopted  by\tdifferent  assessing<br \/>\nauthoritias and\t uniform basis provided is always just, fair<br \/>\nand reasonable\tso that the Assessing Authority\t will have a<br \/>\nuniform and satisfied principle or procedure in that behalf.\n<\/p>\n<p>     Accordingly, we do not find any illegality in the order<br \/>\npassed by the High Court warranting interference.\n<\/p>\n<p>     The special leave petition is accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Guman Singh vs State Of Rajasthan &amp; Ors on 6 September, 1996 Author: K Ramaswamy Bench: Sikri, S.M.
