M. SAHAI)<\/p>\n<p>We<\/a><br \/>\n\thave heard Mr. Mihir Joshi, learned Senior counsel assisted by Mr.<br \/>\n\tDipen A. Desai for the petitioner, Mr. Kamal Trivedi, learned<br \/>\n\tAdvocate General assisted by Mr. P. K. Jani, learned Government<br \/>\n\tPleader and Ms. Sangeeta Vishen, learned Assistant Government<br \/>\n\tPleader for the respondents.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate General has very fairly stated that under a mistake, two<br \/>\n\torders were passed by the respondents.  By the first order, the<br \/>\n\trespondents have not extended the term of the Market Committee and<br \/>\n\tby the second order, they have appointed an Administrator and the<br \/>\n\tAdministrator had taken over the charge of the Market Committee.  He<br \/>\n\tfurther submitted that though the order of this Court has not been<br \/>\n\treceived by the respondents, under a mistake, the aforesaid two<br \/>\n\torders have been passed.  The respondents have apologized for the<br \/>\n\tsaid mistake and statement is made by the learned Advocate General<br \/>\n\tthat the respondents are withdrawing both orders with liberty to<br \/>\n\tpass fresh order after going through the order passed by this Court.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate General has further urged that this petition is required to<br \/>\n\tbe heard by the learned Single Judge and not by the Division Bench.\n<\/p>\n<p>However,<br \/>\n\tin view of the statement made by learned Advocate General, counsel<br \/>\n\tfor the petitioner wants to withdraw the writ petition with a<br \/>\n\tliberty to file fresh writ petition.  The prayer is accepted.  The<br \/>\n\twrit petition is dismissed as withdrawn with liberty to file fresh<br \/>\n\tpetition.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t\t[V. M.
