A.L.DAVE)<\/p>\n<p>\tRule.\n<\/p>\n<p>Learned A.G.P. Ms.Krina Calla waives service of notice of rule for<br \/>\nthe respondents.\n<\/p>\n<p>2.\tBy<br \/>\nthis application, the original petitioners-appellants seek following<br \/>\nreliefs:-\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships may be pleased to allow this \tCivil Application;\n<\/p>\n<p>(B)\tYour<br \/>\nLordships may be pleased to dispose the \tCivil Application as well as<br \/>\nLetters Patent \tAppeal with a direction to dispose off the \tRevision<br \/>\nApplication preferably within three \tmonths from receipt of the writ<br \/>\nand further \tbe pleased to direct the respondents herein \tto maintain<br \/>\nstatus quo till the final \tdisposal of the Revision;\n<\/p>\n<p>(C)\tsuch<br \/>\nother and further relief\/s as may be \tdeemed just in the facts and<br \/>\ncircumstances \tof the present case may kindly be granted.&#8221;\n<\/p>\n<p>3.\tThis<br \/>\nCourt had issued the following directions in the main appeals by<br \/>\norder dated 13.5.2011:-\n<\/p>\n<p>&#8220;Notice<br \/>\nfor final disposal returnable on 16th June, 2011.\n<\/p>\n<p>By<br \/>\nad-interim order, it is directed that the possession shall remain<br \/>\nwith the District Collector, but the appellant shall be at the<br \/>\nliberty to remove the goods lying inside the premises. It is further<br \/>\ndirected that after the goods are removed, the District Collector<br \/>\nshall apply the seal and at that stage, if the appellant so desires,<br \/>\nthe appellant may also apply a lock over the premises. Both the<br \/>\nprocess shall be undertaken in presence of the representative of the<br \/>\nDistrict collector as well as in presence of the appellant.\n<\/p>\n<p>The<br \/>\nrespondents shall also report to this Court as to why the aforesaid<br \/>\ninterim arrangement should not be allowed to be continued untill the<br \/>\nrevision is finally disposed of.\n<\/p>\n<p>Direct<br \/>\nService is permitted.&#8221;\n<\/p>\n<p>4.\tIt<br \/>\nis thus clear that the possession of the premises is with the<br \/>\nDistrict Collector and some goods of the appellants are lying inside<br \/>\nthe premises.\n<\/p>\n<p>5.\tIn<br \/>\nthe facts and circumstances of the case, the Civil Applications and<br \/>\nthe Letters Patent Appeals are disposed of by passing the following<br \/>\norder:-\n<\/p>\n<p>6.\tThe<br \/>\nrevisional authority shall hear the parties and decide the Revision<br \/>\nApplication Nos. (1) MVV\/JMN\/Kutchh\/23\/2011, (2)<br \/>\nMVV\/JMN\/Kutchh\/18\/2011, (3) MVV\/<br \/>\nJMN\/Kutchh\/20\/2011,(4)MVV\/JMN\/Kutchh\/24\/2011,<br \/>\n(5)MVV\/JMN\/Kutchh\/19\/2011,(6) MVV\/JMN\/Kutchh\/22\/2011, and (7)<br \/>\nMVV\/JMN\/Kutchh\/25\/2011, in<br \/>\naccordance with law, without being influenced by the orders passed in<br \/>\nthe writ petitions. The decision would be rendered within a period of<br \/>\nthree months from the date of receipt of this order. In the meantime,<br \/>\nthe parties shall maintain status-quo, to mean that possession of the<br \/>\npremises along with the goods lying therein will remain with the<br \/>\nDistrict Collector, till the decision by the revisional authority is<br \/>\nrendered.\n<\/p>\n<p>7.\tThe<br \/>\nLetters Patent Appeals and the Civil Applications are disposed of<br \/>\naccordingly.
