\nsuit for partition and separate possession,*j* “.1<\/p>\n

Legality and o\ufb01rrectnese of the gudgment and
\ndecree passed by the diyil \ufb01udgefl$r.Dn.), Hunsur
\non 5.4.2006 in \ufb01.S.$o.id\u00a7\/9% is ealled in question
\nby the epeeliee\ufb01, 5eee;e;*i. Appellant was 1%
\ndefendant in the \u00a7uitgT Rel to 5 and the appellant
\nare children oi one late S.K.Javarappa who died in<\/p>\n
the year l972Le_} Rel” to 5 instituted suit for<\/p>\n
_partitien4 and ‘separate possession of their 5\/6″‘<\/p>\n
share*i in <fal1__ the plaint schedule property.<\/p>\n
According 'to~ the plaint averements, their father<\/p>\n
vfg \ufb01avarappa' died in 'the year 1972 and 'three years<\/p>\n
ikpriorrto the institution of the suit their mother<\/p>\n
ii:Lahshmamma died. They had another brother by name<\/p>\n
idevarajegowda who died d15 years prior to the date<\/p>\n

suit. He admitted. the relationship between the
\nparties. According to him, item No.3 is not the
\njoint family property and it is his selfweequired<\/p>\n
property. He also contended that them set jnill<\/p>\n
established. by him is out of his Mself#se\u00a7\ufb01iredW.<\/p>\n
property, therefore defendants heve no right pveri<\/p>\n
suit item No.3 and saw mill 4’eslt–ab1ips:he\u00a7i’ iontlitemp<\/p>\n
No.1. In the circumstan\u00e9es, he”,raised_ several
\nother contentions and requestsjthe court to dismiss
\nthe suit. Based on the above plesdings, following<\/p>\n
issues were framed by the triel court:<\/p>\n

In order to Prove their respeetiue contentions? 2″
\nplaintiff Smt.J.Latha, lgunmarried._ daughter of
\nJavarappa, got examined he:$ue’lf”Vof  another
\ndaughter Saraswathi was examined es \u00a7W~2 and relied
\nupon documents AExs.P~1″–to “\u00a7;e.l0nV behalf of’ the
\ndefendants, _l%t defendant” gotvlesanined. himself’ as
\nDW~1 and he relied upon Exs\ufb02D–1 to 32. Trial court
\nafter hearing the parties held issues 1 to 3 in the<\/p>\n
affirmative and issues 4 to 6 in the negative and<\/p>\n
uultimatelp suit filed by the plaintiffs came to be<\/p>\n
decgg\u00e9de in epartf holding that plaintiff No.1 and<\/p>\n
Ksdefendantg Noll and so also 2″” plaintiff are<\/p>\n
uidentitled ta 49\/168″5share and plaintiffs 2 to 4 are<\/p>\n
V*iuentitled to 7\/16?” share. The court further held<\/p>\n
Vffhat” the property standing in the name of the<\/p>\n

plaintiff as per Exs.Dwl0 to 12 are also liable for
\npartition. Against the judgment and decree of the
\ntrial court, plaintiffs have not filed any appeal.<\/p>\n
Therefore, share granted in respect of Exs;DflQ to<\/p>\n
12 has become final. Present appeal is filed bphr<\/p>\n
the appellant who was 1″ defendant in allottingethet<\/p>\n
share to the plaintiffs in respect of;item_Noi3 and
\nrunning saw mill existing {one item: $0.1 of the
\nplaint schedule property.7f<\/p>\n
2. We have heard the counselffor’the parties.<\/p>\n
3. The main contention of the appellant’s counsel
\nbefore usf”2′.s* court did not appreciate<\/p>\n
that suit item No.3 is selfwacquired property of 1″<\/p>\n
“defendant; .h\u00e97,has acquired. the same by ‘utilizing<\/p>\n
the income gxsm the business. According to him,<\/p>\n
trial court has committed an error in granting a<\/p>\n
f”share, in “the machinaries of saw mill which is<\/p>\n
“rL’\u00a2stablished on suit item No.1. In the<\/p>\n
circumstances, he requests the court to rem<\/p>\n
{%\/<\/p>\n
appreciate the entire evidence and documents<\/p>\n
produced by the parties and set aside the judgment<\/p>\n
and decree so far as it relates to the_aboye\ufb01itees,<\/p>\n
He further contends that when the pro\u00a7ertylincluded_l<\/p>\n
under Exs.5-10 to 12 are not “the ,joint”?\u00a7am;1y”<\/p>\n
properties, plaintiffs were not entitled to get 3<\/p>\n
share out of the above said bropertiesry V}<\/p>\n
4. Per contra, counsel for h-l_subbits that trial
\ncourt after agpreciatinc the eyide\ufb01ce let in by the
\nparties and? \u00a7\u00a7n\u00a7iseg\u00a3ng}’t\ufb01\u00a7i{pra1 and. documentary
\nevidencef has gi\u00a7\ufb01\u00a71\u00a7X\u00a7;\u00a7\u00a7\u00a3\u00a7a decree to the parties
\nherein and that no error re committed by the court<\/p>\n
below to call for the interference by this court.<\/p>\n

