Justice S.SIRI JAGAN\n\n Dated :29\/07\/2008\n\n O R D E R\n                        S.SIRI JAGAN, J\n                  ==================\n                   W.P(C)No.19565 of 2008\n                  ==================\n           Dated this the 29th day of July, 2008.\n\n                        J U D G M E N T\n<\/pre>\n<p>      The petitioner challenges Ext.P7 order passed by the 2nd<\/p>\n<p>respondent under Section 7A of the Employees&#8217; Provident Funds<\/p>\n<p>and Miscellaneous Provisions Act, whereby he has decided that<\/p>\n<p>the petitioner&#8217;s establishment is liable to be covered under the<\/p>\n<p>Act and directed the petitioner to comply with the provisions of<\/p>\n<p>the Act and scheme.\n<\/p>\n<p>      2. The petitioner&#8217;s contention is that the petitioner is not<\/p>\n<p>liable to be covered for want of sufficient number of employees<\/p>\n<p>for such coverage. She disputes the Mahazar prepared by the<\/p>\n<p>Enforcement Officers wherein names of 28 persons have been<\/p>\n<p>included as employees of the petitioner.        According to the<\/p>\n<p>petitioner, all of them are not employees of the petitioner. She<\/p>\n<p>also submits that the details and addresses of the persons are<\/p>\n<p>not mentioned in the Mahazar except their names.              The<\/p>\n<p>petitioner also raises a specific contention that Ext.P7 order has<\/p>\n<p>been passed by one of the enforcement officers who had<\/p>\n<p>conducted the inspection of the petitioner&#8217;s premises on his<\/p>\n<p><span class=\"hidden_text\">W.P(C)No.19565 of 2008           &#8211; 2 &#8211;<\/span><\/p>\n<p>promotion as Assistant Provident Fund Commissioner and passed<\/p>\n<p>Ext.P8 Mahazar,which was the basis for the decision in Ext.P7.<\/p>\n<p>According to the petitioner the 2nd respondent has acted as a<\/p>\n<p>judge in his own cause, in so far as he prepared Ext.P8 Mahazar<\/p>\n<p>and passed Ext.P7 order.\n<\/p>\n<p>      3. The learned Standing Counsel appearing for the<\/p>\n<p>Provident Fund Organisation on the basis of written instructions<\/p>\n<p>received by him submits as follows:\n<\/p>\n<blockquote><p>           &#8220;The allegation that the person who adjudicated the<br \/>\n    matter and the person who drew the Mahazar is one and<br \/>\n    the same is levelled with a motive of diverting the<br \/>\n    attention from the original facts to unimportant technical<br \/>\n    procedures.      The inquiry Officer is a quasi &#8211; judicial<br \/>\n    authority and as such inquiry shall deemed to be a judicial<br \/>\n    proceedings in all sense. His multifunctional role as APFC<br \/>\n    or other position he was holding or any other job he had<br \/>\n    executed by virtue o his Official position prior to this<br \/>\n    enquiry must not had any bearing on the inquiry. The<br \/>\n    inquiry was solely depend on the documentary evidence or<br \/>\n    records produced before him where decisions were not<br \/>\n    taken leasurely but truly, judiciously, objectively and<br \/>\n    impartially.\n<\/p><\/blockquote>\n<blockquote><p>           The habitual practice of the Employer to file various<br \/>\n    Writ petition before the Hon&#8217;ble Court for escaping from<br \/>\n    the statutory provisions of the Society Security Act and for<br \/>\n    denying the Labour benefits of the poor class of<br \/>\n    employees may be brought to the notice of the Hon&#8217;ble<br \/>\n    Court and pray for the dismissal of the petition at the first<br \/>\n    hearing itself allowing the statutory Organisation of<br \/>\n    E.P.F.O to secure prompt compliances from the petitioner<br \/>\n    establishment and to allow the Legal Costs for the<br \/>\n    Respondent E.P.F.O.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P(C)No.19565 of 2008          &#8211; 3 &#8211;<\/span><\/p>\n<p>      4. I am of opinion that the stand of the 2nd respondent is<\/p>\n<p>totally against the basic principles of natural justice. A person<\/p>\n<p>cannot be a judge in his own cause. Here, admittedly the person<\/p>\n<p>who has passed Ext.P7 order conducted the inspection and is a<\/p>\n<p>signatory to Ext.P8 Mahazar.       That being so he cannot have<\/p>\n<p>validly passed Ext.P7 order on the basis of the Mahazar prepared<\/p>\n<p>by himself. Therefore, Ext.P7 is in violation to the principles of<\/p>\n<p>natural justice. Therefore, Ext.P7 is quashed. It would be open<\/p>\n<p>to the 1st respondent to either decide the matter himself afresh<\/p>\n<p>or authorise another Competent Assistant Provident Fund<\/p>\n<p>Commissioner to pass fresh orders under Section 7A after<\/p>\n<p>affording an opportunity of being heard to the petitioner which<\/p>\n<p>shall include opportunity to adduce the evidence also.<\/p>\n<p>      The writ petition is allowed as above.\n<\/p>\n<\/p>\n<p>                                        S.SIRI JAGAN, JUDGE<\/p>\n<p>rhs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court C.