 from out of his selfwacquired property,<\/p>\n

 that he had his own income either during the<\/p>\n

acquired the suit item No.3. If a property is<\/p>\n

family, unless and until it is rebuttedj”ab_’y_l”‘–him,<\/p>\n
presumption under the Hindu Law that it is e\u00e9qnired<\/p>\n
by him out of the joint \u00a3azni1_y….i_pcoa2\u00e9””a:;’;c1 league “has.<\/p>\n
to be treated as a joint fanily pnopertp.\u00a2 i\ufb01 the
\nabsence of cogent evidence htsl show pthet hthe
\nappellant had his own incone to acquire suit item
\nNo.3, trial court is*\u00a3@stified in disbelieving the
\ncontention of the appellant that suit item No.3 is
\nhis absolute ipsoperty!*: ,nocordingly, we answer<\/p>\n

8. So far as point No\u00a22″is concerned, admittedly<\/p>\n
saw  isl4″‘*eVstVa1:?li’sh\u00e9d on item No.1 which is a<\/p>\n
,joint-family\u00abpropert\u00a7. It is also the case of the<\/p>\n
parties” that “residential house on suit Iten: No.1<\/p>\n
‘Vk,and three shops were constructed during the life<\/p>\n
nlftime of’Javarappa. The only question is that how<\/p>\n
lpthelinwestment is made to establish a saw mill on<\/p>\n
nidsuit item No.1. 1″ defendant who claims to be the<\/p>\n
V” absolute owner of the plant and machinaries of saw<\/p>\n
(\ufb01x<\/p>\n

mill has not placed any material to show___how he<\/p>\n
acquired the same. When he contends that-t:.fhe”*.pAhas<\/p>\n
purchased the same by borrowing loan from <\/p>\n
best piece of evidence was to,\u00bb.s1.;*:_1;;xno_’:i theiivadoclngmentise. ‘<\/p>\n
from the bank to show how the
\nand what was the
\ndischarging the loan,’   dispute
\nthat the saw mill is defendant in
\nhis name as kartiauof :t”rie- When he has
\nestablished    we are of the
\nopinion   justified in dis—\n<\/p>\n
believing the the appellant in regard<\/p>\n
to the saw as the share allotted by<\/p>\n
the t,,r\u00a7ial’~ cotV’1’rt.__in respect of the properties<\/p>\n
 uVnderVA:”E:__cs.D~–l0 to 12, as rightly pointed by<\/p>\n

 is sold  the plaintiffs and if the said property<\/p>\n
diseitzeepossession of some third parties, plaintiffs<\/p>\n
 capnriotbwclaim any share and as a matter of fact<\/p>\n
{plaintiffs have also not claimed any share in the<\/p>\n

plaint. However, trial court (M1 its own without
\neven framing an issue has granted decree in favour
\nof the parties. Therefore, we are of the vieu that<\/p>\n
allotment of share to the plaintiffs under Ers\ufb01pel\ufb02<\/p>\n
to 12 is bad in law and any judgment uassed by thein<\/p>\n
trial court would not bind the third parties what<\/p>\n
are in possession unless and until their sale deed,<\/p>\n
is attacked. In the circu\ufb01stancesg*hoth the points
\nare to be held against the agyellant.\n<\/p>\n
9. In the result,_ this rap\ufb01\u00e9aityis dismissed.<\/p>\n
